HomeMy WebLinkAbout1967-01-11 - Resolution No. 154HRH:dh 1-19-67 6 0 RESOLUTION NO. 154 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE YORBA LINDA COUNTY WATER DISTRICT CONCERNING SANITARY SEWER SERVICE WITHIN THE DISTRICT AND SUPPLEMENTING RESOLUTIONS NUMBERS 41 AND 42. WHEREAS, there are certain areas within the District that, because of location, topography or size of parcels, have been unable to avail themselves of sanitary sewers as has the majority of the District, and have therefore remained undeveloped and have not contributed proportionately to the financial growth and strength of the District; and WHEREAS, it has been found and determined by the Board of Directors that there is a need for a responsibility upon the Yorba Linda County Water District to take all reasonable actions to make water and sewer facilities available to all areas of the district; NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: IA. Any areas of the District comprising at least fifteen (15) acres, whether contiguous or not, and capable of sanitary sewer service from a common line, which desire to have the District participate in the financing of such a sanitary sewer line, may submit a preliminary study or may request the General Manager, and he is hereby authorized, to undertake a preliminary study concerning the feasability of such a proposal. The receipt of such proposal, as well as the preliminary report, shall be brought to the attention of the Board by the General Manager at the earliest moment. 1B. Any areas of the District comprising less than fifteen (15) acres, whether contiguous or not, and capable of sanitary sewer service from a common line, which desire to have 1. • r the District participate in the financing, may request the Board of Directors to undertake a preliminary study concerning the feasability of such a proposal. If the Board determines that the proposal has sufficient merit and will be of general bene- fit to the District, it may authorize the General Manager to cause such a study and report to be made. 2. Upon the receipt of a preliminary report, the Board shall appropriately notify the proponents and permit them an opportunity to comment thereon. The Board may thereafter approve and adopt said preliminary report and authorize the District's financial participation in the project upon the following general conditions: A. That the Yorba Linda County Water District will be the contracting agency for approval of the plans and specifications, advertising for bids, receipt of bids, award of contract, supervision of contract, construction inspection and final acceptance; B. That all funds to be contributed by any participants, other than District, shall be deposited with District in full prior to award of any construction contract. The Board will require a partial deposit for design, engineering, legal and other expenses; C. That all refund monies to which the project might be entitled, by priority or otherwise, are irrevoc- ably assigned to the District until the District has been refunded in full for all its monies ad- vanced or charges owed by said project. Thereafter, any refund monies shall be paid to those entitled thereto pursuant to standard District policy; D. In addition to a charge of five per cent (5%) of the total project cost for overhead and office 2. • LI work, the project shall pay to the District an interest charge on the District's contributions to the project equal to the cost of such money or equivalent money to the District. There shall also be collected a pro-rated sum for the cost of any general engineering, aerial survey, mapping, or other work which the District may have done to assist the promotion of this project; E. That the proponents will contribute a sum of not less than Two Thousand Dollars ($2,000.00) per acre for each acre of the property they are includ- ing within the project for offsite sanitary trunk improvements. The District's participation shall not exceed fifty per cent (50%) of the total project cost without a specific finding by the Board as to the general benefit to the District of such higher participation. 3. Upon the approval and adoption of a project, the Board may undertake its completion as called for in a contract or contracts entered into for such purpose. The General Manager is hereby directed, upon such approval, to notify all other property owners, as they appear on the last equalized assessment roll, who might be benefited by such project, of its adoption and inviting them to participate. No delay in the accomplish- ment of a project is contemplated by late participants. 4. This resolution is intended as a commitment by the Board to meet its obligation to encourage and assist, where possible, the orderly development of the entire District through adequate water and sanitary sewer facilities.
