HomeMy WebLinkAbout1986-09-25 - Resolution No. 86-12• 0 RESOLUTION NO. 86-,U RESOLUITON OF THE BOARD OF DIRECTORS OF THE YORBA LINDA WATER DISTRICT AMENDING SECTIONS OF THE PERSONNEL RULES WHEREAS, on May 8, 1980 by adoption of Resolution No. 80-11, the Board of Directors of the Yorba Linda Water District established Personnel Rules of the District, and WHEREAS, the Personnel Rules provide in Section 1.4.2 that the Rules may be amended from time to time by the Board, and WHEREAS, the Board has subsequently amended the Rules and desire to further amend the Rules. NOW, THEREFORE BE IT RESOLVED by the Board of Directors as follows: 1, That Section 3.1 of the Personnel Rules be amended as follows: Section 3.1 - Eaual Onnortunity Policy It shall be the District's policy to recruit, hire, promote or transfer qualified persons regardless of race, religion, color, creed, national origin, ancestry, sex, marital status, handicap or political affiliation, provided however that the District shall make employment decisions on the basis of bonaf ide occupational qualifications when permitted by law. ? That Section 3.2 of the Personnel Rules be amended as follows: Section 3.2 - Recruitment 3.2.1 It is the District's policy to recruit the best qualified candidates to fill each vacant position in the classified service. 32.2 If, as and when a vacancy in the classif ied service is to be filled, the responsible Department Head shall notify the Personnel Officer. 32.3 The Personnel Officer shall then provide public notice of the vacancy, receive applications therefore and evaluate candidates. 2 That Section 3.3 of the Personnel Rules be amended as follows: Section 3.3 - Selection and Annointment 3.3.1 Selection of candidates eligible for appointment, promotion or transfer shall be consistent with Section 3.1 and based on evaluation of personal qualifications, training, work performance and work experience, which shall be ascertained, so far as practical, by competitive selection. Physical, medical and/or written tests may be given as a part of the selection process. 3.3.2 The Personnel Officer shall recommend eligible candidates to the General Manager. The General Manager shall appoint from among the eligible candidates. - 1 - 4. That Section 3.5.1 of the Personnel Rules be amended as follows: 3.5.1 Transfers for the betterment of employees or the best interest of the District are encouraged. J That Section 3.5.3 of the Personnel Rules be amended as follows: 3.5.3 In order to be transferred to a job class with minimum standards of employment substantially different from those of his own job class, an employee shall be required to demonstrate his eligibility for employment in accordance with the provisions of Section 3.3.1. g That Section 3.6 of the Personnel Rules be amended as follows: Section 3.6 - Promotion 3.6.1 Appointment to a vacant position in a job class which is compensated at a higher rate shall constitute a promotion. 3.6.2 In order to be promoted to a job class which is compensated at a higher rate an employee shall be required to demonstrate his eligibility for employment in accordance with the provisions of Section 3.3.1. 7 That Section 3.7.1 of the Personnel Rules be amended as follows: 21,1 Probationary Period Defined: All original and promotional appointments shall be tentative and subject to a probationary period of not less than 6 months' actual service. If the performance of the probationary employee has been satisfactory, the Department Head shall file with the Personnel Officer a statement in writing that such employee has passed probation, is an asset to the District, and should become a permanent employee. If such a statement is not filed by the final day of the probationary period, or extensions granted thereto pursuant to Subsection 3.7.5, the employee will be deemed to have passed probation and shall become a permanent employee. $ That Section 4.1 of the Personnel Rules be amended as follows: Section 4.1 - Forms of Discioline The tenure of every classified employee who has passed probation shall be conditioned by good behavior and satisfactory work performance. Any classified employee who has passed probation may be suspended, demoted or dismissed for reasonable cause. 9 That Section 4.2 of the Personnel Rules be amended as follows: Section 4.2 - Procedure 4.2.1 When a classified employee of the classified service who has passed probation is to be dismissed, demoted or suspended without pay, specific written charges shall be prepared and presented by the employee's Department Head for action by the Personnel Officer. - 2 - XP 0 10 That Section 7.2 of the Personnel Rules be amended as follows: 7.2.1 Classified employees may be considered for merit salary increases. These merit increases to steps within an established salary range shall not be automatic but may be granted only for continued improvement by the employee in the effective performance of the duties of his position as determined at the District's sole discretion. Z ,?,2 A new employee or reclassified employee shall be eligible for consideration for a merit salary increase upon completion of the probation ary period. Subsequent merit salary increase eligibility dates shall be at one (1) year intervals following the completion of the probationary period. All employees shall receive a review on or before this anniversary date. The effective date of any merit salary increase shall generally be at the beginning of the pay peri od following approval of the General Manager. 11 That Section 8.1 of the Personnel Rules be amended as follows: 8.1.1 Employees shall be in attendance at their work in accordance with the rules regarding hours of work, holidays and leaves. All departments shall keep bi-weekly time cards of employees which shall be reported to the Personnel Officer in the form and on the dates he shall specify. Failure on the part of an employee, absent without leave, to return to duty within 48 hours after notice to return has been provided shall be cause for immediate discharge, and such employee automatically waives all rights under these Rules. The depositing in the United States mail of a certified postage paid letter, addressed to the employee's last known place of address shall be reasonable notice. j, That Section 8.2 of the Personnel Rules be amended as follows: 8.2.1 The average regular work week for employees in the classified service shall be 40 hours as scheduled by Department Heads. Department Heads may schedule maintenance and plant operation shifts which include evening, weekend and holiday work. §,2.2 For all classified employees with an average regular work week of 40 hours, the hourly rate of pay shall be twelve times the monthly rate divided by 2,080 (40 hours times 52 weeks). 8.2.3 An employee may request a part-time assignment which shall be granted at the sole discretion of the General Manager or his designee. 8.2.4 All classified employees whose regularly scheduled 40 hour work week or special shift work week includes working hours after 6:00 P.M. and/or before 6:00 A.M. Monday through Friday, and/or any hours on Saturday and/or Sunday and/or holidays, shall be paid a differential equal to their regular hourly rate plus five percent (5%) for each hour worked after 6:00 P.M. and/or before 6:00 A.M. Monday through Friday, and/or all hours worked on Saturday and/or Sunday and/or holidays. 13 That Section 8.4.3 of the Personnel Rules be amended as follows: 8.4.3 The following management/Officer positions shall be exempt from the overtime provisions. Compensatory time off (at the rate of straight time) for - 3 - • • overtime worked by employees in these job classes may be authorized and administered by the General Manager or the Board of Directors. Engineering Manager Financial Manager Office Manager Administrative Aide 14 That Section 8.5.1 of the Personnel Rules be amended as follows: 8.5.1 An employee assigned to standby duty for purposes of being on call to handle emergency situations arising at times other than normal working hours shall be paid at the current rate, as determined by the Board of Directors for each day he is assigned to standby duty. The pay for standby time may be accrued to the second payday in December and paid in a lump sum or it may be paid at the regular pay period in which the standby duty is completed. 1, That Section 9.1 of the Personnel Rules be amended as follows: 9.1.1 The following days shall be recognized as holidays and classified, full-time employees, with the exception of pumping plant operators and employees assigned to special shift work or standby duties for emergency situations shall have these holidays off with pay; provided, however, that the General Manager or the Board of Directors may adjust the dates for observance of the holidays listed below in order to establish four day weekends; in doing so the efficient operation of the District and public acceptance shall be considered. The holiday schedule for the ensuing year will be established and made available to employees in July of each year. (a) July 4th, Independence Day; (b) First Monday in September, Labor Day; (c) September 9th, Admission Day; (d) Second Monday in October, Columbus Day; (e) November 11th, Veterans' Day; (f) Fourth Thursday in November, Thanksgiving Day; (g) Friday following Thanksgiving Day; (h) December 25th, Christmas Day; (i) January 1st, New Year's Day; (j) The third Monday in February, Washington's Birthday; (k) The last Monday in May, Memorial Day. 9.1.3.2 For those classified employees not assigned to special shift work whose scheduled work week is not Monday through Friday, any holiday falling on their scheduled days off shall be taken so as to provide the employee with three consecutive days off, unless another day is designated by the General Manager. 9.1.4 Classified employees assigned to special shift work shall be entitled to receive one day of paid time (an in lieu of holiday) off on a day designated or approved by the District at the regular rate of pay for each holiday, whether or not the holiday falls on a regularly scheduled workday for that employee, so long as the pumping plant is manned and/or a maintenance crew is on duty at work for emergency situations during the holiday period. - 4 - J<4 9.1.5 If classified employees, other than employees assigned to special shift work and employees assigned to standby duty for emergency situations are called in to work on a holiday, they shall receive, in addition to the paid holiday, compensation equivalent to one and one-half times their regular rate of pay for the time actually worked during a regularly scheduled holiday. Such employees may in the alternative receive paid time off in accordance with the terms of Section 8.4.2. I& That Section 9.4.2 of the Personnel Rules be amended as follows: 9.4.2 An employee injured in the scope and course of his employment with the District may elect to take as much of his accumulated sick leave, or his accumulated vacation as when added to his disability indenmity will result in a payment to him of not more than his full salary or wage. 1Z That Section 15.2.2 of the Personnel Rules be amended as follows: 15.2.2 The grievance procedure shall not be used to establish new policies or change any existing rules. It shall not be used in matters resulting from disciplinary action or evaluation content. 18 That Section 15.5 of the Personnel Rules be amended as follows: 15.5.5 Either grievant, Personnel Officer or General Manager may request a meeting to review the grievance prior to a decision. 15.5.6 When it is necessary for a grievant or designated representative to attend a grievance meeting or hearing with management during the workday, he/she will be released without loss of pay in order to permit participation in the foregoing activities provided advance arrangements are made with the employee's Department Head.
