HomeMy WebLinkAbout1964-01-29 - Board of Directors Meeting Minutes330 January 29, 1964 An adjourned meeting of the Yorba Linda County Water District was con- vend at the office of the District by President Wagner January 29, 1964 at the hour of 8:30 A.M. by President Wagner. Directors present were Wagner, McGuire, Hastings and Clodt. Director Milmoe was absent. Also present was H. Rodger Howell, attorney for the District. Mr. Shook reported on the amount of water pumped in the Calender year of 1963 and on the amount of pump tax paid. Job 264 - After discussion a motion was made by Director McGuire, seconded by Director Hastings and carried that the cost of this job be paid from Bond funds. Job 294 - A motion was made by Director Hastings, seconded by Director McGuire and carried that this job be paid for from funds accumulated in account 451. Job B- 64 B-279 - Manager.Dueker requested permission to advertise Jobs B-64 and B-279 for bids. Autforization was granted on a motion by Director Clodt, seconded by Director Hastings and carried. An estimate was presented from Title Insurance in the amount of $32,485.25 for the closing of escrow on land purchased from Shell Gil Company. A motion was made by Director Clodt, seconded by Director McGuire and carried that the payment of the estimate be authorized. A motion was made by Director Hastings, seconded by Director McGuire and carried that authorization be given to pay any taxes on land for Reservoir Site No. 3 incurred by Shell during the period of waiting for title clearance. Job 5-38: After discussion a Deed of Easement was accepted on this job and a Quit Claim granted for a former easement with the proper officers being authorized to sign the Quit Claim on a motion made by Director Clodt, seconded by Director Hastings and carried. Bids were opened for construction of Job S - 286 as follows: Harco Construction 113311.19 Orange County Pipelines Inc. 145078.95 Plumbing Contractors Inc. 125322.78 A motion was made by Director Hastings, seconded by Director McGuire and duly carried that approval be given to the award to the lowest responsible bidder ( Harco Construction Job 303 - Pursuant to Section 7.6 of the rules and regulations the pro- posed water service facilities as shown on Exhibit No. A were examined, It was moved by Director Hastings, seconded by McGuire and carried that the proposed facilities be: Approved as conforming to the rules and regulations with exeeption as follows: That due to the uncertainity of future development it would not be practical to extend a main at this time, the recommendations of staff was to collect z the fee of the main extension to be made in the future, subject to the normal easements, hydrant and meter installations. 331 Jan. 29164 ( contd) Job S-15-5 - Pursuant to 0 the rules and regulations'- the proposed sewer service facilities as shown on Exhibit No. A were examined. It was moved by Direr for McGuire seconded by Director Hastings and carried that the proposed facilities be approved as conforming to the rules and regultions with no exceptions. Job 312 - S-312 Pursuant to Section 7.6 of the rules and regulations the proposed water and sewer service facilities as shown on Exhibit No. A-B were examined. It was moved by Director McGuire, seconded by Director Hastings and carried that the proposed facilities be: approved subject to removal of existing meter and installation of a 111 meter. There being an existing hydrant none will be required as shown under original application. An application attached for sewer service was approved subject to the applicant sharing the cost of a chimney constructed by the owner of adjoining property ( De Vries). All approval subject to a refund policy to be adopted by the Board in the near future. Job 251-B Revised - Pursuant to Section 7.6 of the rules and regulations the proposed water service facilities as shown on exhibit No. A were examined. It was moved by McGuire, seconded by Hastings and carried that the proposed facilities be: Approved as conforming to the rules and regulations subject to installation of one hydrant as recommended by staff. Job 126 - Pursuant to section 7.6 of the rules and regulations the proposed water service facilities as shown on Exhibit No. A were examined. It was moved by Director Hastings, seconded by Director McGuire and carried that the proposed facilities be, approved subject to a provision no grading, filling or use of heavy equipment be permitted over the existing 2611 line unless approved by the Board and that the General Manager & Attorney be authorized if necessary to obtain an injunction to prevent any deviation from this provision. Job 291 - Pursuant to Section 7.6 of 'the rules and regulations the proposed water service facilities as shown on exhibit no's A and B and C were examined. It was moved by Director McGuire, seconded by Director Clodt and carried that hhe proposed facilities be approved as conforming to the rules and regulations with no exceptions. Job S-291 - Pursuant to the rules and regulations the proposed `ewer service facilities as shown on Exhibit no's. A and B and C were examined. It was moved by Director Clodt seconded by Director McGuire and carried that the proposed facilities be approved as conforming to the rules and regulations with no exceptions. Job 310 - Pursuant to Section 7.6 of the rules and regulations the proposed water service facilities as shown on Exhibit No. A were examined. It was moved by Director Clodt and seconded by Director McGuire and carried that the proposed facilities be approved subject to collection for -4- of one hydrant, frontage charges on Round Hill Road @ 2.75 per front foot and x installation of a 111 meter. 332 Jan. 29164 ( cont'd) Job - 239 - Pursuant to section 7.6 of the rules and regulations the proposed water service facilities as shown on exhibit no A were examined. It'was moved by Director Hastings, seconded by Director McGuire and carried that the proposed facilities be:approved subject to payment of front footage charges of $2.75 per foot on Yorba Linda Blvd. and $5°.50 per front foot on Valley View Ave. Job - 5-239 - PuEsuamt-to-Seet em A motion was made by Director Clodt seconded by Director McGuire and carried that sewer service be approved as recommended by staff. Job - 304 - Pursuant to Section 7.6 of the rules and regulations the proposed water service facilities as shown on exhibit no A were examined. It was moved by Director C•lodt, seconded by Director McGuire and carried that the proposed facilities be approved as conforming to the rules and regulations with no exceptions. Job S-304 - Pursuant to= the rules and regulations the proposed sewer service facilities as shown on Exhibit No. A -were examined. It was moved by Director Clodt , seconded by Director McGuire and carried that - due to the fact this parcel had been cut from a larger parcel due to County reg- ulations the division, had not been made to evade payment of the $2000.00 per acre feed`` he fee for this parcel should be based on the charge of $350.00 per acre with the understanding that any future division would be classified under the $2000.00 per acre rate. Job 314 - Pursuant to section 7.6 of the rules and regulations the proposed water service facilities as shown on exhibit no. (no exhibit) were examined. It was moved by Director Hastings, sedonded by Director McGuire and carried that the proposed facilities be authorized for design only. On a motion by Director Clodt, seconded by Director Hastings and carried payment was authorized for bills in the amount of $36,699.77 and deposit refunds in the Amount of $510.00. Job 234 B Revised: After discussion a motion was made by Director McGuire, seconded by Director Clodt and carried that lines=for this Condominium Development of 80 apartments be installed in such a manner as to provide a.separate service line and meter for each apartment and that all the maintenance of said service lines be the obligation of the Condominium and that this decision be incorporated into the Condominiums Maintenance Agreement, °a copy of which shall be furnished to the District. A notice of a special meeting of the Yorba Linda Chamber of Commerce was received, read and filed. A letter was read from Mr. C. H. Eichler protesting the reconditioning and con tinned use of a 20" line crossing $ his property in Lot 5, Block 20. A motion was made by Director McGuire, seconded by Director Hastings and carried that the General Manager be authorized to answer the letter and inform Mr. Eichler that the line could be relocated at his expense but that the intent of the Board to recondition this important line be reaffirmed and that the decision to relocate must be made within two weeks from this date. 333 Jan. 29164 (contd) A letter was read from Mr. W. H. Brewster notifying the Board that he had paid his pro rata share of a fire hydrant in Lot 7 Block 29. A motion was made by bisector Hastings, seconded by Director McGuire and carried that the receipt of the letter be noted and that the letter be filed in the proper job filed. General Manager Dueker made a brief report on his attendance at the meeting of the Assembly Interim Committee at Berkeley on January 21, 1964 and stated that a more detailed report from Rutan and Tucker would follow later. Mr. Dueker reported that the County Board of Supervisiors had refused the District request to consolidate the District election with the June primarys and that the election would be held on the fourth Tuesday in March as $x outlined by the Water Code. Mr. Dueker stated that he had received a maintenance agreement from Foxboro Instrument Company, A motion was made by Director McGuire, seconded by Director Hastings and carried that subject to certain revisions the agreement be signed by the General Manager. After discussion a motion was made by Director McGuire, seconded by Director Clodt and carried that payment of sewer refund of $5,508.00 be authorized to Craig - Ruth, said money having been received for connection fees from the Yorba Linda Citrus Company. A refund of an over deposit of $725.79 to Job 176 - less any bills due the District ax was approved on a motion made by Director McGuire, seconded by Director Hastings and carried. A refund of an over deposit of $153.60 to Job 184 - less any bills due the District was approved on a motion made by Director McGuire, seconded by Director Clodt and carried. A refund of an over deposit of $325.72 to Job 5-127, less any bills due the district was approved on amotion by Director Hastings, seconded by Director McGuire and carried. Mr. Dueker at this time announced his resignation as General Manager effective as soon as possible, but not later than March 1, 1964. Mr. Dueker stated that he was taking this action with regret but that he had been offered an opportunity that he did not feel he could refuse. He stated that he would submit a letter of resignation in the immediate future. LY On a motion made by DirectorMcGuire, seconded by Director Clodt and carried all District Directors are hereby authorized to leave the State of California for either business or personal reasons between now and the next regular meeting of the Board of Directors.
