HomeMy WebLinkAbout1963-11-27 - Ordinance No. 3ORDINANCE NO. 3 AN ORDINANCE OF THE YORBA LINDA COUNTY WATER DISTRICT APPROVING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY, DESIGNATED "ANNEXATION NO. 63-1 (Anderson), TO THE YORBA LINDA COUNTY WATER DISTRICT. Be it ordained by the Board of Directors of the Yorba Linda County Water District as follows: WHEREAS, on the 23rd day of October, 1963, the Board of Directors of the Yorba Linda County Water District did pass and adopt Resolution No. 87 giving notice of the proposal to annex certain uninhabited territory to the Yorba Linda County Water District, said territory being therein designated as "Annexation No. 63-1 (Anderson)", said Resolution describing the boundaries of the territory proposed to be annexed; and WHEREAS, said Resolution No. 87 did contain a notice of the day, hour and place when and where the Board of Directors of the Yorba Linda County Water District would hear protests made by any person owning property within the territory proposed to be annexed, the time of said hearing being not less than 20 nor more than 40 days from the date of passage of said Resolution; and WHEREAS, on the 27th day of November, 1963, at the hour of 10:00 o'clock A.M., in the office of the District, 4866 South Olinda, Yorba Linda, County of Orange, State of California, said time and place being the day, hour and place fixed in said Resolution No. 87 for hearing protests to the said annexation, the said Board of Directors did hear and pass upon all protests made to the proposed annexation and did determine that protests had not been made by the owners of one-half (1/2) -1- of the value of the privately-owned territory proposed to be annexed as shown by the last equalized assessment roll, nor by public owners of one-half (1/2) of the value of the publicly- owned territory proposed to be annexed as determined by said legislative body; and that no protests had been filed; and WHEREAS, said territory is contiguous to the Yorba Linda County Water District and is uninhabited territory in the County of Orange; NOW, THEREFORE, the Board of Directors of the Yorba Linda County Water District does hereby approve the annexation of the territory hereinafter described to the Yorba Linda County Water District, upon the following terms and conditions: The included property shall pay, at a time and in a manner to be fixed by the Board, an amount equal to the taxes that would have been paid to the District had the property been a part of the District at its formation. Such amount shall be computed on land, improvements, trees, personal property and unsecured credits only and shall not bear interest. Said Board of Directors does hereby further ordain that the said territory be and is hereby annexed to the Yorba Linda County Water District. That said territory, the annexation of which to the Yorba Linda County Water District is herein approved, is all that territory situate in the County of Oranges, State of California, more particularly described as follows: That portion of Lot Fifteen (15) of Hazard's Subdivision, in the County of Orange, State of California, as per map thereof recorded in Book 18, page 7, of Miscellaneous Records of Los Angeles County, California, bounded and described as follows: Beginning at the point of intersection of the centerline of Linda Vista Street, 40.00 feet in width as now laid out, with the Westerly prolongation of the Northerly line of Morse Avenue, 49.5 feet in width as now laid out; thence South 89° 58' East 618.89 feet, more or less, along said Westerly prolongation and along the Northerly line of said Morse Avenue to the TRUE POINT OF BEGINNING; thence continuing South 89° 58' East 440.24 feet along the Northerly line of said Morse Avenue to the Easterly line -2- of said Lot 15 of Hazard's Subdivision; thence North 0° 01' East 1024.32 feet along the Easterly line of said Lot 15 of Hazard's Subdivision to the Northeast corner of said Lot 15 of Hazard's Subdivision; thence North 89° 58' West 440.24 feet along the Northerly line of said Lot 15of Hazard's Subdivision; thence South 0° 01' West 1024.32 feet along a line parallel with the Easterly line of said Lot 15 of Hazard's Subdivision to the Northerly line of said,Morse Avenue, the true point of beginning. That said Board further finds and determines that the pro- ceedings comply with the law, that the inclusion is authorized by law, and that the inclusion will be for the best interests of the District and the land. Adopted by the Board of Directors of the Yorba Linda County Water District, Orange County, State of California, at its regular meeting held on November 27,1963.
