• RESOLUTION NO, _J& /Z RESOLUTION OF THE BOARD OF DIRECTORS OF YORFA LINDA COUNTY WATER DISTRICT ORDERING, CALLING, PROVIDING FOR AND GIVING NOTICE OF A SPECIAL ELECTION TO BE HELD IN SAID DISTRICT ON SEPTEMBER 29, 19 59, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF SAID DISTRICT A PROPOSITION TO INCUR BONDED INDEBTED- NESS BY SAID DISTRICT FOR A CERTAIN DISTRICTIMPROVEMENT. The Board of Directors of YORBA LINDA COUNTY WATER DISTRICT, Orange County, California, DOES HEREBY RESOLVE, DETERMINE AND ORDER as follows: Section 1. That this Board deems it necessary that said district incur a bonded indebtedness in the principal amount of $1,900,000 for the following purpose: The acquisition of existing water-facilities for the production, storage, transmission and distribution of water and the acquisition and con- struction of additions, betterments, replacements and extensions thereto, including reservoirs, pipe- lines, pumping stations, chlorination facilities and the reconstruction and rehabilitation of portions of said existing water facilities, to- gether with the acquisition of all works, water rights, lands, easements, pipe, pumps, valves, fittings, meters, hydrants, machinery, apparatus, equipment, and other property necessary for any of the foregoing. Section 2. That, after hearing thereon, this Board has heretofore determined, and does hereby determine and state, that the whole of said district will be benefited by the accomplishment of the above purpose and by incurring said bonded indebtedness. Section 3. That the amount of bonded indebtedness proposed to be incurred for said purpose is $1,900,000 ; that the maximum term the bonds to be issued shall run before maturity shall be the maximum term permitted by law, to wit, forty (40) years from the date thereof, but said bonds may be made to mature within a lesser number of years; that the maximum rate of interest to be paid on said indebted- ness shall not exceed the maximum rate permitted by law, to wit, seven per cent (7%) per annum, payable annually for the first year and semiannually thereafter, the actual rate or rates of interest on said bonds to be determined at the time of the sale or sales thereof. Section 4. That a special election be held, and the same is hereby called to be held, in said district on the 29th day of September , 1959 , for the purpose of submitting to the qualified voters of said district the proposition of incurring the said indebtedness and issuing bonds of said district therefor, in the amount and for the purpose herein- above stated. That if the proposition for the incurring of said indebtedness so submitted receives the requisite number of votes, to wit, more than two-thirds of the votes of the quali- fied voters voting on said proposition, bonds of said district in not exceeding the principal amount hereinabove stated shall be issued and sold for the purpose hereinabove set forth. 2. Section 5. That on the ballots to be used at said special election, in addition to any other matters required by law, there shall be printed substantially the following: OFFICIAL BALLOT SPECIAL WATER DISTRICT ELECTION YORBA LINDA COUNTY WATER DISTRICT ORANuE COUNTY, CALIFORNIA September 29, 1959 INSTRUCTIONS TO VOTERS 7o vote, stamp or write a cross in the voting square opposite the word "YES" or the word "NO" as you may desire to vote. All marks otherwise made are forbidden. All distinguishing marks are for- bidden and make the ballot void. If you wrongly mark, tear, or deface this ballot, return it to the inspector of election and obtain another. BOND PROPOSITION: Shall the . Section 6. A cross placed in the voting square after the word "YES" in the manner hereinbefore provided shall be counted in favor of the adoption of the question or proposition. A cross placed in the voting square after the word "NO" in the manner herein- before provided shall be counted against the adoption of the question or proposition. Section 7. That the polls for said election shall be opened art seven o'clock A.M. of the day of said election and shall remain open continuously from said time until seven o'clock P.M. of the same day, when said polls shall be closed, except as provided in Section 5734 of the Elections Code of the State of California. Section 8. That in all particulars not recited in this resolution said election shall be held and con- ducted in the same manner as provided by law in respect to general water district elections so far as applicable, except as provided in Chapter 2, Part .6, Division 12 of the Water Code of the State of California. Section 9. That the Board of Directors of said district shall meet at its usual place of meeting on October 5 , 19 59 , at 7:00 o'clock P.M. of said day, and proceed to canvass the election returns, 4. r Section 10. That for the purpose of holding said election there shall be and are hereby established two ( 2 ) voting precincts designated as herein- after set forth, each such voting precinct to consist of all or a portion or portions of one or more regular election precincts lying within the boundaries of said district as such regular precincts are now established in the County of Orange for the holding of state and county elec- tions. The polling places for the respective voting pre- cincts shall be the places hereinafter designated and the persons hereinafter named, being competent and qualified electors and residents of said district and of their respec- tive voting precincts, are hereby appointed officers of election and they shall hold said election and make return thereof in the manner provided by law. Only registered voters residing in said district are entitled to vote at said election. Special Election Precinct No. 1 shall consist of Yorba Linda Precincts Nos. 1, 2 and 4. Polling Place: Yorba Linda Fire Station Lemon and Lakeview Yorba Linda, California Inspector: William J. Tar=e.. Judge: Laura Landon Clerk: Ruth L. Adams Clerk: Valita L. Julian 5. r r ~ Special Election Precinct No. 2 shall consist of Yorba Linda Precincts Nos. 3 and 5, Richfield Precinct, North Placentia Precinct, South Placentia Precinct and Yorba Precinct. That notice of said election shall be given by the Secretary of this Board of Directors, in the form and manner provided by law, by publication of a Notice of Election in the YORBA LINDA STAR, a newspaper of general circulation printed and published in said district.- No other notice of said election need be given.
