HomeMy WebLinkAbout1966-01-26 - Board of Directors Meeting Minutes477 January 26, 1966 The adjourned meeting of the Board of Directors of the Yorba Linda County Water District was called to order at 8:30 A.M. by President Wagner at the office of the District on January 26, 1966. All directors were present and answered the roll. Also present was H. Rodger Howell attorney for the District. General Manager Shook read a letter from A.W.W.A. telling of the death of Harvey Satorious® The Board expressed deep regret to hear of Mr. Satorious death. Announcement was made of the reconvened session of A.W.W.A. in Hawaii in October of 1966. Also the National Convention in Miami. General Manager stated that he had planned his vacation for this period and he was going to try to make the aawaii Session. A letter from Sam Hurwitz giving the date of the Kraemer matter hearing as Feb. 10, 1966 at 9:00 A.M. in Dept. 5 Staff and attorney to be present with records and data. Fred Clodt aid Rex Hastings reported on the meeting January-20 at Costa Mesa of the Public Agency Committee. The committee to be made up of retail water users and public water agencies only, who have the same problems locally: Each organization belonging to the committee will have one vote. A report to be mailed later. Discussion regarding the Water Replenishment Assessment. The current payment is the highest single assessment we have ever paid. The percentage of domestic increases and the percentage of irrigation decreasing all the time. Mr. Shook reported that he had met with representatives of District Insurance Associates and felt they had a worthwhile service to offer. Motion by Director Milmoe seconded by Director McGuire, carried unanimously to have the insurance survey made for a cost of $250.00. H. Rodger Howell said there was very little to report on the Brea matter but that he had an appointment next week with the attorney for the City of Brea, Mr. Wheyland and the Mayor, Mr. Spears. Discussion regarding the dirt removal for Job 431. Discuss the contract with Pete Loucks and see if there are some changes that could be made wo that it would be acceptable to both District and Mr. Loucks. General Manager read a letter from the Orange County Planning Commission dated 1/25/66 asking the District to make and present a presentation of the District's sewer facilities etc., date will be all right and staff will make the presentation. Mr. Shook read a letter from Leonard Lemke along with a bill from a tree surgeon for removal of a gum tree damaged when sewer man- hole was installed. Motion by Director Clodt, seconded by Director 478 January 26, 1966 ( continued) Hastings and carried unanimously that District pay the bill for tree removal but ask Mr. Lemke to sign a letter which would be a simple hold harmless agreement. Manager asked to check with insurance carrier regarding their refusl to pay this claim and show the them statement from tree surgeon. Foxboro Service Agreement - Motion made by Director McGuire,. seconded by Director C1odt carried unanimously to renew agreement for one year. 10:00 A. M.' Bid Opening Job 412. One bid late Regal Construction received at 9:00 A.M. January 26, and the time should have been 8:30 A.M. January 25, 1966. Motion by Director Milmoe seconded by Director McGuire carried unanimously to return bid`to Regal Construction unopened. Motion by Director Milmoe, seconded by Director Hastings carried unanimously that these jobs be advertised for bid,as they are ready. S-12-142 Ewing - Customer has requested to cancel the permit and refund of their deposit for sewer service`, but has requested that the application remain on file until the'six months limitation expired, if they can go ahead before the six months is up they' will and if they do not they understand they will have to make-a° new application under the rates applicable at the time they apply. Motion by Director Milmoe, seconded by Director Clodt, carried unanimously to refund to Ewing as stated. 5-379 - Refund agreement to be exeucted by the District, motion by Director Hastings, seconded by Director McGuire carried urn= amimously that the proper officers be authaiiked to execute the document. 5-12-147- Anderson - Sewer service on Collins Lane, motion by Director McGuire, seconded by Director Ggjj_~Iq Clodt carried un- animously approving staff recommendations. Job 445 - Pursuant to the rules and regulations the application and exhibits were examined. It was moved by Director Clodt, seconded by Director Milmoe, and carried unanimously that the,_ application for water service be approved as recommended by staff. Job 380 - Nay at Prospect and Imperial - request to delete 111'__ meter from the original application. Motion by Director__McGuire seconded by Director Milmoe, passed unanimously to approve the deletion as outlined. S-30-2 Sewer service for R. Abbott at Orchard and Mt. View. Motion by Director Clodt, seconded by Director McGuire carried unanimously to approve as recommended by Staff. January 26, 1966 ( continued) 480 S-7i-4418 sewer service for Mr. Shenk at Brooklyn and Casa Loma. Motion by Director Hastings,, seconded by Director McGuire , carried unanimously to accept staff recommendations. Job 447 - Sewer and Water - Pursuant to the rules and regulations the application and e xhibits were examined. It was moved by Director Milmoe seconded by Director McGuire and carried unanimously that the applications for water and sewr service be approved. Motion by Director McGuire, seconded by Director Hastings, carried unanimously that audited bills against the District in the amount of $39,842.33 and refunds in the amount of $8,152.31- checks numbered 7420 through 7474 be paid. Mr. Korn read a lELter from Mr. Bender who has a lot on Knighten-- gale Lane but does not have an easement for utilities so he has requested that the District assist him in acquiring this easement. Motion by Director Hastings, seconded by Director Milmoe carried unanimously that we can set the meter-on Knightengale at any place that he can get an easement to, but that he will have to get his own easement. Rodger Howell suggested the OrangeCounty Lawyer Reference Service as a possible aid to Mr. Bender. General Manager Shook announced therewould be a meeting of Mr. Price of Garden LandCo., Mr. Yorba, Milo Keith and Mr. Korn and Mr. Shook to settle nx an easement problem in the Country Club, Orchard Drive areas on Thursday Feb. 3, 1966 in this office. Motion by Director Clodt seconded by Director McGuire carried unanimously that all Directors leave are hereby authorized to leave the State for either business or pleasure between this meeting and the next regular meeting of the Board.
