A special meeting of the Board of Directors of the Yorba Linda County Water
District was convened at the office of the District on February 19, 1960 at the
hour of 8:30a.m. by President,
On the call of the roll the following Directors were present: Mr. Wagner, Mr.
Milmoe, Mr. Hastings, and Mr. Crist.~ Director Clodt was absent. Also present
was H. Rodger Howell, Attorney and Mr. George Kay, representing James Montgomery.
Mr. Kay reported that he had contacted Mr. Conroy of the Shell Oil Company and
discussed with him the necessity of the District for reservoir sites as outlined
in the Plans and Specifications for the construction program. Mr. Kay stated
that he had tried diligently to convince Mr. Conroy of this necessity but the
policy of the Shell Oil Company seemed to be that they did not want to release
the land and that no agreement could be negotiated.
A general discussion was held and it was brought out and agreed that the
relinquishment of the j/10 of an acre of land involved would not constitute
any undue hardship for the Shell Oil Company.
After thorough discussion.a motion was made by Director Wagner, and seconded by
Director Hastings that Resolution No. 29 be adopted, -providing for condemnation
of the land in question and that Attorney Howell be authorized to proceed with
the filing for condemnation and for immediate possession of the property. The
roll was called with the following vote: Ayes - Mr. Wagner, Mr. Milmoe, Mr.
Hastings, and Mr. Crist. Noes - none. Absent - Mr. Clodt.
Manager Dueker announced that because of the time lag in negotations he had not
considered it advisable to publish the legal notices inviting bids as outlined
in a motion made and carried by the Board February 10, 1960• A motion was made
by Director Hastings, seconded by Director Wagner and duly carried that the
motion made February 10, 1960 be amended to authorize the Manager to publish
the notices inviting Construction Bids on February 25, 1960 and March 3, 1960
in the Yorba Linda Star, and to notify bidders that bids will be received at the
office of the District until the hour of 4:00 o'clock p.m. March 16, 1960.
Mr. Dueker presented to the Board a request by the Fullerton Union High School
and Junior College for the use of the Districts mailing list to distribute
brochures for a proposed Bond Issue. A motion was made by Director Wagner,
seconded by Director Hastings that the School District be permitted the use
of District facilities provided the School District supply the necessary
personnel to do the work.
On a motion by Director Hastings, seconded by Director Wagner and duly carried
the meeting was adjourned.

WAIVER OF NOTICE AND CONSENT TO HOLDING SPECIAL
MEETING OF DIRECTORS OF YORBA LINDA COUNTY
WATER DISTRICT
The undersigned, FRED CLODT, a member of the board of
directors of Yorba Linda County Water District, does hereby
waive notice and consent to the holding of a special meeting
of the directors of that District at the principal office
of the District at 4866 S. Olinda, Yorba Linda, California,
at 8:30 o'clock a.m., February 19, 1960, for the purpose of
adopting a resolution setting forth the necessity of, and
authorizing the taking in eminent domain of certain real
property owned by the Shell Oil Company, does hereby ratify
any and all actions taken thereat and agrees that any business
contracted at said meeting shall be as valid and legal and
of the same force and effect as though said meeting were
held after notice was duly given.
