Time permitting, it is generally in the District’s interest to discuss these more complex matters at one meeting and consider formal action at another meeting. TELECONFERENCE INFORMATION Was included on the agenda. 2. CALL TO ORDER The Yorba Linda Water District/City Council Joint Advisory Committee meeting convened at 4:00 p.m. 3. ACTION CALENDAR 6.1 Minutes of the YLWD/City of Yorba Linda Joint Agency Committee meeting held November 8, 2021. Moved by Hernandez Seconded by Lindsey That the YLWD/City Council Joint Advisory Committee approve the minutes of the November 8, 2021 meeting. AYES (4): Haney, Hernandez, Miller, and Lindsey CARRIED (4 to 0) 7. DISCUSSION ITEMS 7.1 Status of PFAS Water Treatment Plant Engineering Manager Rosanne Weston provided an update on the PFAS Water Treatment plant and stated that as of December the plant is operating and serving water. Municipal Water District of Orange County (MWDOC) Director Al Nederhood inquired if there were plans to increase groundwater production to 75%. Operations Manager John DeCriscio responded that the District is currently working with Southern California Edison to resolve electrical issues which will enable YLWD to operate the booster pump station to increase treatment plant output. Councilwoman Haney asked about the resolution supporting Federal PFAS legislation and Public Affairs Manager Alison Martin explained the purpose of the resolution. Staff responded to questions from the Committee on the background of the legislation and the potential impacts to ratepayers. 7.2 Statewide Drought Conditions Public Affairs Manager Alison Martin spoke about the low amount of rainfall this year and reviewed the State Water Resources Control Board's (SWRCB) new emergency drought rules effective January 15 which water districts are being asked to enforce with no funding from the state. ITEM NO. 6.1. Page 4 of 12 3 A lengthy discussion ensued among staff and committee members regarding water rates, imported water, rainfall and ongoing drought conditions. MWDOC Director Al Nederhood commented that it is a serious and complicated issue with a wide range of solutions and problems. 7.3 Status of Housing Developments (Proposed and In-Progress) Planning Manager Nate Farnsworth gave an update on housing developments in the city and responded to questions from the Committee. General Manager of East Lake Village Community Association Susan Janowicz, spoke about drought conditions and asked the District to forward any new watering conditions to her and she would distribute to the Association. 7.4 West Bastanchury MOU Director of Public Works/City Engineer Jamie Lai provided an overview of the West Bastanchury Road Widening project which includes integrating a new alignment of an existing water line. Staff is working collaboratively with the District on this project and the Memorandum of Understanding will outline the specifics and responsibilities of each agency. Ms. Lai indicated the project would begin in the spring. 7.5 Future Meeting Date, Agenda Items, Location Director Lindsey expressed his appreciation for the Committee and emphasized the strength in working together. Future meeting dates, agenda items and location were not discussed. 8. ADJOURNMENT Mayor Pro Tem Hernandez made a motion, seconded by Director Lindsey, to adjourn the meeting at 4:47 p.m. Motion carried on a roll call vote. ITEM NO. 6.1. Page 5 of 12 ITEM NO. 7.2. AGENDA REPORT MEETING DATE:April 25, 2022 TO:Committee Members FROM:Doug Davert, Assistant General Manager / Interim General Manager STAFF CONTACTS:Alison Martin, Public Affairs Manager SUBJECT:Statewide Drought Conditions Governor Newsom Issues Executive Order to Bolster Drought Response A copy of the executive order can be found here. Following the driest first three months of a year in the state’s recorded history, in March, Governor Gavin Newsom took steps to drive water conservation at the local level, calling on the State Water Resources Control Board (SWRCB) to CONSIDER the following provisions: Requiring local water suppliers to move to Level 2 (up to 20%) of their Water Shortage Contingency Plans, which require actions that will conserve water across all sectors. Banning irrigation of “non-functional” turf (or grass), such as decorative grass adjacent to large industrial and commercial buildings. The ban would not include residential lawns or grass used for recreation, such as school fields, sports fields, and parks. The SWRCB has until May 25, 2022, to make these considerations. Webinars on proposed provisions related to this Executive Order will be held on April 21 and April 28, 2022. In addition to the SWRCB considerations, this Executive Order includes the following provisions: Encouraging Californians to use SaveOurWater.com to learn ways to reduce everyday water use. Suspends all local prohibitions on hauling water for human consumption, cooking, or sanitation out of a water basin of origin, or public agency jurisdiction. Expands State Water Board inspections for illegal diversions and/or waste and unreasonable use of water. Page 6 of 12 Expedites petitions for point of diversion and place of storage to protect fish and wildlife where drought conditions threaten their health and survival. Local governments may not approve a permit for a new groundwater well or alteration of an existing well in a basin with a Groundwater Sustainability Agency (medium- or high- priority) without first obtaining written verification from the managing Groundwater Sustainability Agency; and must determine that the groundwater is not likely to interfere with nearby wells and/or cause subsidence that may damage nearby infrastructure. This excludes small and domestic wells. Expedites and reduces permitting requirements for groundwater recharge projects to support future flood flows. Requests state agencies to submit proposals for drought mitigation by April 15, 2022, for inclusion in the Governor’s May Revision budget.
