Subject: Damage Claim
SUMMARY:
The District received the attached claim seeking reimbursement for property related damages
as a result of flooding caused when a 12" water main line broke behind the property.
DISCUSSION:
On October 13, 2008, the District received a claim from Ms. Hong Nguy requesting
reimbursement in the amount of $4,820 for property damages caused by flooding to her back
yard when a 12" water main line broke behind her property. The incident occurred at
Ms. Nguy submitted the claim lacking the exact date of
the incident and location.
Staff investigated and reviewed the submitted claim and located a copy of a Yorba Linda Water
District Customer. Service Report to find out the exact date of the incident. The incident
occurred on January 30, 2008, based on the documents submitted by claimant and review of
the Customer Service Report staff is recommending the claim be rejected and referred to
ACWA-JPIA for further processing.
COMMITTEE RECOMMENDATION:
The Personnel/Risk Management Committee recommends to the Board of Directors to reject
the claim and refer to ACWA-JPIA.

Subject: Damage Claim
SUMMARY:
The District received the attached claim seeking reimbursement for claimant's insurance
deduction for property related damages resulting from the Triangle Complex Fire incident.
DISCUSSION:
On December 5, 2008, the District received a claim from Mr. Dennis Winzen requesting
reimbursement in the amount of $5,000 for his insurance deductable. Mr. Winzen is claiming
his hillside burned during the Triangle Complex Fire because his sprinklers could not operate
due to a failure to the City's water pressure. Mr. Winzen provided pictures and estimates to
restore the burnt hillside. The incident occurred at

and referred to ACWA=JPIA for further processing.

The Personnel/Risk Management Committee recommends to the Board of Directors to reject

Subject: Approval of Salary Adjustments and Position Reclassifications
PURPOSE:
The purpose of this report is for the Personnel-Risk Management Committee to approve and
recommend to the Board of Directors adoption of Resolution 08-XX approving the number of
Authorized Positions for Fiscal Years 2007/09 and Amending Resolution No. 08-11 at the next
Board meeting scheduled for December 23, 2008. Staff recommends fifteen (15) full time
positions be upgraded in salary to the median salary of similar classifications maintained by
similar public entities and reclassify one (1) position title from a Safety and Training Officer to a
• Safety/Environmental and Training Officer.
DISCUSSION:
For the past four (4) months, the Human Resources Department has actively participated in
conducting a salary survey on all fifty-seven (57) District positions. Per the District's current
MOU and Employee Compensation Agreements the District agreed to conduct a compensation
study using data from the California Public Agencies Compensation Survey (CaIPACS)
database prior to the end of FY 2007/2008 with any salary adjustments becoming effective July
1, 2008 respectively.
Data from the CalPACS database was acquired and used for the purpose of determining
whether the District's top salary step for a specific classification was 9.55% or greater below the
median of the top step for other similarly situated classifications performing similar work in
similar public entities.
After reviewing the salary survey, staff determined various District positions were 9.55% or
greater below the median. Below is a list of positions identified being 9.55% or greater below
the median salary for the specific position:

Any position that is recommended for a salary adjustment will be adjusted by up to three (3)
ranges with a step placement of a minimum of 5%.
Results from the survey indicate that various Yorba Linda Water District positions are
significantly lower than the median salary for those specific positions.
Also, staff is recommending changing the title of the Safety and Training Officer to a
Safety/Environmental and Training Officer.
FISCAL IMPACT:
Long range the fiscal impact to the Yorba Linda Water District will be approximately $106,000
per year in salaries alone to upgrade the positions identified above.
• COMMITTEE RECOMMENDATION:
That the Committee recommends to the Board of Directors adoption of Resolution 08-XX
Approving the Number of Authorized Positions for Fiscal Years 2007-09 and Amending
Resolution No. 08-11.

• RESOLUTION OF THE BOARD OF DIRECTORS
OF THE YORBA LINDA WATER DISTRICT
APPROVING THE NUMBER OF AUTHORIZED POSITIONS
FOR FISCAL YEARS 2007/09
AND RESCINDING RESOLUTION NO. 08-11
WHEREAS, the Board of Directors of the Yorba Linda Water District adopted
Resolution No. 80-XX on May 8, 1980 the "Yorba Linda County
Water District Personnel Rules"; and,
WHEREAS, the "Personnel Rules", as amended, direct that the number of
Authorized Positions and Salary Ranges are subject to approval by
the Board of Directors; and,
WHEREAS, the Board has by Resolution No. 08-11, adopted September 25,
2008 approving the number of Authorized Positions for fiscal years
2007/09; and,
WHEREAS, it is the desire of the Board of Directors to adopt Authorized
Positions for Fiscal Years 2007/09, as set forth in Exhibit "A",
attached hereto and rescind Resolution No. 08-11.
• NOW THEREFORE BE IT RESOLVED by the Board of Directors of the Yorba
Linda Water District as follows:
Section 1. The number of Authorized Positions as set forth in Exhibit "A"
attached hereto is approved and adopted for Fiscal Years 2007/09.
Section 2. The General Manager is hereby authorized to employ up to the
number of employees authorized in each fiscal year without further
approval of the Board of Directors.
Section 3. The General Manager is hereby authorized to fill an authorized
position that is vacated while this Resolution is active with a new
employee at a lower or equal classification. The General Manager
is further authorized to fill an authorized position with a part time
employee or contract staff.

• Section 4. That Resolution No. 08-XX and all conflicting minute orders are
hereby rescinded effective December 23, 2008.

Salary set by Board
Staff may fill several new authorized positions with a part-time employee or contract staff.
If determined the General Manager is hereby authorized to replace any part-time employee
or contract staff with full-time employees if a need exists.
Per Bargaining agreements the District would conduct a salary survey and adjust the salaries of
those classifications whose top step was 9.55% or greater below the median of similar
classifications maintained by similar public entities effective July 1, 2008. Several positions
have been adjusted based on the results from the salary survey.
