Home My WebLink About1979-05-24 - Resolution No. 79-28.4 0 0 RESOLUTION NO. 79-28 RESOLUTION OF THE BOARD OF DIRECTORS OF THE YORBA LINDA COUNTY WATER DISTRICT DETERMINING AND ORDERING ANNEXATION NO. 78-7 TO YORBA LINDA COUNTY WATER DISTRICT WHEREAS, by Resolution No. 78-54, the Board of Directors of the Yorba Linda County Water District made application to the Local Agency Formation Commission for approval of a proposal for annexation to the Yorba Linda County Water District of the territory described in Exhibit "A" attached hereto; and WHEREAS, on January 24, 1979, by Resolution No. 79-15, the Local Agency Formation Commission approved said proposal for annexation, assigned to said annexation the designation of "Annexation No. 78-7 to Yorba Linda County Water District," designated Yorba Linda County Water District as the conducting District, and directed said District to initiate proceedings in compliance with said resolution; and WHEREAS, on may 24,. 1979, a public hearing was conducted by the Board of Directors of the Yorba Linda County Water District and the findings of the Local Agency Formation Commission, expressed in Resolution No. 79-15 were considered and members of the public were permitted to comment on proposed Annexation No. 78-7 to the Yorba Linda County Water District; NOW, THEREFORE, the Board of Directors of the Yorba Linda County Water District does hereby resolve, order, and determine as follows: Section 1: The inclusion of territory proposed by Annexation No. 78-7 to the Yorba Linda County Water District will be to the best interest of the District and to the present and future landowners and inhabitants of the District and the territory proposed to be annexed. Section 2: The territory proposed to be annexed by Annexation No. 78-7 is uninhabited as defined in Government Code Section 56075 and written protests filed and not withdrawn represent less than 50 percent of landowners owning less than 50 percent of the assessed value of land within the territory proposed to be annexed and in accordance with Government Code Sections 56319.1 through 56322, Annexation No. 78-7 may occur without an election. Section 3: Pursuant to Government Code Section 56322 and the authorization of the Local Agency Formation Commission of Orange County as set forth in its Resolution No. 79-15, the territory described in Exhibit "A" attached hereto shall be, and hereby is, annexed to and included within the boundaries of the Yorba Linda County Water District subject to the following terms and con- ditions: (a) The territory within Annexation 78-7 to the Yorba Linda County Water District shall be annexed without provision or lia- bility for payment of taxes or expenses of the District incurred prior to the effective date of the annexation. (b) The territory within Annexation 78-7 to the Yorba Linda County Water District shall not be liable for the assessment, levy, collection or payment of property tax of the Yorba Linda County Water District except for those property taxes necessary to provide for payment of indebtedness specifically incurred to provide water service and facilities to said territory and also excepting those property taxes necessary to provide for payment of that portion of the District's general operation and maintenance expenses incurred to provide water service and facilities to said terri- tory. (c) The territory annexed to the Yorba Linda County Water District shall also be included within Improvement District No. 1 of the Yorba Linda County Water District and subject to privileges and obligations, including bonded indebtedness of such Improvement District No. 1. Section 4: The Secretary or Assistant Secretary is authorized and directed to make the filings provided for in Government Code Sections 56450, et seq., and 54900, et seq. Section 5: The District officers are authorized and directed to draw a check in the sum of $210.00 in favor, of the State Board of Equalization in payment of required filing fees. Secretary, Yorba Linda County Water District -3- Yorba Linda County Water District Annexation 78-7 Beginning at the Westerly terminus of that certain course described as having a bearing of South 870 54' 37" East, and a distance of 787.19 feet in Annexation 78-1 to the Yorba Linda County Water District, per Resolution No. 78-20 of the Board of Directors of said district, said point being on the Northerly boundary of Exception C in said annexation; thence, following along said annexation boundary as described in said exception C in a general Easterly, Southerly, Northwesterly and Northerly, Easterly, Northerly, Westerly and Northwesterly direction to a point in the Easterly line of the Yorba Linda County Water District as created by Annexation No. 78-3; thence leaving the boundary of said Annexation No. 78-1 and going Northerly along said Easterly line of Annexation No. 78-3 and continuing along the boundary of said exception C to the point of beginning.
