Recommendation: Approve the minutes as presented.
2. Payment of bills, refunds, and wire transfers.
Recommendation: Ratify and authorize disbursements in the amount of
$2,015,265.61.
3. Progress Payment No. 14 for the Lakeview Reservoir Construction.
Recommendation: That the Board of Directors approve Progress Payment
No. 14 in the net amount of $440,398.30 to SSC Construction, Inc. for
construction of the Lakeview Reservoir Project, Job No. 200704.

4. Sewer Maintenance Charges for Locke Ranch and Areas Outside of the District.
Recommendation: That the Board of Directors adopt Resolution No. 08-09
electing to have the current Sewer Maintenance Charges collected on the
Fiscal Year 2008-09 Tax Roll and Rescinding Resolution 07-14.

The July 10, 2008 regular meeting of the Yorba Linda Water
was called to order by President Summerfield at 8:30 a.m. TI

CONSENT CALENDAR (Items 1 throuah 61
On a motion by Vice President Mills, seconded by Director Collett, the Board of
Directors voted 5-0 to approve the Consent Calendar.
1. Minutes of the Regular Board of Directors meeting held June 26, 2008.
Recommendation: Approve the minutes as presented.
2. Payment of bills, refunds, and wire transfers.
Recommendation: Ratify and authorize disbursements in the amount of
$1,283,919,15.
3. Progress Payment No. 13 for the Lakeview Reservoir Project.
Recommendation: That the Board of Directors approve Progress Payment
No. 13 in the net amount of $305,846.75 to SSC Construction, Inc. for
construction of the Lakeview Reservoir Project, Job No. 200704.
4. Progress Payment No. 2 for the Highland Reservoir Replacement Project.
Recommendation: That the Board of Directors approve Progress Payment
No. 2 in the net amount of $199,086.79 to Schuler Engineering Corporation
for construction of the Highland Reservoir Replacement Project, Job No.
200309.
5. Quarterly Financial Statements for the Third Quarter of Fiscal Year 2007-2008
Ending March 31, 2008
Recommendation: That the Board of Directors receive and file the Financial
Statement for the Third Quarter of Fiscal Year 2007-2008 Ending March 31,
2008.
6. Damage claim.
Recommendation: Reject and refer to ACWA/JPIA the claim filed by Kamil
Antonios, 5595 Mulberry Way, Yorba Linda.
ACTION CALENDAR
7. Change Order No. 3 to SSC Construction, Inc. for the Lakeview Reservoir Project.
Assistant General Manager Vecchiarelli introduced the item and distributed a
revised agenda report containing a revised recommendation. The item went
before the Planning-Engineering-Operations Committee on Thursday, July 3 after
the Board agenda was posted. The project is on schedule and on budget. The
contractor asked that retention be reduced to 5%. Assistant General Manager
Vice President Mills stated the PEO Committee members believed having a formal
notification could increase the possibility of receiving beneficial use earlier than
anticipated. General Counsel Kidman stated the law is substantially more lenient
than the District, and this is within the law.
General Counsel Kidman noted there has been a slight change in the Brown Act
requiring the District to make available to the public in the District's lobby any items
distributed to the Board of Directors after the 72-hour posting period.
On a motion by Vice President Mills, seconded by Director Armstrong, the
Board of Directors voted 5-0 to approve Change Order No. 3 to SSC
Construction Inc. for construction of the Lakeview Reservoir Project in the
amount of $55,393.45 and 27 calendar days and reduce retention to 5
percent when the District receives beneficial use of the new 8MG Lakeview
Reservoir, Job No. 200704.

8. Change Order for Asphalt Paving Contract. Operations Manager Cory introduced
the item. The District signed a two-year paving contract with Hardy and Harper.
With the high cost of petroleum products, the District was notified that the
contractor could no longer provide the services at the contracted price. General
Counsel concurred that Hardy and Harper could cancel the contract. The District
has elected to take the advice of counsel and use Hardy and Harper with a change
order increasing the price from $8.50 to $14.00.
On a motion by Vice President Mills, seconded by Director Armstrong, the
Board of Directors voted 5-0 to approve Change Order No. 1 to the
Agreement with Hardy & Harper, the District's asphalt pavement contractor,
adjusting the unit price to $14 per square foot.

9. Proposal for Financial and Utility Billing Software. IT Director Grady introduced the
item. He explained Mesa Consolidated uses the same system proposed, and they
are pleased with the functionality. He outlined where the funds will come from.
The Public Information-Technology Committee reviewed the item and concurred
with staffs' recommendation. Questions were asked about the annual
maintenance and support and the reason for paying the cost of the annual
maintenance up front. IT Director Grady explained this was required in the
contract.
On a motion by Director Beverage, seconded by Director Collett, the Board
of Directors voted 5-0 to authorize the General Manager to execute a
Professional Services Agreement with Cogsdale Corporation in the amount of
$291,790 for the installation, implementation and technical support of financial
and utility billing software systems.

General Counsels Report
General Counsel Kidman spoke about the governor's issuance of the drought
emergency declaration. The OC Grand Jury has come out with a report about
what water agencies should be doing with current water supplies. A report
back to the Grand Jury is due on August 20.

The District has the clear authority to develop a water conservation program,
and he recommends doing so. Mandatory measures could include raising the
price system. He spoke about the measures involved. A public hearing would
be necessary. One question is how difficult it will be to tell customers what their
target will be for water usage given different size of lots, differences in
landscape, etc. There is a lot of development work to be done here to reach a
reasonable program with both policy and practical questions needing answers.

SUMMARY:
Section 31302 of the California Water Code says the District shall pay demands made against it
when they have been approved by the Board of Directors. Pursuant to law, staff is hereby
submitting the list of disbursements for Board of Directors' approval.
DISCUSSION:

SUMMARY:
On January 25, 2007, the District Board of Directors authorized the execution of an agreement
with SSC Construction, Inc. (SSC) for construction of an 8-million gallon underground concrete
reservoir, piping and appurtenances. The project also includes demolition of the existing
Bastanchury Booster Pump Station and Reservoir (two steel storage tanks). The site is located
north of Bastanchury Road off the new Lakeview Avenue extension, north of the Hover
Development and south of Vista Del Verde's Village 4. When completed, the project will
increase operational, fire and emergency storage capacity, retain better water quality through
improved circulation and improve reliability of the water system.
DISCUSSION:
In accordance with the contract documents, SSC submitted a request for Progress Payment No.
14, in the amount of $433,938.00 for completed work through June 30, 2008. During this
period, the contractor continued concrete finishing, cleaning, installation of mechanical
appurtenances, and began formwork of the overflow weirs in the interior. General backfill and
rough grading on the slopes is progressing throughout the project site. Work on the water inlet
piping and flex tend units continue. Also included in this pay request is Change Order No. 3 in
the amount of $55,393.45 as approved by the Board of Directors on July 10, 2008.
The status of the construction contract with SSC Construction, Inc. is as follows:
• The current contract is $10,697,781.37 and 574 calendar days starting June 18, 2007.
• If approved, Progress Payment No. 14 is $489,331.45 (4.6% of the total contract
amount), less 10% retention of $48,933.15 for a net payment of $440,398.30.
• Total payments to date including retention are $8,691,780.77 (81.2% of the total
contract amount).
• As of June 30, 2008, 379 calendar days were used (66.0% of the contract time).
Staff and Butier, the District's construction manager for the project, have reviewed the
contractor's progress payment and recommend approval. A copy of Progress Payment No. 14
is attached for your reference.
PRIOR RELEVANT BOARD ACTION(S):
On January 25, 2007, the District Board of Directors approved and awarded a construction
contract with SSC Construction, Inc. in the amount of $10,489,500 for construction of an 8
million gallon underground concrete reservoir, piping and appurtenances, and demolition of the
existing Bastanchury Booster Pump Station and Reservoir. On April 10, 2008, the District Board
of Directors approved Change Order No. 1 increasing the total contract amount to $10,639,500
and total contract calendar days to 547. On June 30, 2008, staff approved Change Order No. 2
in the net amount of $2,887.92 increasing the total contract to $10,642,387.92. On July 10,
2008, the Board of Directors approved Change Order No. 3 in the amount of $55,393.45 and an
additional 17 calendar days to be added to the contract. The Board has approved thirteen
progress payments to date for this project, the most recent of which was approved on July 10,
2008.

Subject: Sewer Maintenance Charges for Locke Ranch and Areas Outside of the District
Boundaries
SUMMARY:
Each year at this time the Board of Directors considers the sewer maintenance charge collected
by the District to finance maintenance of the public sewer system. This charge is uniformly
imposed on all connections to the public sewerage collection system maintained by the District.
For the District's water customers connected to public sewer maintained by the District, this
charge is collected monthly on their water bill. For customers in the Locke Ranch Area as well
as those areas outside the District boundaries served water by the Golden State Water
Company but sewered by Yorba Linda Water District, the sewer maintenance charge is
collected on the property tax rolls prepared by the County of Orange Auditor-Controller. This
process is legally authorized and established by Resolution of the Board. The Auditor
Controller's office requires a certified resolution by the Board directing their office to add the
charges as a special assessment to the tax roll.
DISCUSSION:
The Board of Directors acted in May 2007 to increase the sewer maintenance charges imposed
by the District. These charges finance the maintenance and operations of the public sewer
system maintained by the District. The monthly charge for single family residential customers
connected to the public sewer system was raised at that time from $3.50 to $5.50. Charges for
other customer classifications were adjusted proportionately. The approved fees became
effective on September 1, 2007.
The current Sewer Maintenance Charges are as follows:
Commercial-Industrial and Public Schools:
1. For all sewer customers in this category who use water meter reading, the rate shall
be as follows:
a. First 2,200 cubic feet per month of water consumption per month: $5.50 per
month.
b. All water consumption in excess of 2,201 cubic feet per month: $4.62 per 1,000 cu.
ft.
2. Alternatively, for those customers who have a sewer meter or who can demonstrate to
the District's satisfaction that 100% of the water meter reading ends up in the District's
sewer system, the rate shall be as follows:
a. First 1,100 cubic feet per month: $5.50 per month
b. All metered use in excess of 1,101 cubic feet per month at $5.06 per 1,000 cu. ft.

The Sewer Maintenance Charges are subject to the substantive and procedural requirements of
Proposition 218 (California Constitution Article XIII D) barring a proposed increase in the rates
and/or a discretionary CPI increase of more than 5%.
Staff is not recommending a change to the current sewer maintenance charge at this time. To
collect the current maintenance charge in the Locke Ranch Area and other areas outside the
District boundaries for fiscal years 2008-09, the County of Orange Auditor-Controller's Office
requires a certified Resolution by the Board of Directors directing their office to add the charges
to the tax rolls for the properties assessed. The County establishes a deadline in August to
receive this information.
PRIOR RELEVANT BOARD ACTION(S):
On August 14, 2003, the Board of Directors passed Resolution No. 07-13 adopting the current
sewer maintenance charges and Resolution No. 07-14 adopting these charges for customers in
the Locke Ranch Area as well as areas outside the District boundaries and electing to have the
charges collected on the Fiscal Year 2008-09 tax roll.
STAFF RECOMMENDATION:
That the Board of Directors adopt Resolution No. 08-09 electing to have the current Sewer
Maintenance Charges collected on the Fiscal Year 2008-09 Tax Roll and Rescinding Resolution
07-14.

RESOLUTION OF THE BOARD OF DIRECTORS
OF THE YORBA LINDA WATER DISTRICT
ADOPTING THE SEWER MAINTENANCE CHARGE FOR LOCKE RANCH AND
OTHER AREAS OUTSIDE THE DISTRICT BOUNDARIES AND ELECTING TO
HAVE SUCH SEWER MAINTENANCE CHARGE COLLECTED
ON THE FISCAL YEAR 2008-09 TAX ROLL
AND RESCINDING RESOLUTION 07-14
WHEREAS, in October 1977, the City of Yorba Linda transferred and conveyed
ownership of the Locke Ranch sewer system to the Yorba Linda Water District; and,
WHEREAS, the Yorba Linda Water District ("District" herein) Rules and Regulations
for Rendition of Sanitary Sewer Service include a provision that a sewer maintenance
charge is adopted by separate Resolution for the Locke Ranch and Other Areas
Outside the District Boundaries; and,
WHEREAS, the Board of Directors of the Yorba Linda Water District have from time
to time adopted Ordinances and Resolutions to set and change the Sewer
Maintenance Charge rates charged by the District; and,
WHEREAS, the Locke Ranch sewer system and other sewer systems owned and
maintained by the District are outside the existing District boundaries; and,
WHEREAS, under authority of the California Water Code Sections 31100 and
31101.5 the District may provide sewer service and levy sewer maintenance charges
on property located outside of the District boundaries and under California Health and
Safety Code Sections 5471 and 5473 may elect to have the County of Orange
Auditor/Controller collect such charges on the Orange County Property Tax roll; and,
WHEREAS, the District made available at the District office the Sewer Maintenance
Charge Report in May 2007, which explains the rate structure in greater detail; and,
WHEREAS, as explained in Sewer Maintenance Charge Report document, the rate is
not being used for a general governmental purpose but to pay for sewer service
actually provided to the property; and,
WHEREAS, the revenues from sewer rates do not exceed the amount required to
provide such service and are equivalent to the amount of service received; and,
WHEREAS, the revenues collected from sewer rates have been and will be used only
to pay for the sewer services for which they were collected; and,
WHEREAS, the sewer service provided is not a standby charge, but for sewer
immediately available to the property identified; and,
WHEREAS, on July 24, 2008 at a Regular Board of Directors meeting, the Board of
Directors approved using the Sewer Maintenance Charge rates established in Fiscal
Year 2007-08, and it will remain in effect until superseded or repealed by a
subsequent resolution subject to the substantive and procedural requirements of
Proposition 218 (California Constitution Article XIII D).
NOW THEREFORE, BE IT RESOLVED by the Board of Directors of the Yorba Linda
Water District to adopt Sewer Maintenance Charge as follows:
Section 1. The Yorba Linda Water District Sewer Maintenance Charge for the Locke
Ranch and Other Areas Outside the District Boundaries for Fiscal Year
2008-09 is hereby approved and adopted at $66.00 per year per
residential or equivalent commercial sewer connection and it will remain in
effect until superseded or repealed by a subsequent resolution, with a
discretionary CPI increase capped at 5% per year.
Section 2. The Yorba Linda Water District Sewer Maintenance Charge for the Locke
Ranch and Other Areas Outside the District Boundaries is hereby fixed in
the amounts and against the owners of parcels with sewer connections as
shown in Exhibit "A" attached hereto and by this reference incorporated
herein.
Section 3. The Board of Directors elects to have the County of Orange
Auditor/Controller collect the charges fixed herein on the tax roll in the
same manner, by the same persons, and at the same time as and together
with and not separately from County of Orange taxes.
Section 4. The Yorba Linda Water District Sewer Maintenance Charge for the Locke
Ranch and Other Areas Outside the District Boundaries is imposed
pursuant to the authority provided in Water Code Sections 31101.5 and
adopted in accordance with the requirements of law.
Section 5. The General Manager or his designee is authorized and directed to file
with the County of Orange Auditor/Controller a copy of this Resolution
together with the listing of parcel numbers and amounts of charges shown
in Exhibit "A" and such other documentation as the County
Auditor/Controller may require in order to accomplish the purpose of this
Resolution.
Section 6. Resolution No. 07-14 is superseded effective immediately by the adoption
of this Resolution.

A meeting of the Executive-Administrative-Organizational Committee was called to
order by Committee Chair Summerfield on Tuesday July 15, at 4:00 p.m. The meeting
was held at the District Administrative Office at 1717 E. Miraloma Ave, Placentia.

DISCUSSION ITEMS:
This portion of the agenda is for matters such as technical presentations, drafts of proposed policies, or
similar items for which staff is seeking the advice and counsel of the Committee Members. This portion of
the agenda may also include items for information only.
2. 2005 Urban Water Management Plan
General Manager Payne reported that the information requested by the State on
the District's Urban Water Management Plan has been provided to the State. Staff
will continue to monitor to insure the report has been officially accepted.
3. Review of Board of Directors & General Manager - Form 700 (continued)
The Committee discussed Form 700 and various reporting requirements.
Cindy Mejia, Management Analyst joined the committee meeting after item 3 was
discussed.
4. OC Grand Jury Report - Orange County's Potential Water Crisis
General Manager Payne reviewed a letter received by the OC Grand jury. Mr.
Payne also stated his intentions to split the report into two segments and present
the Public Information Technology Committee with the policy decisions of water
conservation and the Executive-Administrative-Organizational Committee with the
policy decisions of rate structure, incentives and penalties. The Committee
discussed a grant application being submitted for financial assistance for
developing a model for determining water use and identifying penalties. MWDOC
is taking the lead and General Manager Payne announced he has volunteered the
District to be a partner in the grant process. There are a total of 15 other agencies
reviewing the grant. The State will announce approved grants by the end of July.
5. Prevailing Wage Rates
President Summerfield questioned staff and general counsel about an article in the
newspaper about prevailing wages on a project in Irvine. Mr. Kidman responded
the District needs to pay prevailing wages on District projects.
6. Status Report on Legislative Issues
The Committee received an update report from Sacramento Advocates on the
state of California's budget.
7. Status Report on Grant Applications.
The Committee briefly reviewed a report prepared by Townsend Public Affairs, Inc.
General Manager Payne advised he was meeting with Townsend to develop to
canceling the existing contract and developing a new list of duties.

Mr. Nitin Patel, CPA, from Diehl Evans, gave a presentation to the Committee. The
directors asked several questions. The auditors will give an exit presentation to the

The Investment Report for month ending May 31, 2008 was discussed and
accepted as presented.
4. Status report on Wells Capital portfolio investments as of May 31, 2008.
The Committee passed on the call to Keith Khorey. Staff had previously talked to
him, and there were no concerns at this time.

health coverage benefit for any Board of Director sworn into office on or after January 1,
1995. Pursuant to Assembly Bill 1771 introduced February 5, 1998, in order for elected
officials to be eligible for retiree health coverage, the District must have had a policy in
place prior to 1994, and the Director would have had to be on board prior to January 1,
1995.
3. Staff informed the committee of ACWA's 2008 workers compensation program renewal
for the effective coverage period of July 1, 2008 - 2009.
4. Staff informed the committee on the status of the District's current recruitments.
5. Staff informed the committee on the status of District personnel on Administrative
Leave.

A meeting of the Planning-Engineering-Operations Committee was called to order by
Committee Chair William Mills at 4:00 p.m. The meeting was held at the District
Administrative Offices at 1717 E. Miraloma Avenue, Placentia.

DISCUSSION ITEMS:
1. Preventative Maintenance Program Status Report. Mr. Mendum reported on the
monthly maintenance activities and presented the updated spreadsheet tracking
progress of these efforts. Mr. Mendum reported that the temporary reassignment of
personnel from programs that are ahead of schedule now assisting the Meter
Services Division are doing very well to catch up on the meter replacement program.
Mr. Mendum reported the meter replacement program targets will be met by the end
of the month.
2. Status Report on the Meter Replacement and Radio Read Retrofit Project. Mr.
Mendum reported his crews have completed the replacements skipped by the
District's contract services and were nearly completed with the replacement of the
large meters in the western third of the District, all of which were associated with the
first phase of the replacement project. Mr. Mendum left the meeting following this
discussion.
3. Monthly Water Production and Purchased Imports through May 2008. Mr.
Vecchiarelli and Mr. DeCriscio reported on the progress of groundwater production
for the month of June and for the fiscal year 2007-08. Mr. Vecchiarelli reported the
District finished the water year very close to the goals established by the budgeted
basin production percentage (BPP). However because of system groundwater
production and transmission limitations, YLWD was unable to take advantage of
additional opportunity costs created by the elevated BPP this year. The Committee
discussed the timing of addition improvements required to improve the District's
capabilities in the future, especially additional groundwater wells.
4. Monthly Orange County Groundwater Producers Meetings. Mr. Vecchiarelli reported
the monthly meeting agenda was light and staff did not attend.
5. Monthly MWDOC Managers Meeting Summary Report. Mr. Vecchiarelli reported on
his attendance at the monthly managers meeting. Of particular interest was a
presentation by IRWD on their allocation-based rate structures.
6. Status Report on Capital Improvement Projects in Progress. Mr. Vecchiarelli
reported on progress of the Highland Reservoir Replacement Project and proposals
for two new groundwater production well sites.
7. Proposed Action Plan Responding to OC Grand Jury Report. Mr. Vecchiarelli
reported staff was not prepared to discuss this item.
ACTION ITEMS:
8. Consider Change Order No. 3 with SSC Construction, Inc. for the Lakeview
Reservoir Project. Staff presented a report with a recommendation for support of
negotiated Change Order No. 3, in the amount of $55,393.45 and 27 days with
release of one half of the ten percent retention held to date and further reducing
subsequent retentions to five percent on future progress payments. The Committee
discussed staffs recommendation at length and recommended staff modify the
conditions for release of half the retention funds. Staff was advised to condition the
reduction in retention with beneficial use of the new reservoir storage. The modified
Change Order No. 3 and a revised staff report were presented to the full Board of
Directors on July 10, 2008.

AD HOC COMMITTEE MEETING
June 16, 2008, 9:00 a.m.
A meeting of the Yorba Linda Water District and the City of Placentia Ad Hoc Committee was
called to order at 9:00 a.m. The meeting was held at the Yorba Linda Water District, 1717 E.
Miraloma Avenue, Placentia.

INTRODUCTION OF VISITORS AND PUBLIC COMMENTS:
None
DISCUSSION
1. Governor Schwarzenegger Declaration
General Manager Payne reported on a Press Release issued by Governor
Schwarzenegger about the drought. The Committee discussed various issues of the
drought and various stands met, MWDOC and other agencies were taken. A copy of
the press release was provided to the city. Mr. Payne stated he would have the
District staff work with the City staff to keep the residents informed.
2. YLWD - Implement Voluntary 10%
Director Beverage spoke about the Board's concerns about the drought and that staff
and committee were evaluating the various conservation levels in the District's Urban
Water Management Plan. The Board agreed to implement a voluntary 10% reduction
at this time, but may need to implement level 2 should the residents not meet the
desired levels.
3. Water Conservation
The committee discussed the latest in synthetic turfs and the various applications
found throughout the community. The District is still working with surrounding cities,
school districts and other water agencies on securing funding for rebates. The city of
Placentia is desirous of staying involved and possibly becoming a participant. Smart
Controllers, low flow toilets, and front loading wash machines were also discussed.
Mr. Butzlaff reported on his experiences while at the city of Palm Springs.
4. OCWD Annexation Update
General Manager Payne gave a history of the groundwater situation in OC and the
District's reasons and intends to annex the balance of the District lands into OCWD.
The committee discussed issues and concerns raised by other agencies about the
proposed annexations requested by the city of Anaheim and Irvine Ranch Water
District.
5. District Projects
General Manager Payne gave a brief report on the Capital Projects identified in the
budget and a status report on the large projects. Mr. Payne and Mr. Butzlaff agreed
to meet in July to tour these sites.
6. City of Placentia Issues
Mayor Nelson and Mr. Butzlaff reported on projects and issues the city of Placentia is
working on. There is several high priority projects that the city would like to implement
immediately.
7. YLWD Administration Building Dedication - July 16
Director Beverage reported on the District's Administration Building Dedication
planned for July 16. The Mayor and Mr. Butzlaff indicated they would attend as well
as some of their key staff.
