HomeMy WebLinkAbout1962-03-14 - Board of Directors Meeting MinutesThe regular meeting of the Board of Directors of Water District was called to order by President the District at 8:30 A.M. on March 14, 1962. the Yorba Linda County Crist at the office of All Directors were present and answered the roll, Attorney Howell, and the General Manager of the District were, also, present. The General Manager then informed the Board that the Di,ptrict has received no additional communications regarding the sale of the house at Plant No. one) and -recommended that it be rented for $60.00 per month. A motion was ,OpMade by Director Hastings, seconded by Director Milmoe and unanimously carried that the General Manager is authorized to rent the house for $60.00 per month. A motion was made by Director Hastings, seconded by director Clodt and unanimously carried that the minutes of February 14, 163, and 28 are approved as mailed, Dick Everitt then entered the board meeting and requested the District to make application to the Pacific Electric and the State Division of Highways for a maintenance permit for a proposed sewer line on Lemon Drive, A motion was made by director Hastings,seconded by director Wagner and unani- mously carded that the General Manager is authorized and instructed to make said application. I The auditing committee then reported that they had examined the bills for February in the amount of $41,252.45, found them to be in order, and recommended their payment. A motion was made by Director Clodt, seconded by Director Wagner and unanimously carried approving their payment, Attorney Howell then presented a proposed agreement between the District -and the Developer of Tracts 4181 and 4397. The Developer, Mr, Hilton T. Johnson was present and a discussion of this agreement followed. Mr, Johnson requested the right to construct the proposed line on Orangethorpe for a price less than the lowest bid received, the Board, however, thought that if he felt he could do it for less he should submit his bid at the same time as the other contractors would submit theirs. A motion was made by Director Wagner, seconded by Director Milmoe, and unanimously carried that the agreement as presented is acceptable, except that Mr. Johnson must submit his bid at the same time the other contractors submit their bids, and that the officers of the District are hereby authorized,and instructed to sign the agreement for the District. A Resolution on annexation of Tract 4181 & 4397 setting Hearing at 10:00 A.M. at the office of the District on April 11, 1962 was made by Director Milmoe, seconded by director Clodt, and unanimously carried frith all ayes on a Roll Call Vote. RESOLUTION NO. 55 RESOLUTION OF THE BOARD OF DIRECTORS OF THE YORBA LINDA COUNTY WATER DISTRICT INITIATING ANNEXATION AND INCLUSION PROCEEDINGS OF UNINHABITED TERRITORY 155 BE IT HEREBY RESOLVED by the Board of Directors of the Yorba Linda County Water District as follows: 1. That proceedings have been initiated by the Board of Directors of the Yorba Linda County Water District under the provisions of Chapter 2.5 of Part 8_of Division 12 of the Water Code of the State of Cali- fornia, for the purpose of inclusion of uninhabited territory within the boundaries of the Yorba Linda County Water District, known as Annexation No. 1. 2. That the reason for the proposed annexation and inclusion is that the property herein described proposed for annexation and in- elusion is desirous of receiving a water supply from and the use of sewer facilities of this District, and that this District is the agency conveniently available to provide sewer facilities and water for domestic and municipal purposes in the area, and that the owners of the property herein described have requested this annexation and inclusion to proceed. 3. That the boundaries of the territory proposed to be annexed and included in the Yorba Linda County Water District are as follows: That portion of the First Class Land, in the County of Orange, State of California, according to a map attached to and made a part of the Decree of Partition of the Rancho Canon de Santa Ana rendered in Case No. 1978 of the 17th Judicial District Court of Los Angeles County, California, a certified copy of which is recorded in Book 28, page 158 of Deeds of said Los Angeles County, described as follows: Beginning at the intersection of the centerline of Orange. thorpe Avenue as described "Placentia Yorba Road, Deed of Right of Way" to the County of orange, recorded January 6, 1916, in Book 280, page 151 of Deeds of said orange County with the center. line of Orchard Drive as described in deed to the County of Orange, recorded November 30, 1927, in Book 98, page 389, of Official Records of said Orange County; thence along said center. line of grchard Drive North 3 261 30" East 1120.42 feet; thence South 83 11' 38" East 1294.07 feet; thence South l0 341 2711 West 1238.23 fegt to said centerline of Orangethorpe Avenue; thence North 78 18' 40" West 1346.11 feet to the point of beginning„ Containing an area of 35.449 acres, more or less. 4. The terms and conditions of annexation and inclusion are as follows: NONE 5. Any owner of property within the territory proposed to be annexed and included within the Yorba Linda County Water District may file with the Secretary of the District at any time prior to the hour set for, the hearing thereof written protest to the annexation and inclusion of said territory or to the annexation and inclusion of the territory upon such terms and conditons as proposed. 6. That the Board of Directors of the Yorba Linda County Water District hereby fix the time, place and meeting of the Board at which the Board will hear the protests as follows: (a) PLACE OF HEARING. 156, The office of the Yorba Linda County Water District, 4866 South Olinda, Yorba Linda, California. (b) DATE OF HEARING. April 11, 1962. (c) TIME OF HEARING. 10:00 o'clock A. M. 7. That said proposed annexation and inclusion of territory was approved by the Boundary Commission of Orange County on February 26, 1962. 8. That the Secretary of the District shall cause notice of this annexation to be published as required by law. DATED this ,14th day of March, 1962 LLeonar L. Due er Assistant Secretary of the Board of Directors of the Yorba Linda County Water `District The General Manager then requested information as to when he could sign the improvement drawings for Tracts 4181 and 4397. The attorney reported that when the District held a signed petition requesting annexation of this property, the executed agreement approved herinabove, and a deposit for $30;OOG.00, and the regular requirements of the District had been met, the General manager could sign the improvement drawings. The General Manager then presented a report of his conversation with G. C. Page on the trading of property at Reservoir Number Two. A motion was made by director Milmoe, seconded by director Hastings and unani- mously carried authorizing the General Manager and Attorney to prepare the proper documents and return them to the board for approval. A request for water and sewer service for d`.service station at the corner of Lakeview and Yorba Linda Boulevard was referred to staff. Staff then presented an application for a water main extension by Mr. Roy Knight on a portion of Lot 4 Block 4 of the Yorba Linda Tract. motion was made by Director_Wagner, seconded by director Milmoe and unanimously carried that the application 3s approved permitting the installation of fpot°e easement to0theeSouth6propertpnlineoforrfutureants, along with a 50 0 interconnection. 157 A Writ of Attachment for $880.96 against Brisco, etc., et al. was presented to the Board. Followinga report by the Attorney a motion was made by director Wagner, seconded by director Hastings and unani» mously carried that the Assistant Secretary is authorized to pay $880.96 to Haskell A. Kelly, Marshal, Anaheim-Fullerton Judicial District upon approval of Attorney Howell. I Upon a request by the Developer and Approval by the Attorney, a motion was made by director Clodt, seconded by director Hastings and unanimously carried that the General Manager is authorized to send a.letter to the County of Orange approving the release of the water bond on Tract #4344 when the District has received the deposits required by the District for water construction.. The General Manager then made the following report regarding the pipe- lines authorized to be constructed by force accounts with bond funds: 1.) Pipelines completed and in operation are: A. Approximately 1056 feet of 8" pipe on South Ohio St. B. Approximately 2151 feet of 8'! pipe on Park Ave. & Park place including three fire hydrants. C. Approximately 1572 feet of 8" pipe on Highland Avenue D. Approximately 3100 feet of 16", 2800 feet of 1411, and 3500 feet of 12" pipe on Yorba Linda Boulevard. 2.) Approximately 1744 feet of 12", 1054 feet of 1011, and 671 feet of 8" pipe and one fire hydrant was not constructed in Front Street, Yorba Linda Boulevard, Lakeview Avenue, and Lemon Drive due to lack of funds and the change in design due to the failure of the 20" heel line crossing the School property on Yorba Linda Blvd. ' The Contractors price bid for this work was $37,350. 3.) The tabulation of charges for the work under.paragraph 1 above is as follows: f rom er side Tota .15 4.)
