HomeMy WebLinkAbout1965-04-28 - Resolution No. 1244P RESOLUTION NO. 124 RESOLUTION OF THE BOARD OF DIRECTORS OF THE YORBA LINDA COUNTY WATER DISTRICT INITIATING ANNEXATION AND INCLUSION PROCEEDINGS OF UNINHABITED TERRITORY. BE IT RESOLVED by the Board of Directors of the Yorba Linda County Water District as follows: 1. That proceedings have been initiated by the Board of Directors of the Yorba Linda County Water District under the provisions of Chapter 2.5 of Part 8 of Division 12 of the Water Code of the State of California, for the purpose of inclusion of uninhabited territory within the boundaries of the Yorba Linda County Water District, known as Annexation No. 65-1 (Orchard Drive School Site). 2. That the reason for the proposed annexation and in- clusion is that the property herein described proposed for annex- ation and inclusion is desirous of receiving a water supply from and the use of sewer facilities of this District, and that this District is the agency conveniently available to provide sewer facilities and water for domestic and municipal purposes in the area, and that the owners of the property herein described have requested this annexation and inclusion to proceed. 3. That the boundaries of the territory proposed to be annexed and included in the Yorba Linda County Water District are as follows: All that real property in the County of Orange, State of California, being that portion of the first class lands allotted to R. Rivas and V. Yorba, described in the Final Decree of Partition of the Rancho Canon de Santa Ana, a certified copy of which was recorded February 8, 1874, in Book 28, Page 158 of Deeds, records of Los Angeles County, California, described as follows: Beginning at the point on the Northerly line of said first class land of R. Rivas, distant South 75° 49' 14" West along said Northerly line, 31.99 feet from the most Northerly corner of said land, said point being on the Southerly line of the Yorba Linda Tract, per map thereof recorded in Book 5, Pages 17 and 18 of Miscellaneous Maps, records of said County, and on the existing Southerly boundary of the Yorba Linda County Water District, said 1 . • w point being also the most Northerly corner of the land condemned for the use of the Placentia Unified School District of Orange County, California, by the Final Orders of Condemnation in Case #105393 in the Superior Court of the State of California in and for Orange County, copies of said Final Orders being recorded in Book 6460, Page 200, and in Book 6514, Page 183 of Official Records, records of said Orange County; thence, along said southerly boundary of the Yorba Linda County Water District, and alon~ the Northerly line of said condemned land, South 75 49' 14" West 605.66 feet; thence, leaving said Southerly boundary, and continuing along the lines of said condemned land, South 5° 34' 21" West 595.53 feet, South 84° 25' 39: East 641.79 feet, and North 10° 29' 30" East 98.87 feet to the beginning of a tangent curve concave Westerly and having a radius of 960.00 feet; thence Northerly, along said curve through a central angle of 21° 39' 10", a distance of 362.80 feet to a reversed curve concave Easterly and having a radius of 1040.00 feet; thence Northerly, along said reversed curve, through a centralangle of 19° 07' 59", a distance of 347.29 feet to the point of beginning. Containing an area of 10.000 acres, more or less. 4. The terms and conditions of annexation and inclusion are as follows: The applicant shall pay concurrently with the annexation the sum of One Hundred Dollars ($100.00) as applicant's share of the cost of processing this annexation. 5. Any owner of property within the territory proposed to be annexed and included within the Yorba Linda CountyWater District may file with the Secretary of the District at any time prior to the hour set for the hearing thereof written protest to the annexation and inclusion of said territory or to the annex- ation and inclusion of the territory upon such terms and conditions as proposed. 6. That the Board of Directors of the Yorba Linda County Water District hereby fix the time, place and meeting of the Board at which the Board will hear the protests as follows: (a) PLACE OF HEARING: The office of the Yorba Linda County Water District, 4866 South Olinda Street, Yorba Linda, California (b) DATE OF HEARING: Wednesday, May 26, 1965. 2. ~ i (c) TIME OF HEARING: 10:00 o'clock A.M. 7. That said proposed annexation and inclusion of territory was approved by the Boundary Commission of Orange County and the Local Agency Formation Commission. 8.
