RESOLUTION NO. 79-,-7/
A RESOLUTION OF THE BOARD OF DIRECTORS OF THE YORBA LINDA COUNTY WATER
DISTRICT CONSENTING CONDITIONALLY TO ENTER THE JOINT PROTECTION PROGRAM
OF THE ASSOCIATION OF CALIFORNIA WATER AGENCIES JOINT POWERS INSURANCE
AUTHORITY.
The Board of Directors of Yorba Linda County Water District does hereby find, determine,
and resolve as follows:
WHEREAS, pursuant to the provisions of Sections 990, 990.4, 990.8, and
6500 of the Government Code, this District has heretofore expressed its intent to
enter into an agreement with various other Districts entitled Joint Powers Agreement:
Creating the Association of California Water Agencies Joint Powers Insurance
Authority (the "Authority") for the purpose of creating a joint powers insurance
authority to provide for and administer a joint protection program as more fully
set forth in said Agreement; and
WHEREAS, said Agreement has heretofore been approved by the Board of
Directors of the Authority; and
WHEREAS, a joint protection program has been developed by said Authority
pursuant to the provisions of said Agreement, and in particular Articles 15, 16,
and 21 thereof, the basic terms of which program are set forth in the consultants'
"Joint Liability Risk Management Program Feasibility Study Update" dated November
1978, a copy of which is on file in the office of this District, and is incorporated
in this resolution by reference; and
WHEREAS, estimated first year's premiums for the several member Districts
have been developed pursuant to said Agreement and the estimated premium for this
District is set forth in a schedule prepared by paid consultants, dated June 5,
1979 under the heading Association of California Water Agencies Joint Powers Ins-
urance Authority, Deposit Premiums Schedule, a copy of which is on file in the
office of this District; and
WHEREAS, said report and schedule give notice that the estimated deposit
premium to be made by this District for liability exclusive of dam failure liability
is the sum of $19,767.00; and

WHEREAS said joint protection program offers significant advantages
to this District in terms of cost, liability protection, and services, and enter-
ing such program, on the conditions hereinafter set forth, would be and is in the
best interest of this District.
NOW, THEREFORE, BE IT RESOLVED:
Section 1. That Yorba Linda County Water District hereby consents pur-
suant to the terms of this Agreement, to enter said joint protection program on
the following conditions:
(a) That the actual deposit premium for this District for the first
year of such joint protection program, as determined by the Authority
following the expiration of thirty (30) days after June 5, 1979,
shall not exceed the amount of the estimated deposit premium set forth
above and
(b) That at least sixty (60) Districts, with a combined 1978/79
liability policy premium of $2 million, consent in writing to enter
the joint protection program.
Section 2. That the District hereby selects $5,000 as its retention for
the first year under the Authority's cost allocation formula for liability exclusive
of dam failure liability.
Section 3. That the Secretary of the Board of Directors of this District
is directed to certify a copy of this resolution and to forward the same promptly
by mail to the Association of California Water Agencies, 1127 11th Street, # 305,
Sacramento, California 95814.
