HomeMy WebLinkAbout1990-11-20 - Resolution No. 90-390 0 RESOLUTION 90-39 RESOLUTION OF THE BOARD OF DIRECTORS OF THE YORBA LINDA WATER DISTRICT AMENDING SECTIONS OF THE PERSONNEL RULES WHEREAS, on May 8, 1980 by adoption of Resolution No. 80-11, the Board of Directors of the Yorba Linda Water District established District Personnel Rules, and WHEREAS, the Personnel Rules provide in Section 1.4.2 that the rules may be amended from time to time by the Board, and WHEREAS, the Board has subsequently amended the rules, and desires to further amend the Rules. NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Yorba Linda Water District as follows: Section 1: That the following section be deleted: 1.7.2 Sexual harassment includes, but is not limited to: The granting of special privileges, conditions of employment or tangible job benefits based on gender or the promise or granting of social or sexual favors; Suggestive, obscene or lewd verbal comments or "cat calls;" Suggestive, obscene or lewd physical gestures; Physical contact which is offensive to the object of such actions; Obvious visual "leering" which is offensive to the object of such actions; The threat or filing of false sexual harassment complaints with the object being the damage of the accused person's reputation. That the following section be added: 1.7.2 Sexual harassment includes, but is not limited to: The granting of special privileges, conditions of employment or tangible job benefits based on gender or the promise or granting of social or sexual favors; Suggestive, obscene or lewd verbal 6 & comments or "cat calls;" Suggestive, obscene or lewd physical gestures; Physical contact which is offensive to the object of such actions; Obvious visual "leering" which is offensive to the object of such actions; The threat or filing of false sexual harassment complaints with the object being the damage of the accused person's reputation; Or any other conduct of a sexual nature which interferes with an individual's work performance or creates an intimidating, hostile or offensive working environment. " Section 2: That the following section be deleted: Section 9.7 - Jurv Dutv/Court Testimonv Any classified employee who is called as a witness or required to serve as a trial juror shall be entitled to be absent from his duties during the period of such service. During these periods of service the employee shall receive full compensation from the District if any additional compensation received, except mileage reimbursement, from the court is submitted to the District Auditor. That the following section be added: Section 9.7 - Jurv Dutv/Court Testimonv An employee who is called as a witness in a matter to which he/she is not a party or required to serve as a trial juror shall be entitled to be absent from his/her duties during the period of such service. During these periods of service, the employee shall receive his/her full pay from the District. As a condition of receiving regular pay, employees must submit any compensation received from the court to the District, excluding mileage reimbursement. 0 • PASSED AND ADOPTED this 20th day of November, 1990 by the following called vote: AYES: ARTHUR C.
