RESOLUTION NO. 94-15
RESOLUTION OF THE BOARD OF DIRECTORS
OF THE YORBA LINDA WATER DISTRICT
ADOPTING SEWER DEVELOPMENT AND
PROCESSING FEES
AND RESCINDING RESOLUTION 93-27
WHEREAS, the Yorba Linda Water District Rules and Regulations for Rendition of Sanitary
Sewer Service include a provision that sewer maintenance charge rates, and
development fees and charges shall be adopted by separate Resolution entitled
Sewer Development and Processing Fees; and,
WHEREAS, the Board of Directors of the Yorba Linda Water District have, from time to
time, adopted Ordinances and Resolutions to change the sewer maintenance
charge rates and development fees for services provided by the District; and,
WHEREAS, the latest Sewer Development and Processing Fees are set forth in Resolution
93-27 adopted on October 28, 1993; and,
WHEREAS, the public and interested parties were notified of the public hearing to consider
changes in fees fourteen (14) days prior to adoption; and
the fees collected pursuant to this Resolution shall be used to finance costs
necessitated by the services provided by the District
EFORE BE IT RESOLVED by the Board of Directors of the Yorba Linda
to adopt Sewer Development and Processing Fees as follows:

Section 3: Fees identified in Section 9.12 shall be as follows:
9.12 Not less than $300.00 per acre, nor more than $2,000.00 per acre.
Section 4: Fees identified in Section 9.13 shall be as follows:
9.13 Until remaining balance of $1,700.00 per acre (remaining balance of refund is equal to the
total investment per acre in Trunk Sewer facilities less $300.00 per acre less the amount
per acre refunded to date). After the above requirement is satisfied any monies available
for refund shall be calculated in accordance with Section 9.06 including sub-paragraphs A
through J until such time as the original bui
lder has been refunded to his $300.00 per acre
base cost.
Section 5: Fees identified in Section 9.15 shall be as follows:
9.15 Not less than $300.00 per acre, nor more than $2,000.00 per acre.
Section 6: Fees identified in Section 9.17 shall be as follows:
9.17 Until remaining balance of $1,150.00 per acre (remaining balance of refund is equal to the
total investment per acre in Trunk Sewer facilities less $350.00 per acre less the amount
per acre refunded to date). After the above requirement is satisfied any monies available
for refund shall be calculated in accordance with Section 9.06 including sub-paragraphs A
through J until such time as the original builder has been refunded to his $350.00 per acre
base cost.
Section 7: Fees identified in Section 9.23(E) shall be as follows:
9.23(E) Not less than $2,000.00 per acre for each acre of property they are including within the
project for offshe sanitary trunk improvements.
Section 8: Section 10.09 of the Sewer Rules and Regulations shall read as follows:
10.09 In the event any chemical analysis is required pursuant to these Rules and Regulations,
the customer shall pay for the actual cost of any and all required analysis, plus 20% of
the invoice amount for staff time to process billing to the customer.

Whenever the effluent is found to be in violation of the requirements, another chemical
analysis shall be made within fifteen days to determine if the violation has been
corrected If the violation has not been corrected, service shall be terminated until such
time as the violation has been corrected to the satisfaction of the General Managen
When violation of the requirements results in damage to the sanitary sewer facilities,
the customer shall be charged for the cost of repairs and/or replacements.
Section 9: The fees adopted herein shall take effect immediately following adoption of
this Resolution.
Section 10: That Resolution 93-27 is hereby rescinded effective immediately following
adoption of this Resolution.
