AN ORDINANCE OF THE BOARD OF DIRECTORS
OF THE YORBA LINDA WATER DISTRICT
ADOPTING THE SEWER MAINTENANCE CHARGE
AND TO REPEAL ORDINANCE NO. 89-01 CONCERNING SEWER
MAINTENANCE CHARGES
WHEREAS, the Board of Directors of the Yorba Linda Water District have, from time
to time, adopted Resolutions and Minute Orders establishing rates,
policies, and procedures for provision of Sanitary Sewer Service within
the District boundaries; and,
WHEREAS, the Board of Directors have, by previously adopted Resolutions and
Ordinances, set the Sewer Maintenance Charge rate per connection for
customers who receive both water and sewer services provided by the
District; and,
WHEREAS, under authority of the California Health and Safety Code Section 5471,
the District may levy said Sewer Maintenance Charge for the purposes
of maintaining the sewer collection system.
WHEREAS, the Board of Directors of the Yorba Linda Water District adopted
Ordinance No. 89-01 on August 24, 1989, for the purpose of
establishing the sewer maintenance charge.
BE IT ORDAINED by the Board of Directors of the Yorba Linda Water District as
follows:
Section 1: Ordinance No. 89-01 of this Board of Directors entitled
"An Ordinance of the Board of Directors of the Yorba Linda Water District
Adopting The Sewer Maintenance Charge" is hereby repealed.
Sect,Lpn 2: The Yorba Linda Water District Sewer Maintenance
Charge for Fiscal Year 1991-92 and each year thereafter until this
ordinance is repealed or the charge is modified are hereby approved and
adopted at $2.00 per month, per connection.
Section 3: The Yorba Linda Water District Sewer Maintenance
Charge is hereby fixed against all connections within the District's
boundary that are also connected to the District's sewer collection system.
Section 4: The Board of Directors elects to have the Sewer
Maintenance Charge fixed herein collected as a part of the water bill for
those customers within the District's boundary.
Section 5: This Ordinance shall take effect 30 days after its
publication. The General Manager or his designee is authorized and
directed to cause a complete copy of the text of this Ordinance to be
published once in a newspaper of general circulation in the District.
