ACTION ITEMS

1. Approval of Salary Adjustments
Recommendation: The Committee recommend the Board adopt
Resolution 08-16 Approving the Number of Authorized Positions for Fiscal
Years 2007-09 and Amending Resolution No. 08-11.
2. Damage Claim filed by Hong Nguy,
Recommendation: That the Committee recommend to the Board to reject
and refer the claim to ACWA/JPIA.

Subject: Approval of Salary Adjustments
PURPOSE:
The purpose of this report is for the Personnel-Risk Management Committee to approve and recommend
to the Board of Directors adoption of Resolution 08-16 approving the number of Authorized Positions for
Fiscal Years 2007/09 and Amending Resolution No. 08-11 at the next Board meeting scheduled for
January 22, 2009.
DISCUSSION:
• For the past four (4) months, the Human Resources Department has actively participated in conducting a
salary survey on all fifty-seven (57) District positions. Per the District's current Memorandum of
Understanding (MOU) and Employee Compensation Agreements the District agreed to conduct a
compensation study using data from the California Public Agencies Compensation Survey (CaIPACS)
database prior to the end of FY 2007/2008.
Per the MOU and Employee Compensation Agreements, if the District determines that the District's top
step is under 9.55% of the median of similar classifications maintained by similar public entities, the
District will present to the Board of Directors a recommendation to adjust those classifications by up to
two (2) ranges with a step placement which limits the actual increase to 5% effective July 1, 2008.
After reviewing the salary survey, staff determined various District positions were 9.55% or greater below
the median.

Staff is recommending thirteen (13) full time positions be upgraded in salary by one (1) range with a step
• placement which limits the actual increase to 5% as opposed to the actual percentages below the
median as identified in this report.
Results from the survey indicated that various Yorba Linda Water District positions are significantly lower
than the median salary for those specific positions.
FISCAL IMPACT:
Long range the fiscal impact to the Yorba Linda Water District will be approximately $47,000 per year in
salaries alone to upgrade the positions identified above.
COMMITTEE RECOMMENDATION:
That the Committee recommends to the Board of Directors adoption of Resolution 08-16 Approving the
Number of Authorized Positions for Fiscal Years 2007-09 and Amending Resolution No. 08-11.

• RESOLUTION OF THE BOARD OF DIRECTORS
OF THE YORBA LINDA WATER DISTRICT
APPROVING THE NUMBER OF AUTHORIZED POSITIONS
FOR FISCAL YEARS 2007109
AND AMENDING RESOLUTION NO. 08-11
WHEREAS, the Board of Directors of the Yorba Linda Water District adopted
Resolution No. 80-11 on May 8, 1980 the "Yorba Linda County
Water District Personnel Rules"; and,
WHEREAS, the "Personnel Rules", as amended, direct that the number of
Authorized Positions and Salary Ranges are subject to approval by
the Board of Directors; and,
WHEREAS, the Board has by Resolution No. 08-11, adopted September 25,
2008 approving the number of Authorized Positions for fiscal years
2007/09; and,
WHEREAS, it is the desire of the Board of Directors to adopt Authorized
Positions for Fiscal Years 2007/09, as set forth in Exhibit "A",
attached hereto and amend Resolution No. 08-11.
• NOW THEREFORE BE IT RESOLVED by the Board of Directors of the Yorba
Linda Water District as follows:
Section 1. The number of Authorized Positions as set forth in Exhibit "A"
attached hereto is approved and adopted for Fiscal Years 2007/09.
Section 2. The General Manager is hereby authorized to employ up to the
number of employees authorized in each fiscal year without further
approval of the Board of Directors.
Section 3. The General Manager is hereby authorized to fill an authorized
position that is vacated while this Resolution is active with a new
employee at a lower or equal classification. The General Manager
is further authorized to fill an authorized position with a part time
employee or contract staff.

Subject: Damage Claim
SUMMARY:
The District received the attached written Application for Leave to Present a Late Claim on
December 31, 2008 along with the original claim seeking reimbursement for property related
damages as a result of flooding caused when a 12" water main line broke behind the property.
DISCUSSION:
• On October 13, 2008, the District received a claim from Ms. Hong Nguy requesting
reimbursement in the amount of $4,820 for property damages caused by flooding to her back
yard when a 12" water main line broke behind her property. The incident occurred at
Ms. Nguy submitted the claim lacking the exact date of
the incident and location.
Staff investigated and reviewed the submitted claim and located a copy of a Yorba Linda Water
District Customer Service Report indicating the incident occurred on January 30, 2008. Staff
returned the claim to claimant because it was not presented within the time required by law (six
(6) months from the date of the incident).
Based on the written Application to Present a Late Claim submitted by claimant and review of
the Customer Service Report, staff is recommending the claim be rejected and referred to
ACWA-JPIA for further processing.
COMMITTEE RECOMMENDATION:
That the Personnel/Risk Management Committee recommend to the Board of Directors to reject
the claim and refer to ACWA-JPIA.
