RESOLUTION NO. 87-20
RESOLUTION OF THE BOARD OF DIRECTORS
OF THE
YORBA LINDA WATER DISTRICT
AMENDING SECTIONS OF THE PERSONNEL RULES
WHEREAS, on May 8, 1980 by adoption of Resolution No. 80-11, the
Board of Directors of the Yorba Linda Water District
established Personnel Rules of the District, and
WHEREAS, the Personnel Rules provide in Section 1.4.2 that the rules
may be amended from time to time by the Board, and
WHEREAS, the Board has subsequently amended the rules and desire to
further amend the Rules.
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the
Yorba Linda Water District as follows:
Section I. That Section 7.2.2 of the Personnel Rules shall be
renumbered to Section 7.2.2.1 without any changes in the existing text.
Section 11. That Section 7.2.2.2 shall be added to the Personnel Rules to
read as follows:
7.2.2.2 Merit salary increases from Steps 1 through 3 within an
established salary range require that an employee have 60 or
more points on the regular employee evaluation. In order for an
employee to move to a step above Step 3 within an established
salary range, the employee must have 80 or more points on the
annual employee evaluation. At any time an employee on Steps
4 or 5 within an established salary range fails to achieve 80 or
more points on the employee's annual evaluation, the employee
will be reduced one step, but not below Step 3. Such a step
reduction shall be a function of evaluation content and not be
considered discipline for any purpose.

Section 111. That Section 8.3 of the Personnel Rules shall be amended to
read as follows:
Section 8.3 - Pay Periods a lProcedure
Regular salaries and compensation of all District employees shall be
paid on a biweekly basis. In the event that a regularly scheduled pay
day falls during the time of approved time off, the District, upon
written direction of the employee will either mail the check to a
designated address or deposit the check in a local bank or savings and
loan designated by the employee. If there is no written direction, the
District will hold the check until the employee's return to work.
Section IV, That Section 8.4.3 of the Personnel Rules shall be amended
to read as follows:
843 The following management/officer positions shall be
exempt from the overtime provisions. Compensatory time off
(at the rate of straight time) for overtime worked by
employees in these job classes may be authorized and
administered by the General Manager or the Board of Directors.

Section V. That Section 10.7 shall be added to the Personnel Rules to
read as follows:
Section 10.7 - Retiree Insurance
The District shall pay the amounts provided in Sections 10.3
and 105 of the Personnel Rules for any employee who retires
from the District for a period of time which is equivalent to
one (1) year or proration thereof on a monthly basis for each
three (3) years service to the District or proration thereof on a
quarterly basis. To be eligible for this benefit the employee

must be at least 50 years of age, must have five (5) years of
service with the District, must retire from the District while
in good standing and upon ninety (90) days written notice, and
must remain in retired status. If any benefit period remains
when the employee or their spouse reaches age 65, whichever
is latest, then coverage will convert to Medicare Supplement
for the remainder of the benefit period. For purposes of this
section retired status means that the employee shall not work
for compensation for more than seven hundred twenty (720)
hours in any fiscal year (July 1 through June 30). The District
may require an employee to certify under penalty of perjury
that the employee has remained on retired status and/or submit
to such additional verification as the District deems necessary
to demonstrate retired status. The retired employee must
make any contribution to premiums but no more than the
contribution required of a regular employee pursuant to section
10.3 prior to the first day of the month in which coverage is to
be extended, Failure of an employee to make such payment
shall result in termination of coverage and termination of any
right to any benefit pursuant to this section,
