April 14, 1965
A regular meeting of the Board of Directors of the Yorba Linda County
Water District was convened at the office of the District by President
Wagner at the hour of 8:30 A.M. April 14, 1965. All,Directors were
present. Also present was H. Rodger Howell, attorney for the District.
On a motion made by Director Hastings, seconded by Director McG-ire
and unanimously carried the minutes of the meetings held March 10th
and March 24, 1965 were approved as mailed.
A letter was presented from a proposed Orange County Public Wester
Agencies Commission asking for the Directors of the District to give
some thought to some such local agency formation within the County
by approximately 16 districts.
A letter was read from Rutan and Associates announcing an equitable
agreement on easements across the McCracken property in Lot 1 Block
30. A motion was made by Director Clodt, seconded by Director Hastings
that the action of the General Manager in this matter be ratified and
that the recommendation of the legal counsel be accepted and that the
proper officers be authorized to sign any necessary documents.
A letter was read from the City of Anaheim stating that the proposed
agreement between Anaheim and the Yorba Linda County Water District
was not acceptable to the City of Anaheim in its present form. A
motion was made by Director Clodt, seconded by theDirector McGuire
and carried that the General Manager and Attorney for the District
be authorized and instructed-to try furthe-r,to reach an agreement
with the City on this matter.
A letter was read from Orange County Flood Control District stating
that plans were made to advertise for bids for construction of the
Carbon Creek Channel in June 1965 and that the installation of the
proposed sewer line for Job 5-145 should be included in this work.
A communication was received from the Santa Ana River Water Association
stating that no annual meeting was to be held until further notice. It
was generally agreed that there would be no objection to this action
at this time.
The Spring conference of AWWA for Aprii 23 in Riverside was again
announced
The Secretary was instructed to note in the minutes that an Assign-
ment from Edgar R. Pye to Philip Shofner of probable sewer refunds
had been received and ordered filed.
A meeting of the S.C.W.U.A. for Friday April 16 was announced with
the program to include the discussion of the feasability of a Plastic
Water Tube from the far North and a presentation of the North American
Water and Power alliance.

A communication was received from the City of Placentia con-
cerning service by So. California Water Company of water and of
sewer service by the City of Placentia for a proposed Methodist
Church where District service lines are not nearby. After dis-
cussion the matter was referred back to staff for further study.
Job 5-10 - As recommended by staff the proper officers were`
authorized to sign and execute the standard Agreement for sewer
service to this job on a motion made by Director McGuke,
seconded by Director Clodt and carried.
Job 5-223 - On a motion made by Director Hastings, seconded by
Director McGuire and duly carried the proper officers be authorized
to execute the standard Agreement for Sewer service for this
job.
Job S-223 - The hour of 10-00 A.M. having arrived bids for
sewer lines for this job were opened as follows:
E.C. Thomas Contracting 3,700.00
Orange County Pipeline 45803.00
Wm. DeMotte 7,874.30
After discussing certain irregularities appearing in the bids of
E.C. Thomas Contracting and Wm. DeMotte whose bids were.not pre-
sented on a Standard Bidders Form as required by the District, a
motion was made by Director McGuire, seconded by Director Milmoe
and duly carried that the approval be given Land Financial
Corporation to award the contract to the lowest responsible bidder
meeting the specifications of the District, which afpeared to be
OrangeCounty Pipe Lines.
As recommended by staff a refund of $4803.00 over deposited on
this sewer job bemade to the depositor or his assigns, was made on
a motion by Director McGuire, seconded byDirector Clodt and
carried.
Job 65 B - Pursuant to the rules and regulations the proposed
sewer service facilities as shown on Exhibit Nos. A, B and C were
examined. It was moved by Director Milmoe, seconded by Director
Clodt and carried that the application for service be approved
and that the property is within drainage area "C", that the service
charge shall be at the rate of $350.00 per acre and that there
shall be no refund agreement.
Job .229 - Pursuant to the Section 7.6 of the rules and regulations
the pproposed water service facilities as shown on Exhibit No. A
and B were examined. It was moved byDirector Hastings, seconded
by Director McGuire and carried that the proposed facilities be
approved-as conforming to the rules and regulations with no ex-
ceptions.
Job S-263 - A petition was received from W. H. Barton asking that
Lots 86 through 95 of the Newmark Tract be included in and be
treated as one parcel in the plan of the Down Town Improvement
Agency for sewer service under the 1911 Act. After discussion
a motion was made by Director,Hastinggs, seconded by Director
McGuire and carried that the matter be referred back to the
staff and the consulting engineer for a firm engineering plan
and recommendation.

S-372 - A letter was read from Lowry ant Associates Stating that
protests had been received in such a large percentage of the
proposed 1911 Act sewer district near Rose Drive and Yorba Linda
Blvd. that it would not be feasable to proceed with the petition
under the present plan. A motion was made by Director McGuire
seconded by Director Clodt and carried that this matter be
closed due to inadequate petitions in favor of the formation of
the special district.
A discussion was then held concerning a method of providing sewer
service for certain residents of an area adjacent to Rose Drive
and Yorba Linda Blvd. It was agreed that the need of some of
these applicants was immediate and urgent and that having failed
to accomplish this construction under the 1911 Act due to the
opposition of certain residents another method should-be tried.
After discussion a motion was made by Director Hastings, seconded
by Director Clodt and unanimously carried as follows: That
those desiring this service be permitted to construct the facilities
for their properties at their own expense, conforming to the
District Specifications, and deeding same to the District on
completion; and that two questionable properties on the East sid
end of W.Camille Drive be informed that if they wished to be,
excluded from this plan there might be the possibility of an
alternate route for their properties at a later date.
Job S-386 - A motion was made by Director Hastings, seconded
by Director Clodt and unanimously carried that the proper officers
be authorized to sign and execute the necessary agreement for
sewer service for this job.
Job 356 - review - Pursuant to Section 7.6 of the rules and
regulations the proposed water service facilities as shown on
exhibit No. A and B were examined. It was moved by Director
Clodt seconded byDirector McGuire and carried that the pro-
posed facilities be approved as conforming to the rulea and
regulations with exception as follows: Special circumstances -
distance from existing facilities create a hardship in the
cost to provide service at this time. Special agreement for
payment of Service Fee c/o F. H. and bring up to standards
when property is divided.
Job 396 - Pursuant to section 7.6 of the rules and regulations
the proposed water service facilities as shown on Exhibit No.
A and B were examined. It was moved by Director Hastings,
seconded by Director McGuire and carried that the proposed
facilities be approved as conforming to the rules and regulations
with no exceptions.
Job 274 - D Pursuant to the section 7.6 of the rules and reg-
ulations the proposed water service facilities as shown on_
Exhibit No. A and B were examined. It was moved by Director
Hastings, seconded by Director McGuire and carried that the
proposed facilities be.approved as,conforming to the rules
and regulations with no exceptions.

r-S- 73B - Pursuant to the rules and regulations the proposed sewer
service facilities as shown on Exhibit No. A and B were examined.
It was moved by Director Clodt, seconded byDirector McGuire and
carried that the application for service be.apptoved and that the pro-
perty is with in the drainage area "B" that the service charge shall
be at the.rate of $350.00 per acre,_that there shall be no refund
agreement.
On a motion made by Director Hastings, seconded by Director McGuire
and duly carried the audited bills against the District were
approved for payment as follows:
Accounts payable $23,573.12
Refunds of deposits $1,647.29
Motion by Director Hastings, seconded by Director Clodt and carried
stated that the Directors of-the District are hereby authorized
to leave the State of California for either business or personal
reasons between now and tthie next regular meeting of the Board of
Directors.
There being no further business the meeting was adjourned to 8:30
A.M. April 28, 1965 on a motion made by Director McGuire, seconded by
Director Hastings and duly carried.
