RESOLUTION NO. 92-20
RESOLUTION OF THE BOARD OF DIRECTORS
OF THE YORBA LINDA WATER DISTRICT
ADOPTING SEWER DEVELOPMENT AND
PROCESSING FEES
AND RESCINDING RESOLUTION 92-06
WHEREAS, the Yorba Linda Water District Rules and Regulations for Rendition of Sanitary
Sewer Service include a provision that sewer maintenance charge rates, and
development fees and charges shall be adopted by separate Resolution entitled
Sewer Development and Processing Fees; and,
WHEREAS, the Board of Directors of the Yorba Linda Water District have, from time to
time, adopted Ordinances and Resolutions to change the sewer maintenance
charge rates and development fees for services provided by the District; and,
WHEREAS, the latest Sewer Development and Processing Fees are set forth in Resolution
92-06 adopted on May 14, 1992; and,
WHEREAS, the Board of Directors have accepted a report which recommends establishing a
sewer maintenance charge rates for fiscal year 1992-93 and amending Section
10.09 of the Rules and Regulations.
NOW THEREFORE BE IT RESOLVED by the Board of Directors of the Yorba Linda
Water District to adopt Sewer Development and Processing Fees, and amend Section 10.09 of
the Rules and Regulations as follows:
Section 1: Fees identified in Section 6.01 shall be as follows:

Section 3: Fees identified in Section 9.12 shall be as follows:
9.12 Not less than $300.00 per acre, nor more than $2,000.00 per acre.
Section 4: Fees identified in Section 9.13 shall be as follows:
9.13 Until remaining balance of $1,700.00 per acre (remaining balance of refund is equal to the
total investment per acre in Trunk Sewer facilities less $300.00 per acre less the amount
per acre refunded to date). After the above requirement is satisfied any monies available
for refund shall be calculated in accordance with Section 9.06 including sub-paragraphs A
through J until such time as the original builder has been refunded to his $300.00 per acre
base cost.
Section 5: Fees identified in Section 9.15 shall be as follows:
9.12 Not less than $300.00 per acre, nor more than $2,000.00 per acre.
Section 6: Fees identified in Section 9.17 shall be as follows:
9.17 Until remaining balance of $1,150.00 per acre (remaining balance of refund is equal to the
total investment per acre in Trunk Sewer facilities less $350.00 per acre less the amount
per acre refunded to date). After the above requirement is satisfied any monies available
for refund shall be calculated in accordance with Section 9.06 including sub-paragraphs A
through J until such time as the original builder has been refunded to his $350.00 per acre
base cost.
Section 7: Fees identified in Section 9.23(E) shall be as follows:
9.23(E) Not less than $2,000.00 per acre for each acre of property they are including within the
project for offshe sanitary trunk improvements.
Section 8: Sewer Maintenance Charges identified in Section 15.02 shall be as follows:
15.02 For all other sewer customers in this category who use water meter reading, the rate shall
be as follows:
First 2,200 cubic feet per month of water consumption per month: $2.00 per month.
All water consumption in excess of 2,201 cubic feet per month: $0.30 per 1000 cu. ft.
Alterative for those customers who have a sewer meter or who can demonstrate to the
satisfaction of the District that 100% of the water meter reading ends up in the District's
sewer system, the rate shall be as follows:
First 1,100 cubic feet per month: $2.00 per month
All metered use in excess of 1,101 cubic feet per month at $0.42 per 1000 cu. ft.
Excepting as follows:
a. Residential - Single Family Home $2.00 per month per unit
b. Residential - Multiple Unit $1.40 per month per unit
Section 9: Section 10.09 of the Sewer Rules and Regulations shall read as follows:
10.09 In the event any chemical analysis is required pursuant to these Rules and Regulations,
the customer shall pay for the actual cost of any and all required analysis, plus 20% of
the invoice amount for staff time to process billing to the customer:
Whenever the effluent is found to be in violation of the requirements, another chemical
analysis shall be made within fifteen days to determine if the violation has been
corrected. If the violation has not been corrected, service shall be terminated until such
time as the violation has been corrected to the satisfaction of the General Manager
When violation of the requirements results in damage to the sanitary sewer facilities,
the customer shall be charged for the cost of repairs and/or replacements.
Section 10: The fees adopted herein shall take effect immediately following adoption of
this Resolution.
Section 11: That Resolution 92-06 is hereby rescinded effective immediately following
adoption of this Resolution.
