HomeMy WebLinkAbout1979-12-06 - Resolution No. 79-42RESOLUTION NO. 79_ RESOLUTION OF THE BOARD OF DIRECTORS OF THE YORBA LINDA COUNTY WATER DISTRICT FINDING THE CONSTRUCTION OF CERTAIN SANITARY SEWERS TO BE NECESSARY AS A HEALTH MEASURE WHEREAS, the Yorba Linda County Water District ("District") desires to undertake proceedings for the construction or acquisition of sanitary sewers in an assessment district within the District, described as proposed Assessment District 79-1 (Ohio-Oriente); and WHEREAS, the Health Officer of the County of orange has been designated as the Health Officer of the City of Yorba Linda in which the proposed assessment district is situated; and WHEREAS, said Health officer has recommended in writing that the District undertake such proceedings for the construction or acquisition of sanitary sewers within said proposed assessment district as necessary as a health measure; and WHEREAS, the recommendation of said Health Officer is based on the existence of five actual failures of existing systems as well as several potential failures in the proposed assessment district; and WHEREAS, the written recommendation of said Health Officer has been spread upon the Minutes of the Board of Directors of the District. A copy of said recommendation is attached hereto as Exhibit "A"; and WHEREAS, the District Engineer concurs in the recommen- dation of said Health Officer; and WHEREAS, Section 2808 of the California Streets and High- ways Code provides that none of the provisions of the Special Assessment Investigation, Limitation and Majority Protest Act of 1931, being Division 4 of said Code, shall apply to proceedings for the construction and/or acquisition of sanitary sewers when such proceedings have been recommended in writing by the health officer of the City in which such proceedings are instituted and ill I such written recommendate is spread upon the Minutes of the legis- lative body conducting such proceedings and such necessity is found to exist by resolution adopted by the four-fifths vote of the members thereof, NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Yorba Linda County Water District, as follows: Section 1. The foregoing recitals are true and correct and the Board of Directors so finds and determines. Section 2. Proceedings for the acquisition or construction or acquisition and construction of sanitary sewers in an assessment district described as proposed Assessment District 79-1 (Ohio-Oriente), the boundaries of which are described as Exhibit "B" attached hereto, are necessary as a health measure, and the Board of Directors of the Yorba Linda County Water District so finds and determines. Section 3. None of the provisions of the Special Assessment Investigation, Limitation and Majority Protest Act of 1931, being Division 4 of the California Streets and Highways Code, shall apply to the proceedings described in Section 2 hereof. Box 309 Yorba Linda, California Dear Mr. Shook: RFc Manager District J F~ Pu* .i )2686 o,sr~ 00 r~rr I have investigated the potential health hazards caused by the failure of onsite private sewer systems in the area within the Yorba Linda County Water District located northwesterly of the intersection of Ohio and Oriente Streets, including J&J Lane, Hideaway Lane, Villa Terrace and Vallecito Lane. The boundaries of this area are more specifically noted on the diagram attached hereto as Exhibit "A". The investigation has disclosed five actual failures of existing systems as well as several potential failures in the area. I have also reviewed the Yorba Linda County Water District's master plan of facilities that have been proposed to provide public sanitary sewer service to the above described area. Based upon the foregoing, it is my finding that the proposed construction of sanitary sewers to serve the area described is necessary as a health measure pursuant to Section 2808 of the Streets & Highways Code.
