HomeMy WebLinkAbout1964-09-10 - Board of Directors Meeting Minutes377 September 10, 1964 A regular meeting of the Board of Directors of the Yorba Linda County Water District wasc&lled to order at the office of the District by President Wagner September 10, 1964 at the hour of 8:30 A.M... Directors answering the roll were Wagner, Milmoe, McGuire and Hastings. Director Clodt was absent. Also present was H. Rodger Howell, attorney for the District. On a motion made by Director McGuire, seconded by Director Hastings and duly carried the minutes.of the meetings held August 12 and 26, 1964 were approved as mailed. A discussion was held concerning the meeting of the Aseembly Committee on Municipal and County Government to be held .on September 15th and 16th at Sacramento. Mr. Howell stated that representatives of Rutan and Associates would be present at the hearing. A motion was-made by Director McGuire, seconded by,Director Hastings, and carried that the present autonomy of local district boards was still satisfactory, that there are no problems in Orange County and that the additional legislation proposed by this Committee be not approved and that our legal representatives be so advised by letter. The formation o f a new organization called the "California Reclamation Association" was discussed by Mr. Howell. A motion was made by Director Milmoe, seconded by Director McGuire and duly carried that the District become ,,a membr and that the payment of $25.00 membership fee be author- ized. General Plan Amendment No. 38 of the City of Anaheim was discussed. The plan called for the extension of La Palma Avnnue easterly through Block 36 of the District. The matter was referred to staff for study to determine if the plan would interfere with the use of District property. Reclassification No. 64-65®25 of the City of Anaheim was discussed. The matter was referred to Staff for study to determine if it would interfere with the use of District property or be determental to the District's water supply. On a motion made by Director Hastings, seconded by Director McGuire and duly carried that audited bills against the District be approved for payment as follows: Accounts Payable Refunds of Deposits $20,223.17 802.69 RESOLUTION # 117 Job S-38 - On a motion made by Director McGuire, seconded by Director Hastings and unanimously carried Resolution No117 was adopted: o' Approving a Right of Way Agreement and Grant of Easement for the Acquisition of a Right of Way from John A. Skogman et al, and Approving the payment of the Sum of $2,000.00 for Conveyance of Said Right of Way." 378 September 10, 1964 ( continu:,ed) Job 351 - Pursuant to Sec. 7.6 of the rules and regulations the pro- posed water service facilities as shown on Exhibit No. A were examined. It was moved by Director Hastings, second8d by Director McGuire and carried that the proposed facilities be approved as conforming to,the rules and regulations with no exceptions. Job S-351 - Pursuant to the rules and regulations the proposed sewer facilities as shown on Exhibit No.. A were examined. It was moved by Director Hastings, seconded by Director McGuire and carried that the application for service be approved and that the property is within drainage area "C", that the service charge shall be at the rate of $2,000.00 per acre, that there shall be a refund agreement in the amount of approximately $1,650.00 per acre, it being understood that the application for and payment for this parcel may be made by more than one applicant at the same rate per acre. Job S352 - Pursuant to the rules and regulations the proposed sewer service facilities as shown on Exhibit No. A and B were examined. It was moved by Director McGuire, seconded by Director Hastings and carried that the application for service be approved and that the property is within drainage area "C', that the service charge shall be at the rate of $350.00-per acre, that there shall be no refund agreement. A discussion was held concerning the District house on Richfield Road. It was the general opinion that it would be to the advantage of the District to sell the property since it is too small for any practical use for the.District and the staff was instructed to explore this possibility. S-214 - A motion was made by Director McGuire, seconded by Director Hastings and duly carried to authorize the proper officers to execute the Application and Agreement for this job. After discussion a motion was made by Director McGuire, seconded by Director Hastings, and unanimously carried that unless schlegal and Friedman file a "Declaratory Relief Action" regarding the appropriate source of water for Tract 4547 by September 14, 1964 that the Attorney for the District be authorized and instructed to file a Declaratory Action on behalf of the District. A motion by Director McGuire, seconded by Director Hastings and carried stated that District Directors are hereby authorized to leave the state of California for either business or personal reasons between now and the next regular meeting. There being no further business the meeting was adjourned to of 8:30 A.M. September 23, 1964 on a motion made by irector seconded by Director McGuire and duly carried.
