HomeMy WebLinkAbout1973-04-30 - Board of Directors Meeting Minutes985 April 30, 1973 The adjourned regular meeting of the Board Linda County Water District was called to at 8:30 a.m. April 30, 1973 in the offices Drive. of Directors of the Yorba order by President McGuire of the District on Plumosa Directors present and answering the roll: McGuire, Hastings,Clodt, Wagner and Knauft. Also present were DuWayne Lidke,Engineer with James Montgomery, Ralph Shook, General Manager, Jean Mathews, Secretary, H. Rodger Howell of Rutan and Tucker and Pete Royere, Water Superinten- dent. Moved by Director Hastings, seconded by Director Clodt carried,to approve the minutes for April 12, 1973 as corrected. Letter from the Yorba Linda School District asking that District participate in a meeting April 28 regarding the proposed two million dollar bond issue. Received and filed. Reservations for the barbecue lunch at the Perris Dam Dedication on May 18. Several will try to attend on way back from AWWA Conference. R. McGuire reported on the April 16 meeting of City Council R. Knauft reported on the April 23 meeting of the Planning Commission. President McGuire announced, " The hour of 9:00 A.M. on April 30th time for the hearing of protests, objections or appeals in respect of the assessment and work under and pursuant to resolution of intention, Resolution No. 236, and the Improvement Act of 1911" Secretary presented the affidavits of publication, mailing and posting notice of hearing on assessment. Moved by Director Clodt seconded by Director Hastings carried unanimously to accept the affidavits as presented and ordered same filed. General Manager read in full the one written protest filed with the Secretary, from Leonard Morgan as follows: I'd like to file a protest with you to assessment on our property at 16661 Loie St. 334-07101 Parcel #5 in the amt. of $1336.28. We are financially unable to meet this and we did not sign for sewers as our septic tank is fine and we are not connecting to the sewers. Sincerely, Leonard P. Morgan. President McGuire asks," Does any person who has filed a written pro- test, or his representative desire to be heard in support of such protest?" No person present to support the written protest. President McGuire asks: "Does any person wish to make an oral protest?" No one present to make oral protest. Moved by Director Wagner seconded by Director Knauft that the following RESOLUTION NO. 73-16 be adopted: RESOLUTION OF THE BOARD OF DIRECTORS OF YORBA LINDA COUNTY WATER DISTRICT, CALIFORNIA, MAKING DETERMINATIONS AND CONFIRMING ASSESSMENT AND PROCEEDINGS UNDER RESOLUTION OF INTENTION, RESOLUTION NO. 236, Assessment District No. 72-2. 986 April 30, 1973 (continued) WHEREAS, The Engineer of the Yorba Linda County Water District, California has heretofore filed in the office of the Secretary of said District an,'.assessment and diagram for that certain work or improvement in said District done under and pursuant to the Im- provement Act of 1911, Division 7 of the Streets and Highways Code of the State of California, and resolution of intention, Resolution No. 236, adopted by this Board of Directors on the 28th day of September, 1972; and WHEREAS, after the filing of said assessment and diagram the said Secretary has, as required by law, given notice of the filing of said assessment and of the time fixed in said notice for hearing by this Board of Directors and affidavits of publication, posting and mailing of such notices have been approved by this Board of Directors and are on file; and WHEREAS, at the time and place fixed in such notice a hearing was duly held by this Board of Directors at which all written appeals, protests or objections were duly presented and read, and all persons desiring to be heard thereon were heard, and this Board of Directors gave all persons present an opportunity to be heard in respect of any matter relating to said work or improvement, to any act or determina- tion of the Engineer of said District, to the contract for said work or the performance of said assessment of said diagram, or to any other act, determination or proceedings of said Engineer, or to any matter relating to said work, the assessment district or the proceed- ings therefor; and WHEREAS, all such persons desiring to be heard have been heard by this Board of Directors, and that this Board of Directors is fully informed in the premises: NOW THEREFORE, the Board of Directors of Yorba Linda County Water District DOES HEREBY FIND, RESOLVE, DETERMINE AND ORDER as follows: SECTION 1. That said hearing has been duly held; that each and every step in the proceedings prior to and including the hearing has been duly and regularly taken; that this Board of Directors is satisfied with the correctness of the assessment, the diagram, the proceedings and all matters relating thereto, and all protests, objections, or appeals be and the same are hereby overruled and denied except to the extent heretofore allowed, and this Board of Directors does hereby confirm said proceedings and said assessment. SECTION 2. That this resolution shall be entered upon the minutes of this Board of Directors. ADOPTED, SIGNED AND APPROVED this 30th day of April, 1973. Roll call vote: Ayes, McGuire, Wagner, Clodt, Hastings and Knauft. Noes, none. Absent, none. Suggested that the General Manager write Leonard Morgan a letter ex- plaining that his letter of protest had been received and read. 987 April 30, 1973 (continued) Mr. Knauft, Mr. McGuire, Mr. Wagner and Mr. Shook reported on the ACWA Conference on April 25-27. DuWayne Lidke reported that the Health Department tests from the new reservoir had come back negative and all leaks are sealing up so that the back fill could be started and should be ready to connect into the system in about two weeks. Pete Royere reported on Well No. 11 progress. Ralph Shook reported that he had talked with Fred Harper of Sanitation District and the sewer up Santa Ana Canyon is about 4 years away, however the Palm Drive sewer will be ready for bid in July so this should event- ually do away with the lift station on Palm. Mr. Lowry has leased the Olinda property, starting on May 1. Mr. Bradford unable to complete the lease as stated at previous meeting. Pete Royere reported on the Orange County Water District meeting regarding pump tax. Basin percentage for 1973-74 is 700 - 300 and the tax has been increased from $13.00 to $17.00 per acre foot. A letter from Auditor Controller of the County of Orange explaining about Senate Bill # 90 and the tax limit. Letter from the City of Yorba Linda dated April 16 regarding Parks and Recreation, need someone from the District to serve on the committee. Mr. Royere reported that Mr. Toler had fenced across the Well No. 14 site so that we are unable to have access. He also stated that $500.00 would be all he would pay for the parcel. Mr. Royere to talk to him again and see if he would accept the responsibility of abandoning the well if we accepted the $500.00 offer, if not it will be necessary to re-fence so that we have access. S 708 Assessment District 72-3, 19 lots permits for connection - to be figured at $400.00 per acre. This is a request for blanket permission for connection permits for these 19 lots involved in 72-3. Moved by Director Wagner seconded by Director Clodt that General Manager be authorized to sign these permits without bringing each one to the Board for approval. Motion carried unanimously. Water and sewer for Job 582 Tract 7033 Mark III applications and exhibits presented. Sewer costs $14,731.10 and water $13,413.70 with a possible refund on sewer of $8,080.10. Moved by Director Wagner seconded by Director Clodt carried unanimously to approve staff re- commendations for Job 582. 988 April 30, 1973 (continued) Assignments for City Council May 7 R. McGuire, May 21, R. Hastings. Planning Commission May 14 R. Knauft and May 29 F. Clodt. DuWayne Lidke reported on the proposal for a new Master Plan, the proposed scope and work that would be covered. Total price not to exceed $19,000. Discussion moved by Director Wagner seconded by Director Knauft to approve the proposal as presented by Mr. Lidke and the Bryant Ranch to be included in the area covered. Roll call vote: Ayes, McGuire, Hastings, Clodt, Knauft and Wagner. Noes, none. Absent none. Directors fees discussed, Mr. Shook to get the resolution passed by Costa Mesa County Water District before any decision is made to change.
