The property is approximately 0.69 acres and is located within the District's Western Service Area. An exhibit depicting the project location is attached. STAFF RECOMMENDATION: That the Committee recommend the Board of Directors approve the Terms and Conditions for Sewer Service with Mr. David Dickinson, 5111 Los Altos Drive, Yorba Linda, Job 201316. DISCUSSION: The proposed project is located in Drainage Area 1," within the District's Western Service Area. The applicant will be responsible for extending the existing 6 inch diameter sewer line in Los Altos Drive, northerly for approximately 108 linear feet, to the terminus of the street, as shown on the attached exhibit. Additional required improvements include: a house lateral to the Dickinson's residence, two sewer laterals for potential future connections, and a new manhole. Once the proposed facilities are completed, they'll be dedicated to the District, which is consistent with District policy. The applicant will be entitled to future reimbursements for future connections, within the frontage of this sewer main extension, in accordance with the District's Sewer Rules and Regulations. A District representative shall be present to witness the flow test. 22) _ The applicant shall comply with all additional District requirements, relative to the fire protection system, fire hydrant construction and fire hydrant locations. 23) _ The applicant shall install one 1 water Sampling Station(s) in conformance with the District's Standard Plans. 24) _ The applicant shall provide a completed Surety Bond for the water facilities prior to the District signing the Water Improvement Plans. The applicant shall also provide to the District an estimate of the construction costs of the proposed water facilities. 25) _ The applicant shall install the curb and gutters a minimum of one week prior to the installation of the water main and services. 26) _ All existing water services that are not useable in the new plan shall be cut and plugged at the main line. 27) _ The applicant shall coordinate through the District all connections of new water facilities to the existing District facilities. 28) _ The applicant shall provide a written copy of the Bacteriological Report prior to occupancy releases certifying that the water meets the Health Department's requirements. 29) _ The applicant shall adjust and raise to grade all valve covers within the limits of this project. 30) _ The applicant shall install a pressure regulator in all dwellings that have over 80 p.s.i. static water pressure in accordance with the appropriate building codes. 31) _ The applicant shall complete a Temporary Water Permit for all water that will be used through the new water services to serve the new dwellings. 32) _ The applicant shall install a District approved backflow device in connection with any private fire suppression sprinkler facilities that may be required by the Orange County Fire Authority or fire agency having jurisdiction. 33) _ The applicant shall install a reduced pressure principle backflow prevention device on all commercial buildings and landscape services. Page4of5 NAME OF APPLICANT: DAVID DICKINSON LOCATION OF PROJECT: 5 111 LOS ALTOS DRIVE, YORBA LINDA 34) _ The applicant shall install and provide a written test report to the District for each backflow device certifying that the backflow devices are operating properly prior to the water meters being turned on for service. 35) _ The applicant shall install and provide a written test report to the District certifying that the double check detector assembly is operating properly prior to the double check detector assembly being turned on for service. 36) _ The applicant shall provide an annual written test report to the District certifying that the backflow devices and fire detector assemblies are operating properly pursuant to the District's Backflow Prevention Program and the State of California Administrative Code, Title 17, Public Health Rules and Regulations Relating to Cross - Connections. 37) The applicant shall complete a Sewer Connection Application and Permit for Sewer Service. 38) X The applicant shall complete an Application to and Agreement for Sewer Service. 39) X The applicant shall comply with the Rules and Regulations of the Yorba Linda Water District with regard to the Rendition of Sanitary Sewer Service. 40) X The applicant shall pay all of the sewer fees as required by the Rules and Regulations of the District. 41) X The applicant shall have all sewer facilities designed in accordance with the District's Sewer Master Plan and Standard Specifications. All design plans shall be prepared under the supervision of and stamped by a Registered Civil Engineer licensed to practice in the State of California. 42) X The applicant shall provide a completed Surety Bond for the sewer facilities prior to the District signing the Sewer Improvement Plans. The applicant shall also provide to the District an estimate of the construction costs of the proposed sewer facilities. 43) X The applicant's sewer facilities (on -site) shall be District owned and maintained. 44) X The applicant shall construct a sewer main and appurtenances in conformance with the approved plans and the District's Plans and Specifications. 45) X The applicant shall adjust and raise to grade all sewer manhole covers within the limits of this project. 46) X The applicant shall install a sewer backflow prevention valve on all sewer service connections in which the pad elevations of the property being served is lower than the rim elevation of the upstream manhole. The video of the sewer facilities shall be conducted in the presence of the District inspector, which will include stationing locations of manholes, cleanouts, wyes, laterals, backflow devices and appurtenances. The current property owners, the Harold and Elsie Q. Gelber Trust, are converting the existing Yorba Linda Bowl into a new retail market, The Fresh Market, in conjunction with various on site improvements that involve modifications to the building's exterior elevations, parking lot, landscaping and pylon sign. The owners of The Fresh Market are requesting to construct a new monument sign with concrete block and footing to replace the existing pylon sign, inside the easement as shown on the attached exhibit. Staff reviewed the request and recommends approval subject to the execution of a Declaration of Restrictive Covenants. STAFF RECOMMENDATION: That the Committee recommend the Board of Directors authorize the President and Secretary to execute the Declaration of Restrictive Covenants with the Harold and Elsie Q. Gelber Trust, c/o Daniel H. Wampole, Trustee for The Fresh Market. DISCUSSION: Property owners at 18171 Imperial Highway, the Harold and Elsie Q. Gilber Trust, requested permission to replace an existing pylon sign with a new monument sign consisting of concrete block with stone veneer facing. Additional proposed improvements within the waterline easement include landscaping, with trees outside the easement. At staffs request the owner had the water main potholed to determine the depth and confirm the alignment. The water main was found to have five feet of cover in this area which allows for easier access for repair and assures minimal loading from the proposed improvements. The improvements run across the water pipeline within the easement, as shown on the attached exhibit. In discussions with the owners, it was determined that there was no other reasonable location for the sign outside of the easement area. Staff reviewed the applicant's request and determined the improvements would have minimal impact on operations and maintenance of the District's facilities. To further protect the District's interest, staff recommends the execution of the attached Declaration of Restrictive Covenants. Successors and Assigns Bound. Since Owner wishes to pursue the Encroachment, this Declaration obligates the current and future owners of the Subject Property to remedy any future adverse events and to fund any necessary maintenance costs on the Easement and /or Subject Property that may arise in full or in part due to the existence, construction, or damages caused by the Encroachment. 3. Damages to District Facilities. Owner assumes full responsibility, liability and shall pay for any cost(s) or damage(s) to the District Facilities and appurtenant structures, arising from or related to the construction, existence, and /or use of the Improvements. YLWD shall not be responsible for any cost(s) or damage(s) to the District Facilities and appurtenant structures that arise from the Encroachment. 4. Damages to Third Parties. Owner, its successors or assigns, agrees to indemnify and hold YLWD, its officers, directors, employees, agents and consultants, harmless against any third ON parry claims related to or arising out of the construction, existence and /or use of the Improvements. 5. Dama6es to Improvements. Owner acknowledges that the Improvements may be damaged or demolished to permit reasonable access to or reasonable work within and under the Easement area. YLWD, its officers, directors, employees, agents and consultants, shall not be responsible for any damage(s) to or because of the Improvements which results from YLWD's exercise of rights under the Easement. Owner, its successors or assigns, waives all known, unknown, and future claims, liabilities, causes of action, and expenses (including, but not limited to, attorneys' fees) against YLWD, its officers, directors, employees, agents and consultants, for losses and damages to the Improvements and from any obligation to protect, preserve, repair, or replace the Improvements. Construction, use, protection, repair and replacement of the Improvements shall be entirely the risk and obligation of Owner, its successors or assigns, even if damage is caused by YLWD. A summary of the item discussed is as follows: 1. Water Quality Issues: OCWD water quality staff provided an update on the California Department of Public Health's, (CDPH) proposed drinking water standards for Hexavalent Chromium (Cr6). In 2011 the final Public Health Goal (PHG) for Cr6 was set at 0.02 parts per billion (ppb). PHG's are not enforceable standard, but they are used as a guide to help set the maximum contaminant levels (MCL), which are enforceable. In 2013 CDPH established the proposed MCL for Cr6 at 10 ppb, and opened the review period to receive public comments. The public comment period ended on October 11, 2013. The level of Cr6 found in Yorba Linda Water District's groundwater ranges between 0.2 to 1.0 ppb, well below the proposed MCL. MWD lists the Cr6 level in its import water as "Non- detect." 2. June 30, 2013 Accumulated Overdraft: OCWD reported on the accumulated overdraft as of June 2013. Last year's rainfall total at OCWD Field Headquarters was 5.8 inches; the annual historical average at this location is 14.5 inches. The combination of low rainfall and increasing demands has the groundwater basin's current overdraft at an estimated 290,000 acre feet, which puts the basin in the middle of its operating range. In response OCWD is purchasing 20,000 acre feet of untreated full service water from MWD, and will access 12 million dollars from its reserve account to purchase an additional 19,000 acre feet of recharge water throughout the year. 3. Update on North and South Basin lawsuits: South Basin Update: • This past summer the Judge dismissed all OCWD suits. The judge claimed that OCWD didn't have the legal right to sue. OCWD is filing an appeal on the premise that they are responsible for managing the basin, which in turn gives them the right to file a lawsuit if the basin is impacted by water quality contamination. • Two defendants have a mandatory settlement meeting on October 10, 2013. • In the meantime OCWD staff will be recommending a monitoring well project to their Board, so they can do a better job of tracking the plume. North Basin Update: • So far OCWD has recovered $20 million in settlements against contaminators in the North basin. However they are still in litigation and aren't expecting the final rulings until 2014 at which time they can appeal. • North basin extraction wells have been constructed, but the pipeline project has been put on hold while staff evaluates other cleanup options. 4. Annexation Update: According to OCWD staff, a party opposing the Annexation Project or EIR has until November 2, 2013 to file a lawsuit. If no lawsuits are filed the process moves to LAFCO which could take up to five months. Golden State Water was asked if they had any comments or would like to respond. They responded very simply, "no ". 5. Summary of September 26th Seawater Intrusion Meeting: In November the groundwater producers will begin discussing a formal policy for managing the water levels near the coast. Preliminary discussions were to have some type of process that will trigger action based on water levels. 6. Burris Basin — Potential lease for power plant: A private firm has approached OCWD with what appears to be a very lucrative offer for leasing the property at Burris Basin to build a power peaking plant. The firm would like to lease 19 acres by the end of this year. OCWD has not received the terms or even the real dollar cost at this time. The City of Anaheim is strongly opposed to the project and is working very hard to stop it. OCWD commented that it may be possible to build the plant on half the site and use the other half for open space or recreational facilities. 7. MWDOC Consolidation Discussions Update: Discussions are ongoing and at this point they are theoretical. Attorneys are looking at district acts and alike to see if it is even possible to join these two agencies. 8. Ocean Desalination: This process is moving very slowly. OCWD board has a list of about 12 questions that they have asked staff to look into. Staff is expecting to have a report that answers these questions to their boards in December. The process to select a Citizens Advisory Committee continues. The goal is to have a CAC with 20 -25 local citizens in place in the near future.
