HomeMy WebLinkAbout1979-04-26 - Resolution No. 79-22v. # 9 0 RESOLUTION No. 79-22 RESOLUTION OF THE BOARD OF DIRECTORS OF THE YORBA LINDA COUNTY WATER DISTRICT APPROVING PRELIMINARY APPRAISAL AND AUTHORIZING OFFERS OF PURCHASE BASED THEREON WHEREAS, the Board of Directors of the Yorba Linda County Water District ("District" herein) has heretofore approved the Bryant Cross Feeder project; and WHEREAS, the District has previously retained a qualified real estate appraiser to determine the fair market value of the interests in real property necessary to be acquired to implement the Bryant Cross Feeder project; and WHEREAS, the District's appraiser has completed preliminary analysis of the fair market value of the properties necessary to be acquired and has submitted a list of such properties together with a preliminary opinion re- specting the fair market value thereof, which is attached hereto as Exhibit "A" and by this reference incorporated herein, and WHEREAS, the Board of Directors, by Resolution No.79-21 has found and declared the necessity for acquisition of the parcels of real property shown in Exhibit "B" and WHEREAS, Sections 7267, 726.1 and 72.67.2 of the California Government Code require District to obtain an appraisal of the property sought to be acquired and attempt to acquire the same by negotiation following an offer based upon an approved appraisal of the fair market value of such property. NOW, THEREFORE, the Board of Directors of the Yorba Linda County Water District does hereby find and resolve as follows: Section 1. The preliminary appraisals of fair market value set forth opposite each of the parcels of real property sought to be acquired by the District as shown on Exhibit "A" are hereby found to be reasonable approxim- ations of fair market value and hereby deemed to be the District's appraisal in accordance with Government Code Section 7267.2. Section 2. The District General Manager, staff and consultants are hereby authorized and directed to offer the owners of real property listed in Exhibit "B" the amounts listed opposite each such parcel and are further authorized to negotiate with said owners and attempt to enter into agreements for purchase of any and all such parcels for the prices shown. Section 3. In the event that the District General Manager, staff and consultants are unable to negotiate purchase of any parcel or parcels shown in Exhibit "B" in accordance with Section 2 hereof after a good faith attempt so to do, condemnation proceedings may be instituted in accordance with Res- olution No. 79-21. -1- ib • • or Passed and Adopted by the Board of Directors of the Yorba Linda County Water District at a regular meeting held on April 26, 1979. Kidman MEMBER AMERICAN INSTITUTE OF REAL ESTATE APPRAISERS Re: Appraisal of Easements for the Bryant Cross Feeder Dear Mr. Kidman: Pursuant to your request by letter dated April 3, 1979 and a request from Richard Davalos by letter dated April 11, 1979, I submit herewith a letter appraisal of the above referenced easements across the following owner- ships. As a result of a detailed study and analysis, I have arrived at the following conclusions of Just Compensation, as of April 23, 1979: North Orange County Community College - - - - - - - - - $32,600 Shapell-Upper K Joint Venture (Portion 127. 95 Acres) - - $100 Shapell-Upper K Joint Venture (Portion 46. 38 Acres)- - - $100 Albert J. Yorba, et al - - - - - - - - - - - - - - - - - - - $100 I have made an alternate appraisal of the permanent easement across the College property on the basis of the top of the proposed pipe line being at a maximum elevation of 545 feet between stations 3 + 65 and 8 + 00 and at a maximum elevation of 555 feet between stations 12 + 32 and 16 + 00. It is my opinion that Just Compensation under this criteria is the same as the above estimate with the pipe about 5 feet below existing ground level. Attached hereto are statements of the purpose of the appraisal, tabulation of value estimates, limiting conditions, and appraiser's certification. Respectfully submitted, Robert H. Harrison, M. A. I. "All 0 0 PURPOSE OF APPRAISAL The purpose of the appraisal is to estimate Just Compensation for pipe line and construction easements for the Bryant Cross Feeder over the following properties: 189. 23 acres owned by the North Orange County Community College District; 127. 95 acres owned by Shapell-Upper K Joint Venture; 46. 38 acres owned by Shapell-Upper K Joint Venture; and approximately 138 acres owned by Albert Yorba, et al and being developed by Mark III Homes. Date of Value: April 23, 1979 Just Compensation is the difference in the fair market value of the easement area, as a part of the .larger property, before and after the imposition of the easement, plus net severance damages, if any, to the remaining property. Fair market value is the highest price on the date of valuation that would be agreed to by a seller, being willing to sell but under no particular or urgent necessity for so doing, nor obliged to sell, and a buyer, being ready, willing, and able to buy but under no particular necessity for so doing, each dealing with the other with full knowledge of all the uses and purposes for which the property is reasonably adaptable and available. The permanent easements are for the installation and maintenance of pipe lines for domestic and irrigation water. Structures will not be allowed in the ease- ment areas. The top of the pipe line, to be installed, will be approximately five feet below existing ground level. This effectively will preclude cutting or removing dirt from the easement area. Fill material, up to about 30 feet above exist- ing ground level, can be placed above the easement within the College and the 127. 95 acre Upper K properties. About 8 feet- of fill will be allowed above the current ground level in the 46. 38 Upper K and Yorba properties. The construction easements are for the period from June 1, 1979 through March 31, 1980. Both the permanent and construction easements within the Shapell-Upper K and Yorba properties are subject to easement rights previously granted to M. W. D. The entire 50 foot wide M. W. D. easement through these and other properties must be dedicated to the City of Yorba Linda as a condition of tract map approval. • TABULATION OF VALUE ESTIMATES Community College Property: Permanent easement (sta. 0 + 36 to 1 + 33) within MODOC easement, 25' wide, 0. 05 acres = $ 50 Permanent easement (sta. 1 + 33 to future Fairmont R/W), 25' wide, 1. 26 acres @ $50, 000 x 50% = 31, 500 Permanent easement within future Fairmont R/W) 15' wide, 0. 37 acres = 50 Temporary construction easement, 20' wide, 1. 50 acres = 1,000 $32, 600 Shapell-Upper K 127. 95 Acre Property: 15' permanent easement (0. 91 acres) & 35' construction easement (2. 11 acres) between stations 34 + 43 and 60 + 75 = $100 Shapell-Upper K 46. 38 Acre Property: 15' permanent easement (0.04 acres) & 35' construction easement (0. 02 acres) in vicinity of station 71 + 00 = $100 Albert J. Yorba, et al Property 15' permanent easement (0. 27 acres) & 35' construction easement (0. 64 acres) between stations 87 + 10 and 95 + 03 = $100 Note: For station references, refer to preliminary construction plans for the Bryant Cross Feeder by James M. Montgomery, Consulting Engineers dated April 19, 1979. CONTINGENT & LIMITING CONDITIONS This appraisal is based upon the following premises and limiting conditions: 1. That I assume no responsibility for matters legal in character. The properties are appraised as though free and clear of all encumbrances, except as noted. 2. That information obtained for use in this appraisal is believed to be true and correct to the best of my ability; however, no responsibility is assumed for errors and lmissions, or information not disclosed which might otherwise affect the valuation estimate. 3. That pipeline excavations will be backfilled and compacted to near the natural grade. 4. Within the easements, parallel fill slopes can be no steeper than 4 to 1, without special approval by the District. 5. That pipeline construction will be coordinated through the Upper K and Yorba properties so as not to interfer with the concurrent development of the adjacent larger parcels. 6. That vehicular gates will be installed and properly operated on the College property to prevent the escape of horses or other livestock. 7. That in the event landscaping, pavement or fencing within the pipe line easement areas is damaged in the future by the District, repairs and replacements will be made by the District. 8. The appraiser, by reason of this appraisal, shall not be required to give testimony or to be in attendance in court or at any governmental or other hearing with reference to the subject property, without prior arrangements having been made with the appraiser relative to such additional employment. 0 0 CERTIFICATION I, the undersigned, do hereby certify that I have personally inspected the property that is the subject of this appraisal and that, except as specifically noted: 1. I have no present or contemplated future interest in the real estate or personal interest with respect to the parties involved, and that my employment in this matter is not in any manner contingent upon the value conclusion. 2. To the best of my knowledge and belief the statements of fact con- tained in this appraisal, upon which the conclusion expressed herein is based, are true and correct. 3. This appraisal sets forth all of the limiting conditions (imposed by terms of my assignment or by the undersigned) affecting conclusions contained herein. 4. This appraisal has been made in conformity with and is subject to the requirements of the Code of Professional Ethics and Standards of Professional Conduct of the American Institute of Real Estate Appraisers of the National Association of Realtors. 5. I alone collected the data and prepared the analyses upon which the value conclusion is based. Disclosure of the contents of this appraisal is governed by the By-laws and Regulations of the American Institute of Real Estate Appraisers of the National Association of Realtors. In furtherance of the aims of the Institute to develop higher standards of professional performance by its Members, the appraiser may be required to submit to authorized comm- ittees of said Institute copies of this appraisal and any subsequent changes or modifications thereof.
