July 14, 1965
A regular meeting of the Board of Directors of the Yorba Linda
County Water District was called to order by President Wagner at
8;30 A.M. at the office of the District July 14, 1965.
The following directors were present and answered the roll: Directors
Clodt, Wagner, Milmoe, McGuire and Hastings, H. Rodger Howell,
attorney for theDistrict was also present.
Minutes of June 9, 1965 and June 23, 1965 were approved as mailed
by a motion made by Director Hastings, seconded by Director
McGuire aRd, motion carried.
General Manager Shook read a letter from L.A.F.C. announding the
hearing date of July 21, 1965 on Annexation 65-5 and 65-7 at 2:30
P.M. Standard reply that we serve water and sewer as per agreement
and have no objection as a District.
A letter a was read from the Auditor of the County of Orange re-
questing confirmation of theBoard's intention regarding the services
of a certified public accountant. A motion by Director Hastings,
seconded by Director McGuire that the Secretary write a letter
informing the County'Auditor that the services of Diehl and Evans
had been retained for the fiscal year, motion carried.
General Manager announced the Biennial conference for Ground Water
Recharge Development and Management on September 1 and 2, 1965.
He also announced the Hawaii Conference of AWWA in October of 1966,
asking that a $25.00 deposit be made by September 1 followed by
$100 in January - the total amount for one person $347.00.
A short informal report by Manager Shook and Attorney Howell on the
Portland Conference of AWWA. Both gentlemen were very enthused and
felt the meeting was beneficial and well worth the time spent.
The Certificate of Inclusion re: Ordinance # 6 ( Annexation 65-1)
Placentia Orchard Drive School Site was presented for execution by
the proper officers of theDistrict.
Discussion regarding budget. Also the salary resolution as pro-
posed by the General Manager. Motion by Director Hastings, seconded
by Director McGuire and carried that discussion of budget be post-
poned and a committee of the whole for a budget session discussion
be set for July 22, 1965 at 8:00 A.M.
Job S-179B and J 179 B -
Mr. Fasciano appeared before the Board regarding the water and
sewer charges and requirement for Job 179 B. No change in the
Board decision regarding same.
Mr. Shook presented a request from Mr. George Easton of Yorba Orange
Growers at Taylor and Orangethorpe ( area outside District boundary)
for service from the District. Discussion - General Manager to
notify Mr. Easton that the area could be annexed to the District

and sewer and water service would then be available as needed,
according to the rules and regulations in effect at that time of
annexation.
Job 288
Miss Neukom appeared before the Board regarding a Special Request
on the part of her client Mr. Giuffrida of Morse Avenue. Job # 288.
A motion byDirector McGuire, seconded by Director Milmoe and
carried that the Board rule a temprory service would be granted
under certain terms and conditions. The agreement to be drafted
setting up the terms and conditions, k a service fee for the
front footage on Morse plus a minimum of a 1 inch meter with a
back flow prevention device to be incorporated in this agreement,
also the termination date of one year or upon the recording of a
Grant Deed showing change of ownership for the land "whichever
would be first. The above agreement to be drafted with the under-
standing it has been at the specific request of Mr. Giuffrida.
Job 270
The "License" from Shell Oil Company had been reviewed by the
Attorney H. Rodger Howell. Attorneyfelt the "License" awa-all
right except for a few minor changes. Motion by Director Clodt
seconded byDirector McGuire and carried that the Attorney and the
General Manager make these changes and request that the signatures
be acknowledged so that the document could be recorded and after
acceptance of these minor changes that the document be executed by
the proper officers.
Motion byDirector McGuire, seconded byDirector Hastings that the
audited bills against ek the District be paid. Motion carried.

Pursuant to Sec. 7.6 of the rules and regulations the proposed-
water service facilities as shown on Exhibit No. "A"" were examined.
It was moved byDirector Hastings, seconded by Director Clodt and
carried tht the proposed facilities be approved as per staff re-
commendations.

Pursuant to Sec. 7.6 of the rules and regulations the proposed,
water service facilities as shown on Exhibit "A" were examined.
It was moved byDirector McGuire, seconded byDirector Milmow and
carried that the proposed facilities be approved as per staff
recommendation and that k an easement on Oriente also be obtained.

It was moved by Director Clodt, seconded by Director Hastings and
carried that the proposed facilities be approved as conforming to
the rules and regulations with no exceptions.

It was moved by Director Hastings, seconded by Director Clodt
and carried that the proposed facilities be approved as conform-
ing to the rules and regulations with no-exceptions.

Pursuant to Sec. 7.6 of the rules and regulations the proposed
water service facilities as shown on Exhibit No. "A" were examined.
It was moved by Director Clodt, seconded by Director Hastings and
carried that the proposed facilities be approved as per staff
recommendations.

Pursuant to the rules and regulations the proposed sewer service
facilities as shown on Exhibit "A"" were examined. It was moved by
Director Clodt seconded by Director Hastings and carried thathe
application for service be approved and that the property is within
drainage area "C", that the service charge shall be at the rate
of $2000.00 per acre, there shall be a refund agreement in the
amount of approximately $1650.00 per acre.

Pursuant to Sec. 7.6 of the rules and regulations the proposed
water service facilities as shown on Exhbit "A"" were examined.
It was moved by Director Hastings, seconded by Director McGuire
and carried that the proposed facilities as revised be approved
as per staff recommendations.

Pursuant to the rules and regulations the proposed sewer service
facilities as shown on Exhibit "A"" were examined. It was moved
by Director Hastings, seconded by Director McGuire and carried
that the application for service be approved and the property
is in drainage area "C" that the service charge shall be at the
rate of $2000.00 per acre, that there shall be a refund agree-
ment in the amount of approximately $1650.00 per acre.

Job S 204
Pursuant to the rules and regulations the proposed sewer service
facilities as shown on Exhibit No. "All were examined. It was
moved by Director Hastings, seconded by Director McGuire and carried
that the application for service be approved and that the property
is within Drainage area "C", the service charge shall be at the
rate of $2000.00 per acre,,there shall be a refund agreement in the
amount of approximately $1650.00 per acre.
Job 136 revised
Motion by Director Clodt seconded by Director Hastings and carried
that the staff recommendations be approved.
Discussion regarding the acculumation of construction and the ad-
visability of submitting some of these jobs for bid, particularly
the larger more difficult jobs. Motion by Director Hastings, sec-
onded by Director McGuire, motion carried that the General Manager
is authorized to advertise for bids on construction as needed - plans
for which have previously been approved by theBoard.
Attorney H. Rodger Howell reported on several matters. The first,
Kramer vs Practical Builders, after much discussion agreement had
been reached, a motion by Director McGuire, seconded by Director
Hastings, motion carried that the attorney be authorized to execute
stipulation # 129848 Orange County Superior Court to dispose of
the matter.
H. Rodger Howell also announced the date of the Hearing of the Appeal.
for the new trial the District has requested between Brea and Y.L.C.W.D.
date July 23,1965. Board will be notified of the department where
hearing will be held and the exact time.
Attorney Howell had met with Mr. Joseph B. Geisler, attorney for
the City of Anaheim regarding the re-draft of the agreement. Mr.
Geisler requested that they meet and settle the matter at a later
date because of work scheduling problems. Another appointment has
been set up. No problems anticipated.
John D. Roche Inc. vs Laguna Homes b attorney Howell had reached
an agreement with Mr. Moffin, attorney for Roche Inc., in which
assignment of 37% of sums to be received by Developers Improvement
Association to go to John Roche Inc. until they have received the
sum of $6,266.32 (to be subject to prior assignments). This agree-
ment to be signed by Laguna Homes Inc., Developers Improvement
Association, John D. Roche Inc.,. A motion by Director Hastings,
seconded by Director Clodt and carried that the proper officers of
the District execute this document only after it is returned and
properly signed by all of the above parties.
A motion was made by Director Hastings, seconded by Director Clodt
and duly carried that any of theDirectors of theDistrict and the
General Manager be authorized to leave the State of California for
either business or personal reasons between this date and the next

Motion byDirector Hastings, seconded by Director McGuire and
duly carried the meeting be adjourned to July 28 , 1965 at
8:30 A.M.
