Home My WebLink About1978-05-04 - Resolution No. 78-264a 40 Improvement District No. 1 WHEREAS, on April 6, 1978, this Board of Directors adopted its resolution determining that this board deems it necessary for the Yorba Linda County Water District to incur a bonded indebtedness in the sum of $27,320,000 for the purpose of the acquisition and construction of works and facilities useful or necessary to convey, supply, store or make use of water, including all land, easements, rights of way and other property necessary therefor, and including all engineering, inspection, legal and fiscal agent's fees, costs of the bond election and of the issuance of bonds, and bond interest estimated to accrue during the construction period and for a period not to exceed twelve months after the completion of construction, and all costs and estimated costs incidental to or connected with such acquisition, construction or financing of said facilities. WHEREAS, in said resolution this Board fixed Thursday, May 4, 1978, at 8:30 o'clock a.m., of said day, at the meeting place of this Board, 4622 Plumosa Drive, Yorba Linda, California, as the time and place for the hearing by said Board on the questions: (1) Will the whole or only a portion of the Dis- r do • RESOLUTION NO. 78-26 RESOLUTION OF BOARD OF DIRECTORS OF YORBA LINDA COUNTY WATER DISTRICT MAKING DETERMINATIONS RELATING TO A CERTAIN DISTRICT IMPROVEMENT trict be benefited by the accomplishment of said purpose, and (2) If only a portion of the District will be benefited, what portion thereof will be so benefited; and -1- • :WHEREAS, copies of said resolution, accompanied by notice of said hearing, were duly published and mailed as provided by law and said hearing was duly held at the time and place so fixed; and WHEREAS, at said time and place said hearing was held before this Board and all persons interested, including persons owning property within the district, were given the opportunity to appear and present any matters material to the questions set forth in said resolution, and a full and fair hearing has been had; NOW, THEREFORE, the Board of Directors of Yorba Linda County Water District DOES HEREBY RESOLVE, DETERMINE and ORDER as follows: SECTION 1. That as a result of said hearing and upon the said evidence presented, this Board does hereby deter- mine that the whole of said district will not be benefited by the accomplishment of said purpose, and that only a por- tion of said District will be benefited by the accomplish- ment of said purpose, which portion so benefited is deter- mined to be the portion of said District lying within an exterior boundary line described in Exhibit "A" attached hereto and by this reference incorporated herein. SECTION 2. That the portion of said Yorba Linda County Water District described in Section 1 hereof shall hereupon constitute and be known as "Improvement District No. 1 of Yorba Linda County Water District." EXCEPTING THEREFROM: Those portions of land described as Exceptions "B", "C", "D" and "E" in aforementioned Parcel "2" in Annexation No. 78-1. The above described Improvement District No. 1 contains 3932 acres, more or less.
