HomeMy WebLinkAbout1993-08-26 - Resolution No. 93-210 0 RESOLUTION NO. 93-21 RESOLUTION OF THE BOARD OF DIRECTORS OF THE YORBA LINDA WATER DISTRICT ADOPTING LOCKE RANCH SEWER MAINTENANCE ASSESSMENTS AND ELECTING TO HAVE SUCH SEWER MAINTENANCE ASSESSMENTS COLLECTED ON THE FISCAL YEAR 1993-94 TAX ROLL AND RESCENDING RESOLUTION 92-19 WHEREAS, in October 1977 the City of Yorba transferred and conveyed ownership of the Locke Ranch sewer system to the Yorba Linda Water District (herein referred to as 'District"); WHEREAS, the Locke Ranch sewer system is outside the existing boundaries of the District; and, WHEREAS, under authority of the California Health and Safety Code Section 5471 and 5473 the District may levy sewer maintenance assessments on property located outside of the District boundaries, and may elect to have the County of Orange Auditor/Controller collect the sewer maintenance assessment on the County tax bills. WHEREAS. the Board of Directors of the Yorba Linda Water District adopted Resolution No. 92-19 on August 27, 1992, for the purpose of establishing the Locke Ranch sewer maintenance assessment. NOW THEREFORE BE IT RESOLVED by the Board of Directors of the Yorba Linda Water District does hereby resolve, determine and order as follows: Section 1: Resolution 92-19 is hereby rescinded effective immediately following the adoption of this Resolution. Section 2: The Yorba Linda Water District Locke Ranch Sewer Assessments for Fiscal Year 1993-94 and each year thereafter until this Resolution is rescinded or the charge is modified, are hereby approved and adopted at $24.00 per year per assessor parcel and/or commercial unit. Section 3: The Yorba Linda Water District Locke Ranch Sewer Maintenance Assessments are hereby fixed in the amounts and against the assessable parcels of land shown in Exhibit "A" attached hereto and by this reference incorporated herein. Section 4: The Board of Directors elects to have the County of Orange Auditor/Controller collect the assessments fixed herein on the tax roll in the same manner, by the same persons, and at the same time as and together with and not separately from, County taxes. 0 0 Section 5: The General Manager or his designee is authorized and directed to file with the County of Orange Auditor/Controller a copy of this Resolution together with the listing of parcel numbers and amounts of assessments shown in Exhibit "A" and such other documentation as the County Auditor/Controller may require in order to accomplish the purposes of this Resolution. PASSED AND ADOPTED this 26th day of August, 1993 by the following called vote: AYES:4 - Sterling Fox, Carl Scanlin, Michael Beverage & Arthur Korn.
