If the matter is on this agenda, the committee Chair will recognize the individual for their comment when the item is considered. No action will be taken on matters not listed on this agenda. Comments are limited to matters of public interest and matters within the jurisdiction of the Water District. Comments are limited to five minutes. ACTION ITEMS This portion of the agenda is for items where staff presentations and committee discussions are needed prior to formal committee action. 1. Damage Claim filed by Michael F. Burns, Recommendation: That the Committee recommend to the Board to reject and refer the claim to ACWA/JPIA. DISCUSSION ITEMS This portion of the agenda is for matters such as technical presentations, drafts of proposed policies, or similar items for which staff is seeking the advice and counsel of the Committee Members. Public Employee Discipline/Dismissal/Release Pursuant to Section 54957 of the California Government Code 1 ØgIGINAL ADJOURNMENT The next regularly scheduled meeting of the Personnel-Risk Management Committee will be held March 9, 2009 at 4:00 p.m. Items Distributed to the Committee Less Than 72 Hours Prior to the Meeting Pursuant to Government Code section 54957.5, non-exempt public records that relate to open session agenda items and are distributed to the Committee less than seventy-two (72) hours prior to the meeting will be available for public inspection in the lobby of the District's business office located at 1717 E. Miraloma Avenue, Placentia, CA 92870, during regular business hours. DISCUSSION: On December 16, 2008, the District received a claim from Mr. Michael Burns requesting reimbursement in the amount of $1,719.20 for property damages caused by no water supply to claimant's neighborhood when the District shut off the water without issuing proper notice to claimant and his neighbors. The incident occurred at Staff investigated and reviewed the submitted claim. The incident occurred when an earthquake valve at the reservoir was shut off accidently during routine maintenance preventing water from leaving the reservoir. The District's stand-by Operator was contacted on November 12, 2008 with reports of no water at various homes around the Quarter Horse Reservoir. Staff discovered the earthquake valve had been shut off accidently during a routine maintenance inspection preventing water from leaving the reservoir. Because there was no water for several hours and hydrants had to be flushed the claimant's water pump burned up because it had no water supply to it. The claimant was not properly notified because District staff was not aware of the water supply being shut off until residents began to call into the District with complaints of no water supply at their residence. Based on my investigation and the documents submitted by claimant and review of the Seismic Monitor Inspection Report staff is recommending the claim be rejected and referred to ACWA-JPIA for further processing. STAFF RECOMMENDATION: That the Personnel/Risk Management Committee recommend to the Board of Directors to reject the claim and refer to ACWA-JPIA.
