HomeMy WebLinkAbout1973-01-26 - Board of Directors Meeting Minutes970 January 26, 1973 The adjourned meeting of the Board of Directors of the Yorba Linda County Water District was called to order by President McGuire in the offices of the District on Plumosa Drive at 8:30 a.m. January 26, 1973. Directors present and an- swering the roll: McGuire, Clodt, Wagner, Knauft and Hastings. Also present: Ralph Shook, Jean Mathews, Attorney Fritz Stradling, Pete Royere and DuWayne Lidke. Minutes for January 11, 1973 were unanimously approved as mailed on a motion made by Director Wagner seconded by Director Hastings. General Manager Shook announced that the annual AWWA Conference would be held at Las Vegas May'3:~Ethrough the 18th. Reservations to be made on or after February 6th, Ralph McGuire, Rex Hastings, and Fred Clodt said they would try to attend. Moved by Director Hastings seconded by Director Knauft that the Directors and the staff as approved by General Manager be allowed to attend at District expense. License from Southern California Edison approved as to form by Attorney Stradling. Moved by Director Wagner seconded by Director Clodt carried unanimously to approve the Permit or License(easement) to Reservoir # 3 as drawn up by Southern California Edison and authorize the proper officers to execute the document. Fred Clodt reported on the City council meeting on January 15, 1973. Ralph McGuire reported on the Planning Commission meeting January 22, 1973. Sam Peterson came into the meeting at 9:00 a.m. Assessment District 72-3 - S-708 Public Hearing: President McGuire announced this is the time and place fixed by this Board of Directors for hearing objections or protests on the proposed work, or the extent of the assessment district or on the proposed grades under the Resolution of Intention No. 256, covering the construction of certain sanitary sewers, ap- purtanances and appurtenant work in the Yorba Linda County Water District. Secretary presented the affidavits of publication, mailing and posting notice of hearing and affidavit of filing assessment diagram. Moved by Director Clodt seconded by Director Hastings to approve the affidavits and ordered same filed. Motion carried unanimously. Secretary stated there were no written protests. The President asked if there was anyone present to make oral protest. There was no one present to make oral protests. The Engineer, Sam Peterson gave testimony that the project was of benefit to all lands within the District. The General Manager concurred. President McGuire then asked the General Manager what percentage of the area of the property to be assessed for the proposed improvement is represented by written protest. General Manager stated there was no protests. Moved byDirector Knauft seconded by Director Hastings to adopt RESOLUTION NO. 73-3 entitled:RESOLUTION OF THE BOARD OF DIRECTORS OF YORBA LINDA COUNTY WATER DISTRICT, ORANGE COUNTY, CALIFORNIA, ORDERING THE CONSTRUCTION OF SANITARY SEWER WORK IN THE YORBA LINDA COUNTY WATER DISTRICT, ORDERING POSTING AND PUBLICATION OF NOTICES INVITING SEALED PROPOSALS OR BIDS. Roll call vote: Ayes, McGuire, Clodt, Hastings, Wagner and Knauft. Noes, none. Absent, none. Adopted this 26th day of January 1973. Moved by Director Knauft seconded by Director Clodt to adopt RESOLUTION NO 73-4 entitled:RESOLUTION OF THE BOARD OF DIRECTORS OF YORBA LINDA COUNTY WATER DISTRICT, ORANGE COUNTY, CALIFORNIA, DETERMINING THE GENERAL PREVAILING RATE OF PER DIEM WAGE AND THE GENERAL PREVAILING RATE FOR LEGAL HOLIDAY AND OVER- TIME WORK IN SAID DISTRICT FOR CERTAIN CRAFTS OR TYPES OF WOR1Q"IEN AND APPROVING A PROVISION FOR LIQUIDATED DAMAGES. Job s 23-1630 John P.Alley - staff recommendations and exhibits reviewed. Moved by Director Knauft seconded by Director Clodt carried unanimously to approve staff recommendations for sewer for Job S 23-1630. Job 735 - Mr. Hartley exhibits and application reviewed. Moved by Director Clodt, seconded by Director Knauft carried unanimously to approve staff re- commendations of water for Job 735. 972 January 26, 1973 (continued) Moved by Director Knauft seconded by Director Hastings carried unanimously to approve for payment the audited bills and rate deposits in the amount of $73,274.76 on checks No. 21690 through 2.1754. Moved by Director Clodt seconded by Director Hastings that all Directors be allowed to leave the State for either business or personal reasons between this meeting and the next regular meeting of the Board. Jim Kerfoot came into the meeting and explained the Social Security Resolution that would be necessary to adopt authorizing the District to participate in Federal Social Security Act. Moved by Director Knauft seconded by Director Hastings to adopt RESOLUTION NO. 73-9 entitled: Authorizatinn for Coverage Under Federal Social Security Act. Roll call vote: Ayes, McGuire, Clodt, Hastings, Knauft and Wagner. Noes, none. Absent, none. Adopted this 26th day of January 1973. Attorney Fritz Stradling read a letter from Rutan and Tucker regarding the meter anti trust case. Discussion. Moved by Director Wagner, seconded by Director Knauft to authorize the District to withdraw from the suit per the recommendation of the Attorney. Fred Clodt reported on the California Special District Association meeting at Monterey. Discussion - new membership stressed, education on Special Districts where Supervisors and other governmental agencies are concerned. S.B. # 90 now being reworked. Ralph Shook reported on the reservoir construction schedule. Mr. Shook also reported that he had a meeting with Mr. Bryant on Friday the 19th. DuWayne Lidke and Pete Royere were present also and he felt that it was a very good step toward better understanding of the District and what it had to offer for area East of Yorba Linda for Mr. Bryant. DuWayne Lidke reported on the Yorba Linda Blvd. construction scheduling. Moved by Director Knauft seconded by Director Wagner to adjourn at 11:30 a.m., motion carried unanimously. ean E.
