HomeMy WebLinkAbout1978-05-04 - Resolution No. 78-34• RESOLUTION NO. 78-34 RESOLUTION OF THE BOARD OF DIRECTORS OF YORBA LINDA COUNTY WATER DISTRICT RE RATIFICATION OF NOTICES OF EXEMPTION AND NEGATIVE DECLARATIONS FOR IMPROVEMENT DISTRICTS NO. 1 AND NO. 2. WHEREAS, certain property owners within the District have requested this Board water facilities to serve after study, the District two improvement districts authorization for general water service within the boundaries; and to consider methods of financing the East Yorba Linda area and, staff has proposed formation of for the purpose of seeking voter obligation bonds to provide proposed improvement district WHEREAS, the District staff and consultants have prepared plans of works in order to provide cost estimates for said bond authorization elections and such plans of works were based upon projections and preliminary plans of the landowners in the East Yorba Linda area; and WHEREAS, this Board of Directors has been advised by District counsel that the preparation of the plans of works, the formation of the proposed improvement districts and the conduct of elections within the improvement districts do not constitute "projects" and are therefore exempt from the provisions of the California Environmental Quality Act and, based upon such advice, Notices of Exemption have been prepared and filed; and WHEREAS, the District staff, by way of caution in order to assure maximum compliance with the intents and purposes of CEQA, has prepared an environmental evaluation with respect to the creation of the proposed improvement districts and such related matters. Such environmental evaluation has concluded that no environmental impact will -1- result from creation of the improvement districts since such creation will not result in any change in the environment facilities with the proceeds and since the construction of any of the improvement district bonds, if authorized by the voters, will require discretionary approval of this Board, and, con- sequently, will require environmental documentation; and WHEREAS, based upon the Environmental Evaluations, the District staff, after providing the notices required by law and the District local CEQA Guidelines, has filed a Negative Declaration with respect to the proposed formation of the improvement districts; NOW, 'T'HEREFORE, the Board of Directors of the Yorba Linda County Water District does hereby resolve, find, determine and order as follows: The District staff has prepared and filed Notices of Exemption and Negative Declarations with respect to the creation of Yorba Linda County Water District Improvement Districts No. 1 and No. 2 and conduct of bond authorization elections therein, in compliance with the procedures of law and the District's Objectives, Criteria, and Procedures Implementing the California Environmental Quality Act. The Board has heard and considered comments from the public with respect to said Negative Declarations. This Board hereby ratifies and approves the preparation and filing of said Notices of Exemption and Negative Declarations.
