Home My WebLink About1970-05-13 - Resolution No. 192• RESOLUTION NO. 192 0, A RES01 O THE YORBA LINDA COi 'WER DISTRIC _ERNING PROPOSED DETACI , - . 69-1 WHEREAS,the area proposed for detachment from this District designated Detachment No. 69-1 includes both portions served for water and/or sewer purposes along with portions that are not yet developed as well as fully developed and not re- ceiving any service from this District; and WHEREAS, when this District was organized the property within Detachment No. 69-1 was unimproved except for agricultural purposes and contemplated full use of the District's proposed facilities; and WHEREAS, the California Courts in recent litigation have indicated that the Yorba Linda County Water District should provide water service to all areas within its boundaries so long as it has bonded indebtedness for this purpose; and WHEREAS, IT has been the policy of this District to avoid duplication of service wherever possible while protecting the financial integrity of our District and the security of our bondholders. NOW, THEREFORE, BE IT RESOLVED, DETERMINED AND FOUND by the Board of Directors of the YORBA LINDA COUNTY WATER DISTRICT as follows: 1. The Board approves the detachment from the Yorba Linda County Water District of that portion of Detachment No. 69-1 Northerly of the Southerly line of Tracts 4681 and 4814, all as shown upon a map attached hereto and made a part hereof. 2. That there should be added to condition No. 2 of the Executive Officer's report dated May 8, 1970, the following words: "except that should any of the current bonded indebtedness of other existing contracts or obligations of the Yorba Linda County Water District be defaulted upon , the territory herein to be detached will then, and in that event only, he subject to its share of any such remaining debts." 3. That if paragraphs 1 and 2 of this Resolution are approved it would be the further recommendation of this Board that the Detachment No. 69-1 be approved without a vote being required.
