HomeMy WebLinkAbout1980-08-28 - Resolution No. 80-26RESOLUTION NO. 80-26 RESOLUTION OF THE BOARD OF DIRECTORS OF THE YORBA LINDA COUNTY WATER DISTRICT, PRELIMI- NARILY ADOPTING, CONFIRMING AND APPROVING ENGINEER'S REPORT AND APPOINTING TIME AND PLACE FOR HEARING PROTESTS TO PROPOSED IM- PROVEMENTS IN ASSESSMENT DISTRICT 79-1 (OHIO-ORIENTE) WHEREAS, the Board of Directors ("Board") of the Yorba Linda County Water District ("District"), by Resolution No. 79-45, hereto- fore adopted by the Board on December 6, 1979, declared its inten- tion to order work, acquisitions and improvements in Yorba Linda County Water District Assessment District 79-1 (Ohio-Oriente), therein described; and WHEREAS, the Board in and by said resolution referred the proposed work, acquisitions and improvements to the Engineer of Work, and directed the Engineer to make and file with the Secretary of the Board a report containing the matters specified in Section 10204 of the Streets and Highways Code (the "Code"); and WHEREAS, the Engineer has filed with the Secretary of the Board his report (the "Report") in writing containing the matters specified in Section 10204 of the Code, including the following: (a) Plans and specifications of the proposed improvement if the improvement is not already installed; (b) A general description of the property necessary or convenient for the operation of the work and improve- ments and of the property to be acquired as a part of the improvement; (c) An estimate of the cost of the proposed improvements and acquisitions and incidental expenses in connection therewith; (d) A diagram showing the assessment district and the boundaries and dimensions of the subdivisions of land within the district as they existed at the time of the passage of the Resolution of Intention, each of which subdivisions has been given a separate number upon the diagram, and showing the relative location of the parcels of land to the work proposed to be done and the improvements to be made; (e) A proposed assessment of the total amount of the cost and expenses of the proposed improvements distributed and allocated upon the several subdivisions of land in the district in proportion to the estimated bene- fits to be received by such subdivisions, respectively, from the improvements; and 0 0 WHEREAS, the Report has been duly presented by the Secretary to the Board for consideration and has been fully considered by the Board. NOW, THEREFORE, THE BOARD OF DIRECTORS OF THE YORBA LINDA COUNTY WATER DISTRICT DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1: The foregoing recitals are true and correct and the Board so finds and determines. SECTION 2: The Report, including the plans, specifications, general description, estimate of the cost of work, acquisitions and improvements and incidental expenses in connection therewith, diagram and proposed assessment, is hereby preliminarily adopted, confirmed and approved. SECTION 3: Thursday, October 2, 1980, at 7:30 p.m. at the Yorba Linda County Water District offices located at 4622 Plumosa Drive, Yorba Linda, California, are hereby fixed as the time and place for hearing protests to the proposed work, acquisitions and improvements. Any interested person may object to the proposed work, acquisitions and improvements, the extent of the assessment district or to the proposed assessment, by filing a written protest with the Secretary of the Board at or before the time set for the hearing, and the Secretary shall endorse on each protest the date of its receipt and at the time appointed for the hearing shall present to the Board all protests filed with her. SECTION 4: The Secretary is hereby directed to cause to be posted conspicuously in the time, form and manner provided by law, notices of the passage of the Resolution of Intention. SECTION 5: The Secretary is hereby directed to cause a notice of the passage of the Resolution of Intention similar in substance to the notice described in Section 10303 of the Code to be published in the County pursuant to Section 6066 of the Govern- ment Code of the State of California in the "Daily News Tribune," a newspaper published and circulated in the County, and to cause notice by mail to be given of the adoption of the Resolution of -2- Intention and of the filing of said Report to all persons owning real property proposed to be assessed in the time, form and manner provided by Chapter 4, Division 12 of the Code, and otherwise in accordance with all requirements of law. SECTION 6: The Secretary is hereby designated to answer inquiries regarding the protest proceedings herein provided for, and the above described notices shall so indicate. SECTION 7: Upon the completion of the mailing of said notices, the Secretary is hereby directed to file with the Board an affidavit setting forth the time and manner of the compliance with the requirements for publishing, posting and mailing said notices.
