HomeMy WebLinkAbout1977-02-17 - Resolution No. 77-04RESOLUTION NO. 77-4 RESOLUTION OF THE BOARD OF DIRECTORS OF THE YORBA LINDA COUNTY WATER DISTRICT PROPOSING ANNEXATION NO. 77-1 TO THE YORBA LINDA COUNTY WATER DISTRICT PURSUANT TO GOVERNMENT CODE 9 56195 WHEREAS, the Board of Directors of the Yorba Linda County Water District has determined that annexation to said District of the territory described in Exhibit "A" attached hereto,(hereinbefore referred to as Annexation No. 77-1 to the Yorba Linda County Water District) and by this reference incorporated herein, is to the best interest of said District and that the lands within said territory will be benefited thereby; and WHEREAS, subdivision construction is contemplated within said territory and water and sewer service is imminently needed; and WHEREAS, said territory is uninhabited, as defined in Government Code Section 56074, and all of the landowners as defined in Government Section 56046, have requested the proposed annexation, NOW, THEREFORE, the Board of Directors of the Yorba Linda County Water District does hereby resolve as follows: Section 1: Pursuant to the District Reorganization Act of 1965, Division I, Title 6, of the Government Code of the State of California, the Board of Directors of the Yorba Linda County Water District does hereby make application to the Local Agency Formation Commission for approval of the Annexation No. 77-1 to the Yorba Linda County Water District. Section 2: The territory to be annexed by Annexation No. 77-1 is uninhabited and all of the landowners therein have consented to and requested the annexation. Section 3: The reason for said proposal of annexation is that the landowners have requested water and sewer service with said territory. Section 4: The Board of Directors of the Yorba Linda County Water District does hereby request that proceedings be taken for said annexation as provided for in the District Reorganization Act. The owners of said territory have consented to said annexation. The Board of Directors of the Yorba Linda County Water District further requests that the Local Agency Formation Commission approve the proposal for annexation herein without notice and hearing and authorize the Board of Directors to annex said territory without notice and hearing and without an election as provided in Govern- ment Code Sections 56260 and 56261. Section 5: The Board of Directors of the Yorba Linda County Water District requests that the Local Agency Formation Comm- ission approve this application, denominate the proposed • • annexation, "Annexation No. 77-1 to the Yorba Linda County Water District", and designate the Yorba Linda County Water District the conducting district pursuant to Government Code Section 56291. Section 6: The Secretary of the Yorba Linda County Water District is hereby authorized and directed to file a certified copy of this resolution with the Executive Officer of the Local Agency Formation Commission of Orange County and make all other filings and pay such fees as are necessary to effect the pur- poses and intentions of this resolution. S. A. 12 in the Northerly line of said Rancho; thence along said Northerly line South 880 131 33" East 1877.09 teat to that certain line indicated as "Line of Occupation- Fence of Long Standing" on a Map filed in book 97, pages 11 and 12 of Record of Surveys in the office of the County Recorder of Orange County, California; thence along said certain line and along that certain line indicated as "Fence Line Prod." on said Record of Survey South 020 089 14" East 8,902.50 feet to its intersection with a line parallel with and distant Southwesterly 15.00 feet, measured at right angles, from the center line of Cajon Ditch; thence along said parallel line North 600 15" 36" West 196.59 feet; thence South 010 360 22" .lest 1,803.79 feet to the center line of the main tract of The Atchison, Topeka and Santa Fe Railway Company; thence along said centerline South 830 29' 02" West 873.64 feet to the beginning of a tangent curve concave Southerly having a radius of 3,819.83 feet; and Wasterly alon.^, said curve through a central anglo- of 040 171 33" an arc distance of 286.18 feet to the Southerly prolongation of that certain line indicated as "Fence Line Prod." on said record of Surveys, thence along said Southerly prolongation, said certain line, and that certain line indicated as "Line of occupation-Fence of Long Standing" on said Record of Survey North 020 O1' 1.10" West 8,107.51 feet to a point that bears Nocth 390 34, 43" EdSt 559.34 feet from C. Also Excepting Therefrom the interest in 'a strip of land of the uniform width of 100.00 feet through said land which was condemned to the perpetual use of California Central Railway Company, as being necessary for its right of way, for its main tracts, side-tracks, turn outs, and for such other purposes as are necessary and incidental to railroad construction, maintenance.and operation, by decree of condemnation rendered in the Superior Court of the State of California in and for 'the County of Los Angeles, Case ,No. 6158, a certified copy of which decree was recorded January 21, 1888 in Book 376, page 35 of Deeds of Los Angeles County, California. Also excepting f roa a portion of said land all right, title and interest in and to all oil and mineral rights 500 feet below the surface with no right of entry to the surface, as reserved in Dead from Charles 8. Frank and others, recorded May 14, 1976 in book 11736, page 1413 of Official Records.
