Home My WebLink About1988-04-14 - Resolution No. 88-16• 0 RESOLUTION NO. 88-16 RESOLUTION OF THE BOARD OF DIRECTORS OF THE YORBA LINDA WATER DISTRICT DETERMINING AND ORDERING ANNEXATION NO. 87-1 TO THE YORBA LINDA WATER DISTRICT WHEREAS, By Resolution No. 88-7, the Board of Directors of the Yorba Linda Water District made application to the Local Agency Formation Commission for approval of a proposal for Annexation No. 87-1 to the Yorba Linda Water District of the territory described in Exhibit "A" and illustrated on Exhibit "B" both attached hereto and by this reference, made a part hereof; and WHEREAS, on April 6, 1988 by Resolution No. 88-18, the Local Agency Formation Commission approved said proposal for annexation, assigned to said annexation the designation of "Annexation No. 87-1 to the Yorba Linda Water District", designated Yorba Linda Water District as the conducting district, directed said District to initiate proceedings in compliance with said resolution; and WHEREAS, the Local Agency Formation Commission further resolved that the Board of Directors of said conducting district is authorized to annex the territory without notice or hearing and without an election pursuant to Section 56837 of the Government Code; and WHEREAS, the Local Agency Formation Commission as lead agency on Annexation No. 87-1 to the Yorba Linda Water District has reviewed and considered the negative declaration certified by The City of Yorba Linda as complete and adequate for the development of the annexation territory and determined their negative declaration to be in compliance with the California Environmental Quality Act; and WHEREAS, the landowners have deposited with the Yorba Linda Water District all annexation fees totaling $1 16,662.97. 0 0 NOW, THEREFORE, the Board of Directors of the Yorba Linda Water District does hereby resolve, order and determine as follows: Section 1: The inclusion of territory proposed by Annexation No. 87-1 to the Yorba Linda Water District will be to the best interest of the District and of the present and future landowners and inhabitants of the District and the territory proposed to be annexed. Section 2: One hundred percent of the owners of land within proposed Annexation 87-1 to the Yorba Linda Water District have consented to Annexation 87-1 and pursuant to order of the Local Agency Formation Commission, Annexation No. 87-1 may occur without notice and hearing and without an election. Sectio 3: Pursuant to the Cortese-Knox Local Government Reorganization Act of 1985, Division III, Title 5, of the Government Code of the State of California and the authorization of the Local Agency Formation Commission of Orange County as set forth in its Resolution No. 88-18, the territory described in Exhibits "A" and "B" attached hereto shall be, and hereby is, annexed to and included within the boundaries of the Yorba Linda Water District. Section 4: Annexation 87-1 to the Yorba Linda Water District shall be subject to the terms and conditions set forth in Resolution No. 88-7 of the Board of Directors of the Yorba Linda Water District and in Resolution 88-18 of the Local Agency Formation Commission of Orange County as follows: (a) The territory within Annexation 87-1 to the Yorba Linda Water District shall be annexed without provision or liability for payment of taxes or expenses of the District incurred prior to the effective date of the annexation. (b) The territory within Annexation 87-1 to the Yorba Linda Water District shall be subject to the privileges and the obligations of said District including the payment of debt services for the Yorba Linda Water District's general obligation bonds for the western service area authorized in 1959. (c) The territory within Annexation 87-1 to the Yorba Linda Water District shall be subject to annexation fees totaling $1 16,662.97 and are to be paid in full prior to the District's Board of Directors determining and ordering the annexation. 6 0 Section 5: The Secretary of the Yorba Linda Water District is hereby authorized and directed to file a certified copy of this resolution with the Executive Officer of the Local Agency Formation Commission of Orange County and make all other filings and pay such fees as are necessary to effect the purposes and intentions of this resolution.
