RESOLUTION OF THE BOARD OF DIRECTORS
OF THE YORBA LINDA WATER DISTRICT
IMPLEMENTING DEMAND REDUCTION ACTIONS FOR A WATER SHORTAGE
LEVEL OF 10-20% (LEVEL 2) AND CERTAIN WATER CONSERVATION
MEASURES RELATED TO THE IRRIGATION OF NON-FUNCTIONAL TURF
WHEREAS, the Board of Directors of the Yorba Linda Water District ("District"), at the
conclusion of a public hearing on June 22, 2021, adopted the 2020 Urban
Water Management Plan and 2020 Water Shortage Contingency Plan
("WSCP") in accordance with California law; and
WHEREAS, the WSCP, which was adopted under Section 10632 of the Water Code and
is attached hereto as Exhibit A, is triggered during water shortage conditions
and describes stages of actions the District must take to manage demand
and available supplies; and
WHEREAS, the State of California is now in its third consecutive year of drought, and in
each year, annual precipitation levels were inadequate to fill the State's key
reservoirs; and
WHEREAS, on July 8, 2021, through Executive Order N-10-21, Governor Newsom
expanded a previous drought emergency declaration to include a total of 50
counties across the state, and called on all Californians to voluntarily reduce
their water use by 15% from 2020 levels; and
WHEREAS, on August 16, 2021, the United States Bureau of Reclamation issued its
first-ever shortage declaration for the Colorado River System; and
WHEREAS, on August 17, 2021, the Metropolitan Water District of Southern California
issued a Condition 2 Water Supply Alert for conservation through drought
ordinances and other measures; and
WHEREAS, on October 19, 2021, Governor Newsom issued a proclamation declaring
that a state of emergency exists in all 58 counties in California due to
ongoing drought conditions; and
WHEREAS, on November 9, 2021, Metropolitan declared a regional drought emergency
for its service area, asking for increased conservation efforts, especially in
those counties that are highly dependent on State Water Project supplies;
and

WHEREAS, on March 28, 2022, through Executive Order N-7-22, Governor Newsom
required the State Water Resources Control Board ("State Water Board") to
consider directing all urban water suppliers to implement, at a minimum, the
response actions identified in their WSCPs for a shortage level of up to
twenty percent (Level 2) by a date to be set by the State Water Board, which
was estimated to be June 10, 2022; and
WHEREAS, on March 28, 2022, upon determining that dry conditions continue to impact
California's water supply, the Department of Water Resources revised the
State Water Project allocation for 2022 to only five percent of requested
supplies; and
WHEREAS, the District's WSCP establishes regulations to be implemented during times
of declared water shortages or declared water shortage emergencies,
including six Water Shortage Levels which establish defined Shortage
Response Actions and Demand Reduction Actions to be activated during
such water shortages, with increasing restrictions on water use in response
to worsening drought or emergency conditions and decreasing supplies;
and
WHEREAS, the State Water Board adopted a drought-related emergency water
conservation regulation on May 24, 2022, that places new requirements on
urban water suppliers, such as the District, and new restrictions related to
the irrigation of non-functional turf which was expected to go into effect the
week of June 6, 2022, and then subsequently changed to on or around June
16, 2022, depending on Office of Administrative Law process.
NOW THEREFORE BE IT RESOLVED by the Board of Directors of the Yorba Linda
Water District as follows:
SECTION 1. Effective June 16, 2022, the District shall implement the demand reduction
actions for a Water Shortage Level of ten to twenty percent (Level 2) as
identified in Table 8-2 of the District's WSCP.
SECTION 2. As specified in the State Water Board's emergency water conservation
regulation adopted on May 24, 2022, the use of potable water is prohibited
for the irrigation of non-functional turf at commercial, industrial, and
institutional sites in order to prevent the unreasonable use of water and to
promote water conservation. However, the use of water is not prohibited to
the extent necessary to ensure the health of trees and other perennial non-
turf plantings or to the extent necessary to address immediate human health
and safety.
SECTION 3. These Demand Reduction Actions and supplemental water conservation
measures related to the irrigation of non-functional turf shall remain in effect
until rescinded by the Board of Directors.
