HomeMy WebLinkAbout1973-10-11 - Board of Directors Meeting MinutesOctober 11, 1973 1021 The regular meeting of the Board of Directors of the Yorba Linda County Water District was called to order by President Hastings at 8:30 A.M. October 11, 1973 in the office of the District on Plumosa Drive. Directors present and answering the roll: Hastings, Wagner, Knauft, Lindow and Clodt. Also present, General Manager Ralph Shook, Engineer Du Wayne Lidke, Attorney H. Rodger Howell, Gordon Peterson, Auditor. Moved by Director Wagner seconded by Director Hastings and carried unanimously that Gordon Peterson be appointed recording secretary for the regular board meeting of October 11, 1973. Director Wagner moved that the minutes for September 13, 1973 be approved as mailed, motion seconded by Director Clodt, carried unanimously. Rules 15 and 16 of the District Personnel Manual were discussed at length. Moved by Director Wagner seconded by Director Lindow that the Board adopt RESOLUTION NO. 73-28 ammending Rule 15 of the Yorba Linda County Water District Personnel Manual. Roll call vote: Ayes, Lindow, Hastings, Knauft, Clodt and Wagner. Noes, none. Passed and adopted this 11th day of October, 1973. RESOLUTION No. 73-28 RESOLUTION OF THE BOARD OF DIRECTORS OF THE YORBA LINDA COUNTY WATER DISTRICT AMMENDING RULE NO. 15 OF THE YORBA LINDA COUNTY WATER DISTRICT.PERSONNEL MANUAL WHEREAS, Resolution No. 160 was adopted August 23, 1967 setting forth the personnel policy of the District, and, WHEREAS, it is necessary from time to time to ammend and update the policy; NOW THEREFORE, BE IT RESOLVED by the BOARD OF DIRECTORS of the YORBA LINDA COUNTY WATER DISTRICT that RULE NO. 15 be ammended as follows: 1022 October 11, 1973 (continued) RULE 15. HOLIDAYS SECTION 15.0- The following days shall be recognized as holidays: and regular, full-time employees in the classified service, with the exception of employees in those job classes listed in Section 15.3, shall have these holidays off with pay: (a) January 1st New Year's Day (b) The third Monday in February, Washington's Birthday (c) The last Monday in May, Memorial Day (d) July 4th Independence Day (e) First Monday in September, Labor Day (f) Admission Day September 9th (g) Columbus Day second Monday in October (h) November 11th Veterans Day (i) December 25th Christmas Day (j) Every day appointed by the President or Governor for a public feast,thanksgiving or holiday. The Friday following the Thursday appointed as Thanksgiving day shall also be celebrated as a holiday. (k) Good Friday from 12 noon. SECTION 15.01 - Regular part-time employees shall receive holiday reimbursement in proportion to the average or normal hours worked as a part-time regular employee. (i.e. 4 hours worked by a regular part-time employee would be paid 4 hours on a holiday) SECTION 15.1 - The General Manager, the Secretary and the Auditor shall also be given the above holidays off with pay. SECTION 15.2 - In the event that any of the above holidays fall on an employee's scheduled day off, the following scheduled work day will be observed in lieu of the holiday unless another day is designated by the General Manager. SECTION 15.3 - Certain designated employees may be required to work on any of the above holidays or days observed in lieu of those holidays. Any employee required to work on any of the above holidays shall re- ceive additional compensation equivalent to one and one-half times his regular rate of pay, or have the option of taking the time off (not to exceed an accumulation of forty (40) hours in lieu of pay - see Section 6.03. Any employee required to work on any day observed in lieu of any of the above holidays shall receive additional compensation equivalent to his regular rate of pay. Employees in the job classes listed in Section 6.04 shall be exempt from the provisions of this Section. SECTION 15.4 - Any holidays falling on a Saturday or Sunday may be taken at a time designated by action of the General Manager or the Board of Directors. RESOLUTION No. 73-29 RESOLUTION OF THE BOARD OF DIRECTORS OF THE YORBA LINDA COUNTY WATER DISTRICT AMMENDING RULE NO. 16 OF THE YORBA LINDA COUNTY WATER DISTRICT PERSONNEL MANUAL WHEREAS, Resolution No. 160 was adopted August 23, 1967 setting forth the personnel policy of the District, and, WHEREAS, it is necessary from time to time to ammend and update the policy; NOW THEREFORE, BE IT RESOLVED by the BOARD OF DIRECTORS of the YORBA LINDA COUNTY WATER DISTRICT that RULE NO. 16 be ammended as follows: RULE 16. VACATION SECTION 16.0 - Employees in the classified service shall receive annual vacation with pay in accordance with the following provisions: 1024 October 11, 1973 (continued) 16.010 Regular, full-time employees with an average regular work week of forty (40) hours shall accrue paid vacation at the following rate per year, or fraction thereof: After 1 years service - 80 hours or 10 days After 5 years service - 88 hours or 11 days After 10 years service-103 hours or 13 days After 15 years service-120 hours or 15 days After 20 years service-160 hours or 20 days 16.011 Regular, part-time employees with an average regular work week of at least twenty (20) hours, but less that thirty (30) hours shall accrue paid vacation at the following rate per year, or fraction thereof: After 1 years service - 60 hours or 72 days After 5 years service - 44 hours or 512 days After 10 years service- 512 hours or 612 days After 15 years service- 60 hours or 72 days After 20 years service- 80 hours or 10 days 16.012 Regular, part-time employees with an average regular work week of at least thirty (30) hours, but less than forty (40) hours shall accrue paid vacation at the following rate per year, or fraction thereof: After 1 years service - 60 hours or 72 days After 5 years service - 66 hours or 82 days After 10 years service- 77 hours or 9 3/4 days After 15 years service- 90 hours or 11.1/4 days After 20 years service-120 hours or 15 days 16.02 For vacation accrual the 31st day of December shall be considered the ending of the accrual year and all accruals for the preceding 12 months or fraction of a year thereof shall be credited to the employee at this time. Vacations accrued prior to December 31 of any year may not be taken until after January 1 of the following year except by a waiver of this rule by the General Manager. 16.03 Paid vacations shall continue to accrue in accordance with the above provisions during any period of leave with pay. SECTION 16.1 - All vacations shall be scheduled and taken in accordance with the best interest of the District and the department or division in which the employee is employed. SECTION 16.2 - The maximum amount of vacation that may be taken at any given time shall be that amount that has accrued to the employee con- cerned. The minimum amount of vacation that may be taken at any given time shall be four hours. 1025 October 11, 1973 (continued) SECTION 16.3 - A permanent full time employee shall be eligible to take any accrued vacation after the first day of January of the year following his employment. SECTION 16.4 - Each employee shall have one (1) hour deducted from his accrued vacation time for each hour of vacation taken. An employee with a regular work day of eight (8) hours shall have eight (8) hours deducted from his accrued vacation time for each day of vacation taken. SECTION 16.5 - Vacation which is accrued, but not taken will be forfeited except with written permission from and at the discretion of the General Manager to accumulate it. The maximum that may be accumulated shall not be more than one half (2) years accrual. The General Manager,Secretary and Auditor are exempt from this section of this rule. SECTION 16.6 - Upon termination, an employee shall be compensated in cash at his current rate of pay for any vacation accrued but not taken, provided that he has successfully completed his probationary period. SECTION 16.7 - In the event that any recognized holiday occurs during any employee's vacation, with the exception of employees in the job classes listed in Section 15.3, the holiday shall not be charged against the employee's accrued vacation. The only vacation hours that shall be charged against any employee's accrued vacation shall be those hours that the employee is regularly scheduled to work. SECTION 16.8 - No employee may draw accrued vacation until his pro- bationary employtment period has been satisfactorily completed; see RULE 9. AND BE IT FURTHER RESOLVED that the effective date of the Revision be October 11, 1973. The General Manager was directed to review the sick leave policy and report his finding and recommendations to the Board. Roy Knauft reported on October 1, 1973 City Council Meeting. Mountain View will be paved in 1974 or 1975. Distribution of City Brochure was also discussed. Rex Hastings reported on the Committee Meeting of the Park and Recreation Commission. Attorney Rodger Howell reported on Annexations 72-1, 72-3 and 73-1. Annexation 73-1 has cleared. The status of Annexation 72-1,72-3 is unknown at this time. Discussion on SB 716. A report was made by Director Lindow on the Planning Commission meeting of October 9, 1973. The appeal made by the City Council on Flatten property development without sewers to be heard at October 15 Council meeting. Staff to prepare presentation for the appeal. 1026 October 11, 1973 (continued) Moved by Director Knauft seconded by Director Wagner carried un- animously to approve audited bills and rate deposits in the amount of $58,636.16 on checks 23409 through 23583. Moved by Director Wagner seconded by Director Lindow all Directors are hereby authorized to leave the State for either business or personal reasons between this regular meeting and the next regular meeting of the Board. Motion carried unanimously. General Manager reported on the Orange County Water District tour of October 13, 1973 to various Water collection, storage, processing and distribution facilities in and near Orange County. A report was also made on the greenbelt water rate presentation to the Assembly Committee or. Water held on October 2 8 3,1973 at Harbison Hall, Pasadena City College. Report by Auditor Gordon Peterson on letter to District Group Retirement Insurance Company (North Western National Insurance Company) requesting information on the possibility of transferring employers and employees vested funds to the Public Employees' Retirement System of the State of California. Operations Manager Pete Royere gave a report on the Fiesta Day parade to be held on Saturday October 27, 1973. General Manager made a report on the AWWA, California Section, conference held at Oakland, California on September 26 through September 28, 1973. General Manager read letter from City of Anaheim requesting temporary water connection on Lakeview Ave. Moved by Director Lindow seconded by Director Knauft to approve staff recommendations on serving water to 1290 Lakeview to Anaheim through a 1" service on a temporary basis. Motion carried unanimously. General Manager read a draft of a letter to the Huntington Beach City Council relating to the necessity of increasing sources of power to produce electricity. Upon a motion duly made by Director Clodt seconded by Director Wagner the Board of Directors authorized the General Manager to send the letter supporting Southern California Edison Company in their effort to produce additional power for electricity. 5-1-436 Bailey McCune, 3514 Merienda Lane. Payan, 4682 Prospect. Motion by Director Wagner seconded by Director Lindow to approve staff recommendations. Motion carried unanimously. Director Wagner moved to approve Christmas gift certificates for District employees in the amount of $12.50 each, seconded by Director Clodt. Motion carried unanimously. Letter read by Manager on Secretary Seminar held in Palm Springs, California on October 5 and 6, 1973. Notification was received late so District official was unable to participate in the Seminar.
