HomeMy WebLinkAbout1963-12-24 - Board of Directors Meeting Minutes323 December 24, 1963 _ An adjourned meeting of the Board of Directors of the Yorba Linda County Water District was convened at the office of the District by President Wagner at the hour of 8:30 A.M. December 24, 1963. All Directors were present and anwered the roll. Also present was H. Rodger Howell, Attorney for the District. A letter was read from Jamaica Construction Company asking for per- mission to use existing sewer facilities for models in Tract 5010 until construction of the lines to serve the tract were completed. A motion was made by Director Hastings, seconded by Director McGuire and carried that permission be granted. A letter was read from Marjan Developers explaining that they were encountering certain difficulties obtaining the proper sewer ease- ment from A.S. Bradford for a line on Linda Vista Street. After discussion a motion was made by Director McGuire, seconded by Dir- ector Hastings and unanimously carried that the matter be referred to the attorneys for the District and that authorization be given the attorneys to proceed with a condemnation if considered necessary by the General Manager and Attorney. A letter was read from Diehl Evans Co., suggesting the quarterly audit for September 30, 1963 be omitted and a more comprehensive audit made as of December 31, 1963. The letter was generally approved by the Board and ordered filed. Mr. Mattillo of Matillo Brothers was present to discuss their low bid which was accepted for Job 5-249. Mr. 11attillo stated that he had made an error in the original bid and would like to be permitted to submit another bid. Attorney Howell ruled that it would not be proper to accept another bid and that the alterna..tives would be to insist on the low bid as accepted, call for all new bids, or to award to the second low bidder and that the matter should be referred back to the Developers and that this Board would approve their decision as to the award. A motion was made by Director Milmoe, seconded by Director C1odt, and carried that the three alternatives be referred back to the Developer. Audited bills in the amount of $4,129.45 were approved for payment on a motion by Director C1odt, seconded by Director Hastings and carried. The committee on the matter of constructing a parking lot at 0linda and Imperial reported that all arrangements were no ,~j complete and that construction should begin. The committee on the sale of property reported that the Richfield Oil Co. had indicated that they would not be interested at the suggested price. The General Manager reported that the Deed for a Reservoir Site North of the town from Shell Oil Co. had been forwarded by them to the Title Company for recording. 324 Job 231 - As recommended by staff, approval of the filing of Notice of Completion for Job 231 was approved on a motion by Director C1odt, seconded by Director Milmoe and carried. Job 231 - Payment for Job 231 was authorized on a motion by Director Clodt, seconded by Director Hastings and carried, 90% to be paid immed- iately and the remaining 10% to be paid 35 days after recording of Notice of Completion. Job 74, 77, & 94 - On a motion by Director McGuire, seconded by Director Hastings and carried refunds for overpayments of deposits were approved as follows: Job 74 for $1,094.87; for Job 77 $476.10; for Job 94 $500.00. After discussion a motion was made by Director McGuire, seconded by Director Clodt and carried as follows: That a payment of 60% of the cost of the second office building moved in by Rands Cabana Company be authorized and that final payment on both buildings be authorized upon satisfactory proof of Lien Waivers or 35 days after recording of Notice of Completion. Job 251 (Exhibits A & B) - A communication from Mr. Jahn Apalatagui was presented asking,for domestic service on property situated in Lot 12, Block 10. A motion was made by Director McGuire, seconded' by Director Clodt and carried that the request be°granted subject to the service being restricted by agreement to the exact location specified in the application and for the exact purpose specified in ,the application. Job 296 - A request for water and ^sewer service (Exhibits A. B, C, D. and E) from Tidewater Associated at Plumosa and Imperial was presented. A motion was made by Director Clodt, seconded by Director Hastings to approve as recommended by Staff and as conforming to the Rules and Regulations of the District. Job 5-295 - (Exhibits A, B. and C) An application was presented from ,the Yorba Linda Citrus Co for sewer service on Yorba Linda Blvd. A motion was made by Director McGuire, seconded by Director Clodt and "carried that in as much as the application was subject to reasonable doubt as to the amount of property involved was referred back to the staff with instructions that the proof of the acreage involved be furnished by the applicant. On a motion made by Director McGuire, seconded by Director Clodt -and carried that all District Directors are hereby authorized to leave the State of California for either business or personal reasons between now and the next regular meeting of the Board of -Directors.
