The adjourned meeting of the Board of Directors of the Yorba Linda
County Water District was called to order by President Clodt at
6:17 p.m. in the offices of the District on Plumosa Drive.
Directors present and answering the foll: Fred Clodt, Roy Knauft,
Howard Lindow and Art Korn. Director Merwin Wagner absent. Also
present assistant general manager P.D. Royere and secretary Jean
Mathews.
Mr. Royere presented the directors with a letter dated June 28,
1977 received at 2:00 p.m. from Aft Simonian city manager of Yorba
Linda with the council's reply to the last letter the Board had
sent with regard to the Joint Powers Agreement and the 15 year time
limit. City has again stated 90 day term is only one they will
accept and all through the letter the City had stressed the fact
that the District will not make a commitment for service to the
East. July 5th given as the date that the District must either
accept or reject the City's new proposal.
Discussion. Board called Mr. Littleworth attorney on the con-
ference phone. Board stated their position to Mr. Littleworth
and asked for his advice on the matter, they also asked for a
budget figure on the fees.
- Mr. Littleworth stated that we could go ahead and serve water
without a joint powers agreement and sign the sewer agreement
as presented by the City and use the time to build up the system
and the District against the City's take over.
The other course of action would be to go ahead and serve water
and sewer to all the area east of Yorba Linda as indicated by
our sphere of influence as designated by LAFCO and establish the
time that the present JPA was nullified by the City, notify
LAFCO that we will serve sewer and water and also notify the
developers. City to be told that the District has withdrawn
the JPA offer and rejected the sewer JPA as approved by the City
however at the same time to still indicate that the District does
wish to work with the City if at all possible.
Discussion.
Moved by Director Lindow seconded by Director Knauft to take the
second course of action and serve sewer and water to the east
without a joint powers agreement and notify LAFCO of the District's
decision and notify the City before July 5th and to proceed with
the attorney's guidance. The motion carried unanimously.
Moved by Director Lindow seconded by Director Korn to adjourn to
7:00 p.m. July 6, 1977. Motion carried unanimously.
